Recognizing the perceived need for universal health insurance coverage for all citizens and those legally residing in the United States, the United States Congress and President Barack H. Obama enacted and signed Public Law 111-148 “The Patient Protection and Affordable Care Act” and Public Law 111-152 “The “Health Care and Education Reconciliation Act of 2010” collectively known as the “Affordable Care Act” (ACA) often referred to as “Obamacare”. As the one of the laws title suggests, in addition to expanding health care through government welfare insurance programs, government welfare subsidies for private insurance, mandatory employee coverage for most businesses, and mandatory private insurance for anyone not covered by the other categories, it also provides newer and enhanced protections for all consumers of health insurance. The key focus of this pamphlet is the protection afforded to consumers from retroactive policy rescissions when submitting claims to your health care insurance carrier.
