An associate professor of medical law at Medical University of Bialystok, Poland (since 2009) and Centre of Postgraduate Medical Education (since 2017). Obtained a master’s degree in law (Faculty of Law, University of Bialystok, 2008), completed postgraduate studies in Medical Law, Bioethics and Sociology of Medicine (Faculty of Law and Administration, University of Warsaw, 2010), obtained PhD degree in public health (Medical University of Bialystok, 2010).
She lectures candidates for medical practitioners (nurses, obstetricians, physiotherapists) and doctors on medical law.

The “Health law. Selected issues” includes studies presenting the selected aspects of health law. Fourteen lawyers, representatives of science and legal practice, have shared the results of their research. The collective study has been divided into three parts: pharmaceutical law, medical malpractice and varia. All of them are innovative and the aim is to present a broad area of health law interests.
Dużym walorem publikacji jest przejrzysta i klarowna prezentacja tematu oraz przedstawienie wybranych zagadnień w formie tabelarycznej i graficznej, umożliwiające poznanie prawa medycznego i orzecznictwa lekarskiego również osobom niemającym nawet elementarnej wiedzy prawniczej.

- umowy o udzielanie świadczeń zdrowotnych i właściwą ich realizację,
- prawa pacjenta oraz eksperyment medyczny z udziałem pacjenta.
W książce uwzględniono stan prawny na dzień 1 czerwca 2014 r.

Książkę wzbogacono o wyciąg tez z orzecznictwa sądowego i administracyjnego, które odnoszą się do poszczególnych przepisów ustawy o pomocy społecznej, normujących problematykę funkcjonowania domów pomocy społecznej oraz wzory formularzy wykorzystywanych w działalności tych jednostek organizacyjnych.
Opracowanie omawia w szczególności:
- tworzenie i rejestrację DPS,
- potrzeby bytowe w DPS,
- realizację zadań opiekuńczych i potrzeb wspomagających w DPS,
- zapewnienie świadczeń zdrowotnych w DPS,
- personel i wolontariat w DPS,

W kontekście omawianego zagadnienia istotne jest zwrócenie uwagi na działania Unii Europejskiej w przedmiotowej materii. W wydanym 4.11.2008 r. Komunikacie w sprawie korzyści telemedycyny dla pacjentów, systemów opieki zdrowotnej i społeczeństwa Komisja Europejska podkreśliła profity płynące z wykorzystania technologii informacyjno – komunikacyjnych (TIK) w sektorze zdrowia (eZdrowie, eHealth) oraz podkreśliła swoje zaangażowanie w rozwój telemedycyny. Konsekwencją powyższego jest Plan działania w dziedzinie e-zdrowia na lata 2012-2020 – Innowacyjna opieka zdrowotna w XXI wieku zakładający działania mające na celu usuwanie barier (zwł. prawnych) utrudniających pełne zastosowanie technologii informacyjno – komunikacyjnych w dziedzinie zdrowia. Działaniom promującym rozwój telemedycyny stale towarzyszy postulat wprowadzenia przejrzystości prawnej zapewniający pacjentom ochronę prywatności i bezpieczeństwa.
Polski ustawodawca stanął na stanowisku, iż lekarz może orzec o stanie zdrowia pacjenta wyłącznie po uprzednim osobistym zbadaniu (art. 42 ustawy o zawodach lekarza i lekarza dentysty), natomiast wysyłkowa sprzedaż dopuszczona jest wyłącznie dla produktów leczniczych wydawanych bez przepisu lekarza (art. 68 ust. 3 ustawy prawo farmaceutyczne). Jednakże, 24 czerwca 2014 r. Rada Ministrów przyjęła założenia do projektu ustawy o zmianie ustawy o systemie informacji w ochronie zdrowia oraz niektórych innych ustaw dotyczące wprowadzenia pełnego systemu informacji w ochronie zdrowia. Wspomniane działania zakładają przygotowanie rozwiązań prawnych umożliwiających monitorowanie przez lekarza stanu zdrowia pacjenta bez osobistego kontaktu oraz wprowadzenie od 1 sierpnia 2016 r. recept elektronicznych.
W wystąpieniu zostaną przedstawione problemy, z jakimi będzie musiał się zmierzyć legislator celem zapewnienia bezpieczeństwa pacjenta przy jednoczesnym pełnym wykorzystaniu telemedycyny. Postawione zostaną m.in. następujące pytania: czy wykorzystanie telemedycyny będzie wymagało akredytacji? czy telemedycyna zostanie ograniczona do telemonitoringu? jak zabezpieczyć transmisję danych by zagwarantować ochronę danych pacjenta? w jaki sposób będzie wybierana apteka, która będzie realizowała eReceptę? czy eRecepta rozszerzy działalność aptek internetowych o leki na receptę?
Wystąpienie zostało zakończone konkluzją, iż tylko kompleksowa regulacja prawna może zapewnić pełne wykorzystanie telemedycyny przy udzielaniu świadczeń zdrowotnych przy jednoczesnym zapewnieniu bezpieczeństwa pacjenta.
Wystąpienie zostanie podzielone na następujące części: przedstawienie stanu prawnego zastosowania testów genetycznych w procesie ustalenia ojcostwa, analiza wybranego orzecznictwa Sądu Najwyższego z zakresu badań genetycznych w omawianych postępowaniach, rozważania nad etycznymi aspektami konsekwencji wprowadzenia możliwości przeprowadzania testów genetycznych w ww. sprawach.
Celem wystąpienie będzie zaproszenie uczestników do dyskusji na temat etycznej roli testów genetycznych w procesie ustalenia ojcostwa. Czy możliwość badań genetycznych spowodowała ograniczenie całego postępowania dowodowego tylko do tego dowodu? Czy nadal możemy mówić, że rodzic może swobodnie zdecydować, czy wyraża zgodę na przeprowadzenie badań dziecka? A może możliwość zgody rodzica na poddanie dziecka testom genetycznym jest już swoistego rodzaju fikcją prawną, gdyż odmowa będzie skutkowała uznaniem stanowiska strony przeciwnej?
The speech will be the encouragement to discussion on two questions: how the full use of ICT can change functioning (especially in communication) of therapeutic teams and how a legal regulation can contribute to the better functioning of therapeutic teams using the ICT tools in contacts with patients and among themselves.
At first, using new technologies is always connected with a sense of fear of the unknown and fear of more responsibilities. An appropriate legal regulation providing detailed procedures of team functioning may contribute to an increase in a sense of safety and reduction of a fear of the unknown. The above is important for the quality of medical care. It was confirmed by the research conducted by PeopleKeys® in the medical market, which showed that employees, who were satisfied with their work and felt appreciated ,were perceived as those, who provided higher level of patient care services (Source: Bradley Smith, Ph.D., Larry R. The appropriate legal regulation of communication among therapeutic teams of the e-Health era may considerably contribute to enhancement of work, higher efficiency of personnel and better quality of their services.
Ochrona praw osób z zaburzeniami psychiatrycznymi jest podstawowym zadaniem Rzecznika Praw Pacjenta Szpitala Psychiatrycznego. Powyższa instytucja została wprowadzona do polskiego systemu prawnego 2005 r., jednak z uwagi na opóźnienia legislacyjne pierwszy Rzecznicy zostali powołani w latach 2007 – 2008. Aktualnie omawiany urząd piastuje 26 osób, z czego najwięcej w województwie mazowieckim.

