Il penale ha attraversato fasi storiche che bisogna leggere ciascuna secondo la sua lingua, fuori da ogni logica monista, e badando ad evitare quel che spesso si è fatto: una storia di staticità messe in successione. È bene che l’approccio sia, se mi spiego, ’pluralista’. È bene che l’ottica ricostruttiva sia realistica, duttile e modulata, perché sembra evidente che fasi diverse ‘convivono’ affiancate, intrecciate o sovrapposte, in ragione di una ‘inerzia’ delle pratiche, che non si lasciano abrogare da nuove regole e tanto meno da novità interpretative o da svolte dottrinali. Per cui non è dato vedere che una nuova fase del penale rimpiazzi interamente la precedente, cancellandola. Allo stesso modo, ogni singolo frangente della trasformazione e della crescita dell’ordine penale è fatto di molti elementi che coesistono ed interagiscono su diversi fronti, dando vita ad una complessità che non si presta ad essere semplificata o ridotta. Che non si presta, in ogni caso, ad una trattazione meramente ‘evoluzionista’, che limpidamente scandisca fasi e stabilisca progressioni. È dunque l’approccio ‘plurale, dinamico ed integrato’ che permette allo storico di ‘vedere’ in tutta la sua rilevanza la specificità della ‘dimensione penale’ della vita associata ed il reale funzionamento dei sistemi penali storicamente rilevati. Intendo il loro concreto dispiegarsi, e non soltanto la loro conformazione, quale è possibile desumere dalle norme e dalle dottrine. Penso alla implicazione di sistemi normativi diversi dal giuridico, alle mentalità ed alle culture, alla criminalità in presenza, alle inclinazioni della giustizia praticata, all’orientamento dei poteri politici, alle sinergie dispiegate dai poteri diffusi, dalla chiesa, dalle comunità e dalle oligarchie locali. Penso alle logiche economiche che si intrecciano con la più generale economia del penale, alle interferenze morali ed ai condizionamenti religiosi, al ruolo giocato in direzioni diverse dal moral panic, dalla incostante efficienza degli apparati repressivi, dall’anomia e dall’osservanza». La prospettiva storica consente di intrecciare modelli costituzionali e politiche della giustizia, concetti e dispositivi istituzionali, procedure e casi. Questo volume nello scegliere la storia della giustizia come campo di azione della storia del diritto intende osservare la "questione giustizia" come formante di sistema ed offrire un contributo per una riflessione metodologica.
Gracias a las contribuciones de especialistas con diferentes formaciones y trayectorias, este vol... more Gracias a las contribuciones de especialistas con diferentes formaciones y trayectorias, este volumen intenta fomentar unas cuantas incursiones en las fronteras que los supuestos de la Ilustración han conseguido cimentar en los proyectos levantados por la cultura jurídica occidental de los últimos tres siglos. Con una perspectiva diacrónica y transatlántica los autores se confrontan con las dinámicas donde la frontera se torcía en perímetro y se hacía límite, capaz de estabilizar y absorber las tensiones estructurales de la sociedad, para luego abrirse o quebrarse, cuando la ilusión de haber alcanzado el edificio perfecto chocaba con el descubrimiento de grietas estructurales. De allí que en estos momentos se reactivase una reflexión sobre los cimientos que habían puesto voluntad e individuo como elementos inexcusables (que no significa exclusivos) de la declinación de lo político y de lo jurídico de un Occidente que llega a hacer, en la segunda mitad del siglo XX, del hombre-ciudadano y de sus derechos los parámetros de la humanidad, alcanzado la frontera donde todavía hoy se está moviendo la reflexión y la praxis del poder.
