Abstract; This work supports the idea of moral ascendancy to solve conflicts that may arise in cases of maternity subrogated in countries where there is no regulation of the institute. Moral ascendancy would be derived solely from the fact of taking the desire to have a child through surrogacy and make it viable. This consideration allows, for all cases, the same rules are applied to the natural biological ancestry, by analogy, with only the variation of the concept of motherhood and fatherhood for the field simply moral, forgetting the classic qualifications of family members. This design is the one that protects, on all sides, the embryo and their equality with all conceived naturally.
