Se analizan tópicos que tradicionalmente no son tratados en los manuales y que se estiman como fundamentales para comprender el actual desarrollo de esta área del derecho, no solo en nuestro país sino también fuera de nuestras fronteras. Así, el libro incluye una amplia sección dedicada a los mecanismos colaborativos de resolución de conflictos (ADR), temática que ha experimentado un significativo crecimiento normativo en los últimos años. Este crecimiento, se ha visto potenciado en el ámbito procesal civil, aspecto que se aborda en esta segunda edición. También, junto con actualizar el capítulo que examina el derecho a un debido proceso, incluyendo los más recientes fallos de tribunales
internacionales vinculantes para nuestro país, en la presente edición se incorpora un nuevo capítulo referido al derecho de acceso a la justicia.
En esta segunda edición, el libro amplía el tratamiento de tópicos tradicionales, como los fines del proceso y el rol del juez y de las partes. Sin embargo, lo hace desde una perspectiva que integra consideraciones de políticas públicas, derecho comparado y de reformas procesales, ofreciendo una visión sistémica del proceso judicial que lo sitúa dentro del contexto nacional e internacional en vista de las demandas y exigencias ciudadanas que en la actualidad experimentan los sistemas de justicia.
Si bien la obra ofrece un análisis de interés para cualquier actor del sistema de justicia, destaca por su innovación en aspectos de docencia para favorecer el aprendizaje de quienes se inician en el estudio de esta disciplina. Para ello, el texto emplea diversas estrategias docentes para asegurar la comprensión de los contenidos tratados. Estas estrategias incluyen el uso de esquemas, mapas conceptuales, referencias a casos reales, estadísticas, y al final de cada capítulo, un conjunto de preguntas, casos hipotéticos y análisis de jurisprudencia.

Los cambios sociales y los actuales desafíos y problemas que enfrentan los sistemas de justicia h... more Los cambios sociales y los actuales desafíos y problemas que enfrentan los sistemas de justicia han determinado la aparición de elementos, desarrollos y tendencias que configuran un nuevo paradigma en la conducción de los procedimientos judiciales.Esto ha hecho necesario articular los diversos fines del proceso, de manera de asegurar su vigencia no solo para el caso particular, sino también para el conjunto de casos que ingresan al sistema.En el derecho comparado, una de las respuestas con mayor desarrollo para hacer frente a estos desafíos es elcase management o gestión judicial de casos.
Elmanejo de casossupone una nueva comprensión del proceso judicial que quiere asegurar las personas no solo una solución justa al conflicto, sino que, además, el que esta solución se alcance de manera oportuna ya un costo razonable.A pesar de su amplio desarrollo fuera de nuestras fronteras, ha sido en gran medida omitida por nuestra doctrina.Esto último no deja de ser paradójico, considerando que, como se muestra en este libro, en el funcionamiento diario de nuestros tribunales existen diversas manifestaciones del mecanismo delcase management .
En esta obra –que fue encargada a los autores por la Academia Judicial– se sintetiza la doctrina comparada en torno al tema, lo delinea conceptualmente, aborda sus fundamentos teóricos y su desarrollo operativo en sistemas judiciales comparados, y, por último, explica cómo se ha ido configurando paulatinamente en Chile y qué proyecciones tiene de cara a la reforma procesal civil.