Zostanie również omówiona legitymacja czynna i bierna do złożenia wniosku o ustalenie zdarzenia medycznego, jego obligatoryjne elementy, podstawy prawne funkcjonowania wojewódzkich komisji do spraw orzekania o zdarzeniach medycznych (jej skład i kompetencje) oraz jej procedury. Dodatkowo zostanie również przedstawiona problematyka dotycząca wydawanych orzeczeń przez Wojewódzką Komisję do spraw Orzekania o Zdarzeniach Medycznych w Rzeszowie oraz Białymstoku.
W kontekście omawianego zagadnienia zostanie również podkreślone, iż konsekwencją dokonanych zmian w prawie jest również obowiązek ubezpieczeniowy szpitali oraz związanie ubezpieczyciela orzeczeniem ww. komisji.
Tematyka wystąpienia wpisuje się - z racji wiodącego motywu Konferencji - w problematykę zarządzania służbą zdrowia.

od 12 grudnia 2015 r. – ustępu 4 art. 2 Ustawy z 5 grudnia
1996 r. o zawodach lekarza i lekarza dentysty (tj. Dz. U. z 2015 r., poz. 464 ze zm.), zgodnie z którym lekarz i lekarz dentysta mogą wykonywać zawodów także za pośrednictwem systemów
teleinformatycznych lub systemów łączności. Wprowadzona nowelizacja umożliwia zatem lekarzowi udzielanie świadczeń zdrowotnych przy wykorzystaniu telemedycyny. Problem, jaki pojawia się w przywołanym przepisie, to nieprecyzyjność oraz brak analogicznej regulacji przy finansowaniu świadczeń
zdrowotnych. Po pierwsze ustawodawca nie określił katalogu działań, które mogą być przez lekarza realizowane.
Należy zatem przypuszczać, że zakres zastosowania systemów teleinformatycznych lub systemów łączności nie jest normatywnie limitowany i to lekarz jest jedynym decydentem stosowania telemedycyny.
Procedura dowodowa w powyszych sprawach jest nieodzownie zwiazana z dowodami natury
biologicznej, wsród których szczególna role odgrywa dowód z badan DNA, który prawidłowo
przeprowadzony pozwala ze stuprocentowa pewnoscia na wykluczenie ojcostwa oraz z prawdopodobienstwem
graniczacym z pewnoscia jego ustalenie.
