Entre ellas, incorporó el artículo 245 bis a la LCT que pretendió regular los despidos discriminatorios. Así, pretendió modificar la reinstalación como remedio frente a un despido discriminatorio (fallo Álvarez), establecer una indemnización tarifada, versus una indemnización plena que surge de la ley antidiscriminatoria, y pretendió modificar el estándar de prueba para los casos de trato desigual en los despidos discriminatorios (precedente Sisnero).
Sostengo que esta reforma modifica interpretaciones que realizó la Corte Suprema de Justicia de la Nación sobre el principio de igualdad, y que por tanto, resultan inconstitucionales, ya que no podrían modificarse por ley.

En este trabajo señalo que la Corte utilizó el estándar equivocado para hacer el análisis, en tanto no debió utilizar "mera razonabilidad" sino "impacto desproporcionado". Este es el segundo caso en el año donde la Corte Suprema aplica erróneamente las doctrinas del derecho antidiscriminatorio.

El nuevo DNU no garantiza ni el principio de inocencia ni el debido proceso y permite la expulsión de personas migrantes sin que sea necesario que se pruebe que han sido culpables de la comisión de algún delito.
El Tribunal Superior de Justicia de la Ciudad estableció una jurisprudencia en materia de subsidi... more El Tribunal Superior de Justicia de la Ciudad estableció una jurisprudencia en materia de subsidio habitacional que divide a la población beneficiaria en tres grupos con distinta prioridad: personas mayores o con discapacidad, familias con niños menores de edad, y el resto de los beneficiarios. En base a ello, otorga mayor protección constitucional, o ninguna, según entienda que la persona "merece" o "no merece" el subsidio estatal. Por su parte, autores reconocidos de filosofía política han discutido cuáles deberían ser los parámetros para las transferencias de ingresos estatales. En un intento de aplicar las discusiones filosóficas relevantes a los conflictos resueltos por los Tribunales, este trabajo analiza la compatibilidad de esta jurisprudencia desde la Teoría de la Justicia de Rawls, y desde las teoría igualitarista de la suerte de Ronald Dworkin. Así puede observarse que las categorías sostenidas por el TSJ no podrían ser sostenidas desde ninguna Teoría de la Justicia.