No hay duda alguna que el Derecho del consumo ha adquirido cada vez más atención e importancia en... more No hay duda alguna que el Derecho del consumo ha adquirido cada vez más atención e importancia en los últimos años. Esto no sólo se observa en los cada más profusos y sofisticados trabajos de Derecho privado en la materia, sino también desde otras dos perspectivas. Una, se refiere a la creciente atención en el quehacer de los actores que participan y hacen uso de él, como el Sernac y las Asociaciones de Consumidores. Otra, de frecuente reporte por los medios de prensa, quienes informan acerca de casos que son resueltos o acordados en nuestros tribunales, disponiendo de los derechos de cientos o de miles de personas, “consumidores”.
Ahora bien, la recientemente aprobada Ley Nº 21.081, conocida como “Ley de fortalecimiento del Sernac”, vino a introducir importantes reformas a los actores y procedimientos que conforman el sistema de protección de los derechos de los consumidores. Muchas de estas reformas derivan de los más de 20 años de experiencia en materia de consumo, tanto en la justicia de policía local como ordinaria, y son respuestas directas a prácticas y problemas de este sistema que el legislador ha decidido modificar.
Para poder examinar de manera adecuada muchas de estas reformas, se hace necesario ir más allá de una perspectiva estrictamente exegética y por ello ésta debe ser complementada mediante la incorporación de las otras perspectivas que hemos mencionado. En particular, creemos que para aquellos que trabajan día a día en materia de consumo, es necesario
aproximarse a esta ley y su reciente reforma legal desde un enfoque más comprehensivo, que considere al Derecho del consumo como un “área de litigación” especial. Con ello, busca reconocerse que los “casos” que se llevan en esta área del Derecho, no sólo generan debates muy relevantes de Derecho privado, sino también complejas y ricas discusiones de Derecho administrativo, Derecho procesal y probatorio. De la misma manera, es necesario una perspectiva que no sólo ponga atención en la regulación, sino que también en las prácticas y los actores que intervienen en el sistema.
Dado lo anterior, la presente publicación busca proveer al lector de una mirada más holística acerca del Derecho del consumo y su reciente reforma legal, por lo que los artículos que lo conforman hacen uso de metodologías y enfoques diversos. Algunos de ellos hacen un uso estricto del método dogmático. Otros vinculan dicho análisis con la jurisprudencia y/o con la experiencia cotidiana trabajando en el área, identificando prácticas que desafían la ley y anticipando futuros nudos problemáticos una vez implementada la reforma legal. Inclusive, hay algunos artículos que hacen uso de metodologías propias de las ciencias sociales. Finalmente, hay artículos que presentan análisis muy detallados de la reforma legal, mientras que hay otros que privilegian una mirada panorámica, destinada a contextualizar y ubicar las principales modificaciones y sus repercusiones.

Por una parte, se intenta mostrar que las normas e instituciones procesales surgen en épocas y contextos específicos que determinan su fisonomía, que se construyen en la interacción de los actores del sistema de justicia y que se encuentran conectadas con la normativa internacional.
Por otra parte, se tocan temáticas que tradicionalmente no son tratadas en los manuales y que se estiman como fundamentales para comprender adecuadamente esta área del Derecho.
Se revisan, por ejemplo, los efectos de la ley procesal en el tiempo y en el espacio, la estructura orgánica de los tribunales, incorporando nuevas perspectivas de análisis. Se incluye, también, una amplia sección sobre mecanismos ADR (Alternative Dispute Resolution), temática que ha tenido un enorme crecimiento normativo y de aplicación en nuestro medio. Asimismo, se destina un capítulo completo al examen del derecho al debido proceso, vinculado con fallos de tribunales internacionales, buscando entregar una visión completa y actualizada sobre uno de los pilares acerca de los cuales se construyen actualmente los sistemas procesales. Se integran también consideraciones de políticas públicas, reformas procesales, y se ofrece una visión sistémica del proceso judicial con el fin de ampliar y enriquecer su examen más allá del mero análisis normativo, situándolo dentro del contexto nacional.

En materia de tribunales de familia, el papel de los jueces y juezas en la audiencia preparatoria... more En materia de tribunales de familia, el papel de los jueces y juezas en la audiencia preparatoria ha sido poco estudiado, especialmente desde una perspectiva holística del mismo. El presente trabajo postula que los jueces y juezas de familia en el contexto de esta particular audiencia desarrollan un conjunto de actividades judiciales que buscan satisfacer una gran variedad intereses y objetivos, los que muchas veces se encuentran en tensión y debe ser resuelta por los jueces y juezas. Para lo anterior, los jueces y juezas deben echar mano a diversas herramientas y estrategias, pretendiendo dar a cada interés y finalidad el espacio que ameritan, identificándose así un rol articulador que no ha sido reconocido en nuestro medio. La identificación y caracterización de este rol, permite observar la real complejidad de la labor judicial en la audiencia preparatoria.

