Resumo Entre os séculos XII e XIII, no Ocidente europeu, as discussões em torno dos dízimos ocupa... more Resumo Entre os séculos XII e XIII, no Ocidente europeu, as discussões em torno dos dízimos ocupavam papel de destaque no direito canônico, tanto nas obras de compiladores e juristas como também em textos teológicos. Apesar de uma certa especialização em suas respectivas áreas, os juristas, para estabelecer seus argumentos, se referiam aos trabalhos de teólogos, enquanto que estes, por sua vez, utilizavam fórmulas legais em seus discursos. Dízimos representam um caso particularmente interessante para compreender as interações entre Direito e Teologia por possuírem uma natureza dupla de spiritualia e temporalia; são, portanto, ao mesmo tempo elementos do mundo divino e do mundo secular. Esse trabalho analisa as discussões sobre os dízimos a partir da Summa Aurea de Hostiensis e outras obras jurídicas para demonstrar que Direito Canônico e Teologia devem ser abordados a partir de uma perspectiva de sincretismo, compreendido a partir do conceito de equidade (aequitas). Palavras-chave: Dízimos, Direito Canônico, Teologia Abstract In the 12th and 13th centuries, in Western Europe, discussions regarding tithes had a privileged role in Canon Law in the works of compilers and jurists, but also in theological texts. Despite a certain specialization in the areas of Law and Theology, theological discourse used legal formulas and jurists referred to theological work to set their arguments. Tithes represent a particularly interesting case to understand the interactions between Law and Theology since they possessed a double nature of spiritualia and temporalia and were, therefore, part of the divine and the secular world at the same time. This paper analyzes the discussions about tithes in Hostiensis Summa Aurea and other juridical work to demonstrate that Canon Law and Theology must be approached from a perspective of syncretism, understood through the concept of equity (aequitas).

Resumo: O Direito Canônico medieval se transformou a partir de meados do século XII com a organiz... more Resumo: O Direito Canônico medieval se transformou a partir de meados do século XII com a organização de inúmeras compilações que buscavam sistematizar o conhecimento jurídico do período e oferecer ao mesmo tempo ferramentas de estudo e uso prático. Ao acompanhar o percurso dessas coleções, particularmente a partir do lugar concedido à discussão sobre dízimos, podemos observar como se deu o envolvimento do papado no processo de consolidação do direito canônico como um instrumento importante de definição de autoridade e jurisdição.
Abstract Medieval Canon Law was transformed from the middle of the 12 th century onwards with the organization of countless compilations that attempted to systematize the period ' s juridical knowledge offering, at the same time, tools for the study of laws as well as for their practical application. Following the development of these collections, particularly through the place given to the discussion on tithes, we can observe the papacy 's involvement in the process of consolidation of canon law as an important instrument for the definition of authority and jurisdiction.

tithes performed a series of religious, political, and social functions. Among these functions, we can highlight
the political, spatial, and jurisdictional organization of parishes, dioceses, and of the papacy itself. In a slow
process in which the concept of jurisdiction was also under construction, tithes played an essential role in the
definition and delimitation of ecclesiastical jurisdictions, particularly regarding episcopal and papal jurisdictions.
Analyzing Hostiensis’s the Summa Aurea (1253) through an intertextual comparison against work as the Liber
Extra and Gratian’s Decretum, this paper’s goal is to demonstrate the relationship between the discourse on
tithes and the definition both of the concept and of the practical action of ecclesiastical jurisdiction between
the 12th and 13th centuries.

Da maneira como o conhecemos hoje, o casamento não surgiu automaticamente junto com o Cristianismo, mas sim através de um processo lento e gradual de controle da Igreja sobre a sociedade. Foram necessários séculos para que a Igreja conseguisse finalmente firmar um considerável grau de normatização, a ponto de estabelecer seu modelo de casamento na Cristandade.
Explorando questões como a natureza do casamento cristão, o conceito de indissolubilidade, o adultério e as ofensas morais, este livro analisa como foi formulado juridicamente e religiosamente o ideal de casamento cristão na Idade Média, particularmente no contexto de reformas da Igreja nos séculos XI e XII. Como os juristas e outras autoridades determinaram o que seria um ideal de casamento cristão? Como as questões sexuais influenciaram o que seria certo ou errado dentro desse matrimônio? Seria possível perceber como o discurso formulado pela Igreja foi compreendido no mundo das cortes medievais?