This paper analyzes the compatibility between public law litigation and popular constitutionalism... more This paper analyzes the compatibility between public law litigation and popular constitutionalism. At first, it seems that using Courts to promote a law reform is incompatible with a theory that pretends to undermine the judges' power. However, I think there is no incompatibility. To explain this idea I will use the case for the sanction of the same sex marriage law in Argentina, promoted by the Argentinean Federation LGTB (lesbian, gay, transexual and bisexual). LGTB collective used at the same time both a judicial strategy and a parliamentary strategy to get the same sex marriage law passed by Congress, what happened in 2010. At first, in 2007 they promoted a lawsuit to obtain that the Supreme Court set, with the last word, the correct constitutional interpretation about the same sex marriage. Nevertheless, before the Supreme Court speaks, and because of the delay that the Supreme Court was taking on doing it, they changed the strategy. Then, they started a parliamentary strategy (lobby), and also they promoted a lot of individual lawsuits clamming for authorization to get married, at first stage Courts (district and local courts) in different provinces. Finally, they obtained the first authorization from a judge in Buenos Aires City local court, what gives the same sex marriage public visibility and interest. This case was very important to install the issue on the public agenda, and because of this (and the lobby, of course), Congress started to discuss the legal reform. During the discussion at the House Committees, four other local judges also gave authorization to marry to same sex couples, providing legal arguments to representatives that supported the initiative. Finally, the law was passed by Congress, and the Supreme Court never ruled the point. In this case, the judicial strategy reinforced the legislative debate. This is a good example of how you can use public law litigation in a framework of popular constitutionalism. It has to be pointed out that this case was ruled by local judges, who did not pretended to have the last word on constitutional interpretation. Also, that the Supreme Court did not ruled the case timely. The same sex marriage was a public law litigation, but it was not an structural reform lawsuit. Nevertheless, I think that popular constitutionalism is also compatible with structural cases, when the remedies are thought in an experimentalist model (in terms of Sabel and Simon). In this model, the judge calls the public officer, the agency, and the interested people (parties, amicus, and the like) to create and negotiate a institutional reform that respects the Constitution. But is not the judge who decides the reform itself (as it could happen in a model of command and control), but the public officer and the parties. I think that this experimentalist model of remedies in structural cases, is compatible with a popular constitutionalism theory. The same sex marriage case provided a good opportunity to think on how to articulate the public law litigation within a model of judicial intervention compatible to a democratic system, that assures that the Constitution remains in the hands of the people, and not the judges.
La presidenta de la Nación envió al Senado un proyecto de nuevo código civil, realizado por una c... more La presidenta de la Nación envió al Senado un proyecto de nuevo código civil, realizado por una comisión de expertos en la temática, que propusieron unificar los códigos civil y comercial, y actualizarlos con algunas incorporaciones que estaban en discusión doctrinaria desde hace varios años. Esta comisión de expertos trabajó a puertas cerradas, y es ahora el Congreso de la Nación quién dará una discusión un poco más abierta sobre las reformas propuestas. El código civil establece la base del derecho privado, pero esto no significa que la discusión que deba realizarse no sea política. El código regula las relaciones entre los particulares, y las decisiones sobre a qué parte fortalecer en la relación o cómo llevar adelante las negociaciones, son eminentemente políticas. Aquí es dónde se verá qué decisiones prefiere adoptar el Congreso según las diferentes ideologías en pugna. Lamentablemente, pudo observarse que en este nuevo proyecto de código civil los pobres han sido invisibilizados. Se sigue partiendo de la base en que los contratos son el fruto del consentimiento entre partes iguales, y se olvida que la actual protección al derecho de propiedad y el statu quo existente provoca que no todas las partes tengan igual poder de negociación. Los pobres en general son los débiles en las negociaciones, frente a empresas o personas jurídicas que cuentan con mayor información, profesionalismo y no tienen urgencias. Muchas veces su consentimiento no es plenamente libre. Como intentaré mostrar en este artículo, sin regulación estatal, las empresas con poder de mercado actúan con el objetivo de extraer las mayores ganancias posibles frente a las partes más débiles. De este modo, a diferencia de lo que podría plantear alguna teoría de justicia igualitaria, son los pobres los que terminan pagando más caro por los bienes y servicios que consumen en virtud de que no tienen un poder de negociación que los proteja contra los abusos del poder de mercado de empresas que buscan maximizar sus ganancias.
Este escrito examina el Consejo de la Magistratura argentino a partir del marco teórico desarrol... more Este escrito examina el Consejo de la Magistratura argentino a partir del marco teórico desarrollado por Garoupa y Ginsburg en su trabajo empírico, que según el autor logra demostrar la relación que existe entre la independencia judicial, la rendición de cuentas y la estructura de los Consejos de la Magistratura. en primer lugar, establece los problemas metodológicos que dificultaron el proyecto empírico de Garoupa y Ginsburg. Para concluir que los indicadores usados por los autores dejan a un lado variables importantes como el pluralismo y la rendición de cuentas. Por último, analiza el caso del Consejo de la Magistratura argentino para concluir que la discusión actual se centra en la composición del Consejo y en el ajuste de la independencia y la rendición de cuentas.

In this case, the judicial strategy reinforced the legislative debate. This is a good example of how you can use public law litigation in a framework of popular constitutionalism. It has to be pointed out that this case was ruled by local judges, who did not pretended to have the last word on constitutional interpretation. Also, that the Supreme Court did not ruled the case timely.
The same sex marriage was a public law litigation, but it was not an structural reform lawsuit. Nevertheless, I think that popular constitutionalism is also compatible with structural cases, when the remedies are thought in an experimentalist model (in terms of Sabel and Simon). In this model, the judge calls the public officer, the agency, and the interested people (parties, amicus, and the like) to create and negotiate a institutional reform that respects the Constitution. But is not the judge who decides the reform itself (as it could happen in a model of command and control), but the public officer and the parties. I think that this experimentalist model of remedies in structural cases, is compatible with a popular constitutionalism theory.
The same sex marriage case provided a good opportunity to think on how to articulate the public law litigation within a model of judicial intervention compatible to a democratic system, that assures that the Constitution remains in the hands of the people, and not the judges.