Por un lado, en el funcionamiento de la justicia civil la conciliación cumple
un rol prácticamente insignificante en términos estadísticos, lo que la diferencia de los sistemas reformados en materia laboral y de familia, donde su uso es masivo. Por otro lado, el derecho procesal comparado muestra como las salidas negociadas en el proceso civil -destacando, entre ellas, la conciliación judicial- tienen un rol cada vez más relevante, generando una profunda discusión acerca de una cultura de los acuerdos. Nada de esto ocurre en nuestro derecho procesal civil. Sin embargo, una reciente reforma al Código de Procedimiento Civil incorporó el artículo 3 bis, que estableció un deber general de todos los actores de promover las salidas autocompositivas, posicionando al sistema de justicia civil chileno en la misma dirección que el derecho comparado. En este artículo nos preguntamos hasta qué punto nuestro sistema de justicia sigue las tendencias comparadas en materia de métodos alternativos/apropiados de solución de conflictos, y, en particular, qué obstáculos puede enfrentar la implementación y aplicación del art. 3 bis del Código de Procedimiento Civil. Esta reflexión se construye contrastando el funcionamiento de la conciliación en los tribunales civiles, con su funcionamiento en los procedimientos reformados, el desarrollo de este asunto en la experiencia comparada y algunos de los diversos desafíos que debería sortear nuestro país para sumarse adecuadamente a esta tendencia transversal.

En esta perspectiva, este trabajo describe someramente aquellas exigencias y desafíos contemporáneos de los sistemas de justicia que han generado un nuevo paradigma en la conducción de los procedimientos, que la doctrina y el derecho procesal comparado denominan case management o judicial case management. Junto con esbozar los rasgos centrales de este nuevo paradigma, se demuestra cómo sus alcances implican la superación del paradigma del juez director del proceso.

Su propósito es intentar responder dos preguntas: 1) ¿Existe una violación al derecho al debido proceso y al principio de la inmediación en el evento de que las audiencias se desarrollen a través de video conferencia? y 2) ¿De qué manera el sistema de justicia debe y puede procesar los actuales casos graves y urgentes, el retraso acumulado y la eventual avalancha de nuevos casos que se esperan a propósito de la pandemia?
Para dar respuesta a ambas interrogantes, el texto examina el rol que ha tenido la tecnología durante la pandemia en el sistema de justicia chileno. Asimismo, se propone que un enfoque de case management puede proveer de un marco teórico y de diversas herramientas - entre ellas la tecnología - que permitan al sistema de tribunales de familia enfrentar la actual situación.

El objetivo de este capítulo ha sido identificar, describir y analizar la respuesta dada por el s... more El objetivo de este capítulo ha sido identificar, describir y analizar la respuesta dada por el sistema estatal de justicia criminal (Poder Judicial, Ministerio Público, y Defensoría Penal Pública) −a la luz de los estándares internacionales en materia de la obligación de prevenir, investigar y sancionar violaciones a los derechos humanos−, a las acciones que tuvieron lugar en nuestro país durante el período posterior al 18 de octubre de 2019. Para ello, se han tenido en cuenta, particularmente, los estándares internacionales desarrollados en el seno del Sistema Interamericano de Derechos Humanos, en materia del deber de prevenir, investigar, y sancionar, a fin de analizar en qué medida las instituciones intervinientes han orientado su trabajo de manera de cumplir con dichos estándares. Además del impacto ocasionado por la pandemia en el sistema de justicia en general y respecto de estas causas en particular, hemos identificado algunos nudos críticos que resultará relevante tomar en consideración cuando llegue el momento de evaluar la responsabilidad internacional del Estado en esta materia.

En dicha oportunidad la profesora Genn decidió hablar sobre la justicia civil en el derecho del common law y, en especial, acerca de la justicia civil inglesa. El año 2010 su conferencia fue publicada bajo el título Judging Civil Justice o Juzgando a la justicia civil, constituyéndose en una de las publicaciones más citadas en el área en dicho país. El presente documento contiene la versión adaptada en castellano de la introducción de aquel libro, reconociendo lo inusual que supone traducir solo una parte de una publicación. Sin embargo, se ha estimado que el señalado preámbulo supone por sí solo un gran aporte al debate en Chile sobre la reforma al proceso civil, hoy en discusión parlamentaria. Se cuenta con la autorización expresa de la autora para la traducción.

La prueba constituye un problema común y decisivo en los juicios de consumo, sean estos individua... more La prueba constituye un problema común y decisivo en los juicios de consumo, sean estos individuales o colectivos. A pesar de que de manera paulatina se han ido introduciendo diversas reglas y mecanismos probatorios para equilibrar las diferencias entre litigantes, su efectividad ha sido limitada ya que subsiste un contexto normativo, teórico y práctico que tiende a limitar los efectos que tales mecanismos y reglas promueven. Este contexto no ha sido adecuadamente estudiado en el medio Chileno. El objetivo de este texto es dar cuenta de este contexto, los distintos niveles en que opera y las disfuncionalidades que este genera, para posteriormente sugerir algunas bases conceptuales y debatir acerca de algunas propuestas que permitan avanzar en la construcción de un derecho probatorio que se haga cargo de las particularidades de la relación de consumo.La metodología utilizada fue mayoritariamente analítica en cuanto al estudio de las normas, su modificación y también al análisis jurisprudencial.En conclusión, se presentan algunas propuestas para remover obstáculos normativos, teóricos y prácticos para el desarrollo de una actividad judicial en el campo de la prueba más funcional a los objetivos del proceso de consumo. Una primera alternativa sería la elaboración de un código procesal de consumo, que otorgue autonomía teórica y normativa para la tramitación en esta materia. Otra propuesta sería llevar la especialización en esta materia un paso más allá, creando así tribunales dedicados exclusivamente a la resolución de conflictos de consumo. Sin embargo, existe una tercera alternativa que parece más viable y que sería perfectamente compatible con la creación de una legislación completa y coherente, aunque quede en manos de los jueces generales. Tal solución consistiría en introducir la noción de gestión de casos como un vehículo conceptual que viene a modificar y ofrecer nuevos paradigmas sobre la comprensión del papel de los jueces dentro del proceso, cambiando eventualmente la cultura jurídica de los operadores de justicia.

En efecto, el juez civil que conoce de un procedimiento colectivo debe asumir responsabilidades que un procedimiento ordinario no tiene, por ejemplo, la aprobación judicial sustantiva del acuerdo que vinculará toda la "clase".
Ahora bien, con la entrada en vigencia de la Ley Nº 21.081 la necesidad de estudiar con detalle el rol del juez en estos procedimientos se hace urgente, ya que dicho cuerpo normativo modificó algunos deberes de los jueces en la materia y les otorgó poderes adicionales.
En este texto se defiende la postura de que el juez civil que conoce de este tipo de procedimientos debe asumir un rol activo en el proceso, hablamos de un "juez-supervisor". Las razones de nuestra postura derivan de consideraciones propias de los procedimientos colectivos, como del derecho sustantivo de consumo.

Dado lo anterior, la presente publicación busca proveer al lector de una mirada más holística acerca del Derecho del consumo y su reciente reforma legal, por lo que los artículos que lo conforman hacen uso de metodologías y enfoques diversos. Algunos de ellos hacen un uso estricto del método dogmático. Otros vinculan dicho análisis con la jurisprudencia y/o con la experiencia cotidiana trabajando en el área, identificando prácticas que desafían la ley y anticipando futuros nudos problemáticos una vez implementada la reforma legal. Inclusive, hay algunos artículos que hacen uso de metodologías propias de las ciencias sociales. Finalmente, hay artículos que presentan análisis muy detallados de la reforma legal, mientras que hay otros que privilegian una mirada panorámica, destinada a contextualizar y ubicar las principales modificaciones y sus repercusiones.
Por una parte, se intenta mostrar que las normas e instituciones procesales surgen en épocas y contextos específicos que determinan su fisonomía, que se construyen en la interacción de los actores del sistema de justicia y que se encuentran conectadas con la normativa internacional.
Por otra parte, se tocan temáticas que tradicionalmente no son tratadas en los manuales y que se estiman como fundamentales para comprender adecuadamente esta área del Derecho.
Se revisan, por ejemplo, los efectos de la ley procesal en el tiempo y en el espacio, la estructura orgánica de los tribunales, incorporando nuevas perspectivas de análisis. Se incluye, también, una amplia sección sobre mecanismos ADR (Alternative Dispute Resolution), temática que ha tenido un enorme crecimiento normativo y de aplicación en nuestro medio. Asimismo, se destina un capítulo completo al examen del derecho al debido proceso, vinculado con fallos de tribunales internacionales, buscando entregar una visión completa y actualizada sobre uno de los pilares acerca de los cuales se construyen actualmente los sistemas procesales. Se integran también consideraciones de políticas públicas, reformas procesales, y se ofrece una visión sistémica del proceso judicial con el fin de ampliar y enriquecer su examen más allá del mero análisis normativo, situándolo dentro del contexto nacional.

Por un lado, en el funcionamiento de la justicia civil la conciliación cumple
un rol prácticamente insignificante en términos estadísticos, lo que la diferencia de los sistemas reformados en materia laboral y de familia, donde su uso es masivo. Por otro lado, el derecho procesal comparado muestra como las salidas negociadas en el proceso civil -destacando, entre ellas, la conciliación judicial- tienen un rol cada vez más relevante, generando una profunda discusión acerca de una cultura de los acuerdos. Nada de esto ocurre en nuestro derecho procesal civil. Sin embargo, una reciente reforma al Código de Procedimiento Civil incorporó el artículo 3 bis, que estableció un deber general de todos los actores de promover las salidas autocompositivas, posicionando al sistema de justicia civil chileno en la misma dirección que el derecho comparado. En este artículo nos preguntamos hasta qué punto nuestro sistema de justicia sigue las tendencias comparadas en materia de métodos alternativos/apropiados de solución de conflictos, y, en particular, qué obstáculos puede enfrentar la implementación y aplicación del art. 3 bis del Código de Procedimiento Civil. Esta reflexión se construye contrastando el funcionamiento de la conciliación en los tribunales civiles, con su funcionamiento en los procedimientos reformados, el desarrollo de este asunto en la experiencia comparada y algunos de los diversos desafíos que debería sortear nuestro país para sumarse adecuadamente a esta tendencia transversal.
Su propósito es intentar responder dos preguntas: 1) ¿Existe una violación al derecho al debido proceso y al principio de la inmediación en el evento de que las audiencias se desarrollen a través de video conferencia? y 2) ¿De qué manera el sistema de justicia debe y puede procesar los actuales casos graves y urgentes, el retraso acumulado y la eventual avalancha de nuevos casos que se esperan a propósito de la pandemia?
Para dar respuesta a ambas interrogantes, el texto examina el rol que ha tenido la tecnología durante la pandemia en el sistema de justicia chileno. Asimismo, se propone que un enfoque de case management puede proveer de un marco teórico y de diversas herramientas - entre ellas la tecnología - que permitan al sistema de tribunales de familia enfrentar la actual situación.

derechos humanos en la materia, así como también los problemas y

Ahora bien, con la entrada en vigencia de la Ley Nº 21.081 la necesidad de estudiar con detalle el rol del juez en estos procedimientos se hace urgente, ya que dicho cuerpo normativo modificó algunos deberes de los jueces en la materia y les otorgó poderes adicionales.
En este texto se defiende la postura de que el juez civil que conoce de este tipo de procedimientos debe asumir un rol activo en el proceso, hablamos de un "juez-supervisor". Las razones de nuestra postura derivan de consideraciones propias de los procedimientos colectivos, como del derecho sustantivo de consumo.
Se analizan tópicos que tradicionalmente no son tratados en los manuales y que se estiman como fundamentales para comprender el actual desarrollo de esta área del derecho, no solo en nuestro país sino también fuera de nuestras fronteras. Así, el libro incluye una amplia sección dedicada a los mecanismos colaborativos de resolución de conflictos (ADR), temática que ha experimentado un significativo crecimiento normativo en los últimos años. Este crecimiento, se ha visto potenciado en el ámbito procesal civil, aspecto que se aborda en esta segunda edición. También, junto con actualizar el capítulo que examina el derecho a un debido proceso, incluyendo los más recientes fallos de tribunales
internacionales vinculantes para nuestro país, en la presente edición se incorpora un nuevo capítulo referido al derecho de acceso a la justicia.
En esta segunda edición, el libro amplía el tratamiento de tópicos tradicionales, como los fines del proceso y el rol del juez y de las partes. Sin embargo, lo hace desde una perspectiva que integra consideraciones de políticas públicas, derecho comparado y de reformas procesales, ofreciendo una visión sistémica del proceso judicial que lo sitúa dentro del contexto nacional e internacional en vista de las demandas y exigencias ciudadanas que en la actualidad experimentan los sistemas de justicia.
Si bien la obra ofrece un análisis de interés para cualquier actor del sistema de justicia, destaca por su innovación en aspectos de docencia para favorecer el aprendizaje de quienes se inician en el estudio de esta disciplina. Para ello, el texto emplea diversas estrategias docentes para asegurar la comprensión de los contenidos tratados. Estas estrategias incluyen el uso de esquemas, mapas conceptuales, referencias a casos reales, estadísticas, y al final de cada capítulo, un conjunto de preguntas, casos hipotéticos y análisis de jurisprudencia.
Elmanejo de casossupone una nueva comprensión del proceso judicial que quiere asegurar las personas no solo una solución justa al conflicto, sino que, además, el que esta solución se alcance de manera oportuna ya un costo razonable.A pesar de su amplio desarrollo fuera de nuestras fronteras, ha sido en gran medida omitida por nuestra doctrina.Esto último no deja de ser paradójico, considerando que, como se muestra en este libro, en el funcionamiento diario de nuestros tribunales existen diversas manifestaciones del mecanismo delcase management .
En esta obra –que fue encargada a los autores por la Academia Judicial– se sintetiza la doctrina comparada en torno al tema, lo delinea conceptualmente, aborda sus fundamentos teóricos y su desarrollo operativo en sistemas judiciales comparados, y, por último, explica cómo se ha ido configurando paulatinamente en Chile y qué proyecciones tiene de cara a la reforma procesal civil.
Ahora bien, la recientemente aprobada Ley Nº 21.081, conocida como “Ley de fortalecimiento del Sernac”, vino a introducir importantes reformas a los actores y procedimientos que conforman el sistema de protección de los derechos de los consumidores. Muchas de estas reformas derivan de los más de 20 años de experiencia en materia de consumo, tanto en la justicia de policía local como ordinaria, y son respuestas directas a prácticas y problemas de este sistema que el legislador ha decidido modificar.
Para poder examinar de manera adecuada muchas de estas reformas, se hace necesario ir más allá de una perspectiva estrictamente exegética y por ello ésta debe ser complementada mediante la incorporación de las otras perspectivas que hemos mencionado. En particular, creemos que para aquellos que trabajan día a día en materia de consumo, es necesario
aproximarse a esta ley y su reciente reforma legal desde un enfoque más comprehensivo, que considere al Derecho del consumo como un “área de litigación” especial. Con ello, busca reconocerse que los “casos” que se llevan en esta área del Derecho, no sólo generan debates muy relevantes de Derecho privado, sino también complejas y ricas discusiones de Derecho administrativo, Derecho procesal y probatorio. However, most Latin American countries and procedural legal scholarship, with the prominent exception of Brazil, have not had a vigorous debate about its existence. More importantly, there is scarce empirical information regarding managerial judging and its operational dynamics in South American legal systems. Th e following article aims to fill that void by focusing on Chile ’ s legal system. In the last 20 years, Chile has initiated a series of procedural reforms that created new courts and radically changed procedural regulation by introducing oral proceedings and the concentrated trial hearing. This article presents original empirical evidence that shows the emergence of managerial judging practices at family and labour reformed courts. By identifying, characterising and examining in detail such practices, it is possible to understand when and how managerial judging takes place and to what end.

Este documento aborda una formulación genérica de la cláusula, proponiendo cuestiones relativas a su extensión, alcance, límites y mecanismo de protección constitucional, sin abordar el desarrollo de las garantías particulares que lo integran, lo que ameritaría un análisis en detalle.

Cada país puede definir si desea otorgar dicho derecho a sus ciudadanos en cada uno de los procedimientos judiciales que diseñe…”
Cualquier análisis acerca del derecho a ser oído, en un contexto general o específico, debe partir por entender la estrecha relación entre este y el interés superior de los niños, niñas y adolescentes. Lo cierto es que no es posible determinar de manera adecuada en qué consiste dicho interés en un caso particular, sin haber escuchado a los niños respecto de los cuales una decisión será tomada. Esta exigencia es lógica y plenamente consistente con el cambio de un enfoque paternalista a uno de sujeto de derechos, en que se concibe a los NNA como sujetos autónomos.
Ahora bien, la manifestación más elemental de esta autonomía consiste en la facultad de participar en todas aquellas instancias en donde decisiones acerca de su futuro y sus relaciones sean tomadas, y la forma más básica de participación consiste en tener la posibilidad de ser oído por la autoridad, a efectos de dar a conocer su posición en la materia.
El presente documento desarrolla con mayor nivel de detalle una de las manifestaciones del derecho a ser oído, aquella consagrada en la Convención sobre los Derechos del Niño en su artículo 12 numeral 2. En este contexto, el derecho está revestido de una serie de exigencias no solo para las autoridades estatales, sino que también impone una serie de requerimientos para el legislador, quien debe poner especial atención en el diseño y posterior implementación de aquellos procedimientos utilizados por las autoridades.
Con el fin de desarrollar adecuadamente este informe, el documento se dividirá en tres capítulos y una conclusión. En el primer capítulo se examinará someramente la influencia que los compromisos adquiridos por el Estado en materia de derechos humanos, y en particular en lo relativo a las normas sobre debido proceso, tienen en el diseño del modelo que consagra el sistema procesal penal chileno, circunstancia que necesariamente debe ser considerada al momento de examinar el recurso de nulidad penal y su regulación. En el segundo capítulo haré referencia al derecho a recurrir y sus implicancias, a efectos de fijar con claridad los estándares que cualquier sistema recursivo debiese respetar. En el tercer capítulo me referiré al recurso de nulidad contemplado en libro III del Código Procesal Penal, con el fin de analizar su estructura, examen de admisibilidad y las facultades de revisión que el tribunal superior tiene, en función de las exigencias internacionales.
En este contexto la finalidad del presente artículo es comenzar a hacerse cargo de este vacío en nuestra doctrina nacional en la materia. En particular, el objetivo es dar cuenta, mediante el uso de diversas fuentes de información jurídica y empírica, acerca de prácticas vinculadas a la prueba pericial ante los tribunales de familia, analizar sus consecuencias para el funcionamiento del sistema y reflexionar brevemente acerca de la necesidad y pertinencia de una futura reforma legal en la materia, que nos permita hacernos cargo de los problemas detectados.
El objetivo es ver las razones que justificaron al legislador incorporar esta construcción foránea en nuestro sistema de enjuiciamiento criminal y examinar como ha sido desarrollada por la doctrina y la jurisprudencia.
Previo a ello se realiza un trabajo de presentación acerca de qué es un estándar probatorio, concepto cuyo estudio ha estado ajeno a nuestra dogmática procesal y que requiere una mirada extraprocesal a efectos de tener una mayor comprensión acerca de su rol y función.

Se trata, en términos prácticos, de responder una pregunta: ¿cuánta prueba se necesita en juicios civiles, como por ejemplo casos de indemnización de perjuicios o de incumplimiento contractual, para que el juez se encuentre autorizado y confiado en dar por cierto determinados hechos que favorezcan la pretensión de una de las partes? Es, a final de cuentas, una decisión respecto a la distribución del margen de error inherente a toda actividad humana, como lo es la judicial.
El artículo justificará la relevancia de incluir esta herramienta en la futura reforma al proceso civil argumentando el trascendente rol que esta juega en sistemas probatorios en donde los principios de la libertad probatoria, la sana crítica y el deber de fundamentar los fallos judiciales imperan. Asimismo, se presentará experiencia comparada entorno a esta figura con el fin de facilitar al lector tener una imagen clara de cómo funciona en la práctica.
Finalmente se esbozan una serie de reflexiones respecto de los desafíos que el legislador chileno deberá enfrentar si pretende introducir esta herramienta probatoria.
El documento se centra en mostrar como, a pesar de que en materia de Tribunales de Familia se consagra el principio de la libertad probatoria y la sana crítica, existe jurisprudencia que muestra que aún los jueces aprecian las pruebas según la lógica del sistema de la prueba legal, método que no es compatible con los principios aludidos. Para fundamentar mi opinión me centro en dos tópicos: la utilización de criterios abstractos y generales para evaluar la credibilidad de testigos y la tendencia a exigir prueba 100% indubitada para determinar la procedencia de un divorcio por culpa.

1) ¿Qué tanto se valora la disidencia y la polémica en nuestra academia, especialmente respecto de la organización de seminarios y publicaciones?
2) ¿Desde qué perspectiva los académicos de procesales deberían aproximarse a la academia? ¿está bien que solo se coloquen en los pies de los abogados y los justiciables?
Ciertamente se trata de una pregunta que puede hacerse respecto de la academia jurídica en general y no solo de la procesal, pero dado que esta es la comunidad de la que soy parte me gustaría circunscribirla a ella, con el fin de generar una discusión sobre nuestro quehacer.
Although most Latin-American countries have experienced procedural reforms during the last 30 years, Chile stands out as a study case. Indeed, before the reforms, Chilean justice worked with a “hopelessly written” dossier system, and oral proceedings were a fact only discussed in comparative law textbooks and seen in movies and foreign TV shows. However, the country radically changed this by introducing a foreign legal institution, the concentrated trial hearing. What makes Chile different is that this innovation was added not only as part of the criminal reform but instead, the country, like only a few others, introduced it as a central element of the family and labor procedural transformations as well. Furthermore, these three reforms were also part of the same public policy of judicial reforms, under the same political coalition.
Most research on legal transplants compares legal institutions at the source and its reception in the host system. However, this research innovates by looking at how one foreign legal idea was introduced as the key element of three procedural reforms initiatives, developed very closely in time, and in the same legal system. By comparing, contrasting, and analyzing them thoroughly, this investigation identified the specific differences in their day-to-day performance and examined in detail the diverse factors that contributed to their occurrence.
Using more than 50 original semi-structured interviews with judges, lawyers, court administrators, and legal reformers, over 70 court observations, and by examining records and original statistical information, this dissertation finds important differences in how the idea of the concentrated trial hearing was understood and operationalized by the three procedural reforms in the country.
In fact, while these reforms shared the same procedural principles, structure, evidence framework, and many rules, there were important differences between the performance of concentrated trial hearing at the criminal trial courts compared to family and labor courts. Among these differences, two were explored in-depth. First, the piecemealing of the trial hearing that happens at the family and labor courts, a phenomenon in which the trial hearing could be split in small sessions months apart. Secondly, the rise of managerial judging practices by the family and labor judges, although nor the law, the legal reformers, or the legal scholarship anticipated them.
Later, the dissertation presents and analyzes the two main variables that explain this variance. The first was an institutional one. In fact, several mistakes in the implementation process of the family courts reform led to an institutional crisis that lasted for many years, placing these courts under high public scrutiny and the desperate need to regain prestige and legitimacy. Consequently, they took several organizational and workload-related measures at the expense of sacrificing the concentrated trial ideal. Following this path, the new labor courts took very similar administrative measures to avoid the risk of becoming a second “public failure,” producing similar consequences.
A second variable refers to the legal transplant process itself, especially the role of legal reformers, as the emergence of judicial case management practices was the consequence of an “unintended legal transplant.” This research finds that this practice responded to a series of problems that the introduction of orality involved and that the family and labor legal reformers were unable to anticipate, something that revealed the differences in the work of the legal reformers themselves.
Finally, this thesis suggests that the different groups of legal reformers behind each procedural transplant explain in many ways why the criminal procedure reform follows closely the core values that supported it while the family and labor courts diverge from them in important ways. The criminal procedure reformers had essential advantages, including skill and knowledge, which allowed them to regulate the legal change in a more precise way and anticipate many of its problems. Moreover, the criminal legal reformers steered the transplantation process from inception to implementation, something that the family and labor teams were not able to do.
The Chilean procedural reform experience, along with its successes and failures, is a valuable lesson for other countries that already have or are going through similar transformations in their justice systems.

¿cómo deben los tribunales y el sistema de justicia hacer frente al conjunto de casos que actualmente están ingresando al sistema?
Cualquiera respuesta que se formule debe permitir enfrentar los problemas más urgentes y graves, hacerse cargo del retraso de casos
acumulados y la futura avalancha de otros de la más variada naturaleza producto de los efectos la pandemia.
Así las cosas, deben descartarse las propuestas consistentes en solo esperar que se vuelva a la normalidad, ya que, en realidad, no
ofrecen respuesta alguna, pueden agravar la ya crítica situación y no considera las urgentes necesidades de los justiciables, considerando
la extensión del estado de catástrofe.
Aparece así la necesidad de distribuir los limitados recursos disponibles de nuestro sistema de justicia y organizarlos de la mejor forma
para que los fines que institucionalmente se le asignan puedan ser alcanzados, en la medida que corresponda, tanto en los casos que
actualmente conoce como en aquellos que conocerá mañana. Este contexto exige racionalización y cumplir con estándares mínimos, con
una perspectiva que considere el conjunto de casos, los valores del sistema y los actores involucrados.
Este escenario, exacerbado por la actual pandemia, abre un importante espacio para considerar una noción o herramienta que ha permitido a otros países hacer frente a este complejo dilema, el case management. Según este, son los tribunales y, en particular, los jueces, quienes asumen la responsabilidad de controlar el desarrollo del conjunto de la litigación, distribuyendo y racionalizando los recursos del sistema según un criterio de proporcionalidad, en coordinación y cooperación con las partes. Esta idea implica articular los fines públicos y privados de la litigación bajo una conducción judicial.
