This book offers a radical new understanding of law, beyond the con nes of its formalization by t... more This book offers a radical new understanding of law, beyond the con nes of its formalization by the state. The book takes off from the late work of Gilles Deleuze and Michel Foucault, for whom law and its institutions came to be liberated from an ideological perspective that had treated them as sterile instruments for the reproduction of domination. Engaging with its continental history, it addresses the concept of law, not merely as 'command', but as the result of a much more complex legal operation aimed at dynamically stabilising the social relations of a community. The book thus sidesteps the usual legal-political focus on those-from Hobbes to Schmitt-who have contributed to the categorical scheme of the modern state, and with it questions of political representation, sovereignty, the rigid distinction between public law and private law, and so on, as it pursues an alternative theoretical trajectory through Ravaisson, Tarde, and Hauriou. Politics, this book maintains, can no longer be treated simply through the state form. And, relatedly, the law must be seen as a living law: a law that cannot be treated exclusively in formal terms, but must be taken as a grammar capable of articulating a politics of process, relationality, and innovation. Reconceived as such, law can then circumvent the aporias that arise when society is viewed as a private company, and the state seen as the bearer of the only possible means of formalising its relationships. At the intersection of law and political theory, this book will speak to scholars and others with interests in both these areas, and especially those concerned with the limits of both conventional and critical approaches to law.

Oriented around the theme of a ‘politics of philosophy’, this book tracks the phases in which Fou... more Oriented around the theme of a ‘politics of philosophy’, this book tracks the phases in which Foucault’s genealogy of power, law, and subjectivity was reorganized during the 14 years of his teaching at the College de France, as his focus shifted from sovereignty to governance. This theme, Sandro Chignola argues here, is the key to understanding four features of Foucault’s work over this period. First, it foregrounds its immediate political character. Second, it demonstrates that Foucault’s "Greek trip" also aims at a politics of the subject that is able to face the processes of the governmentalization of power. Third, it makes clear that the idea of the "government of the self" is – drawing on an ethics of intellectual responsibility that is Weberian in origin – an answer to the processes that, within neoliberal governance, produce the subject as an individual (as a consumer, a market agent, an entrepreneur, and so on). Fourth, the theme of a ‘politics of philosophy’ implies that Foucault’s research was never simply scholarly or neutral; but rather was characterized by a specific political position. Against recent interpretations that risk turning Foucault into a scholar, here then Foucault is re-presented as a key figure for jurisprudential and political-philosophical research.

Per dare risposta a tali questioni, è necessario operare un radicale spostamento di prospettiva: passare dalla «filosofia politica» a una «politica della filosofia». Perché la filosofia, checché se ne dica, è anzitutto una pratica: una pratica del sapere che produce significati, discorsi, forme di verità e falsità, istituzioni e da qui effetti sull’ambito sociale e della vita politica. Per questo occorre anzitutto interrogare l’istituzione all’interno della quale avviene l’insegnamento di questa disciplina e che è la sede di validazione dei saperi filosofici: l’Università. Si scopre allora che l’Università non è affatto un luogo neutro di trasmissione del sapere filosofico, né è sempre stata la sede nella quale veniva praticata la filosofia. Si tratta tutto sommato di un’invenzione recente, la quale ha effetti di potere sui filosofi stessi e sulla pratica del pensiero. The fourth volume of the History of Sexuality reveals some decisive problematizations of Foucault's power analytics. Displaced from its preliminary inclusion in the judicial framework and from its contamination with the inquisitorial practices of torture - a theme that recurs between Surveiller et punir and the Courses of 1974-75 - the "confession", in the double meaning of the sacramental practice (aveu) and of the "profession" of faith (confession), returns to the centre of Foucauldian research, as a "governed" form of veridiction and access to that particular dimension of Christian subjectivity - the "western" form of subjectivity, Foucault was to recognize - which, starting from the first centuries and not to date from the post-tridentine era, decisively marks the culture to which we belong. This research on Christianity is only preliminary and serves not only to set up a genealogy of the techniques of veridiction historically functional to the emergence of the governed form of subjectivity, but also to formulate the problem of that 'politics of ourselves' that will occupy until the last Foucault. The research conducted between 1980 and 1982 therefore maintains a transitional role . And it is probably for this reason that Foucault gave up publishing Les aveux de la chair.

Conduc6ng a lecture with you, assuming it is one, is an opportunity for me to try for the first 6me to propose some hypotheses and some reflec6ons on the theme of transla6on and its poli6cal implica6ons. I start with the 6tle, perhaps a li?le thoughtlessly chosen, for this lecture: Poli%cs as Transla%on & Transla%on as Poli%cs. It is, first of all, necessary for me to disambiguate its effect and try to clarify its premises. That poli;cs is transla;on can, in fact, be understood in different ways. I first want to premise what is to be excluded. That poli;cs is in fact a process of transla;on does not mean for me that poli;cs should be understood as the third field of media;on or recogni;on between iden;;es or, worse, between cultures that are somehow en;fied by the gaze that is directed at them. In the debate on mul;culturalism in vogue a few decades ago, this assump;on acted as a surrogate for liberal-democra;c prac;ce and theory in countries of more or less recent immigra;on. What was not ques;oned, however, was the inevitably white and western point of view, which allowed the differences expressed by the different 'cultures' to be related, making things of them and recording them with a police eye. Poli;cs was intended to translate these 'cultures' into the democra;c universal that recognised them and in which they should recognise themselves. It goes without saying that this posi;on, intended to implement the procedural theories of liberalism, is not mine. It is not mine because of at least two further issues that seem to me to be at work in it. The first (i) concerns the status of poli;cal philosophy, the discipline (but even this separa;on of philosophy into disciplinary fields should be discussed) to which I academically belong. The second (ii) concerns the pre-edipal phantasm of an available, maternal and welcoming universal in which to compensate for the trauma of separa;on and difference.

To do so, the authors tend to widen the meshes of the Koselleckian method. And, if it is possible to generalize what runs through the individual case studies and contributions that make up the book, they do so in at least four ways.

Il saggio affronta i concetti di «Stato» e di «Federalismo» all'interno dell'analisi di Reinhart ... more Il saggio affronta i concetti di «Stato» e di «Federalismo» all'interno dell'analisi di Reinhart Koselleck che traduce in prassi collettive le strutture della fatticità heideggeriana, radicando, con Schmitt, la concettualità giuridica sul concreto della sociologia. Analizzando alcune voci fondamentali dei Geschichtliche Grundbegriffe (Staat, Souveranität, Bund, Bündnis, Föderalismus, Bundesstaat) viene ricostruito il modo in cui Koselleck formula una prognosi immediatamente politica in merito al processo di unificazione europea, evidenziando che il federalismo, lungi dall'essere solamente un reperto archeologico del passato, rappresenta una risorsa per un ordine politico postnazionale.

Era una fredda mattina, mi pare di ricordare, nella quale ero arrivato molto presto al mio studio in dipartimento. Era, allora, ancora nel vecchio Istituto di Filosofia dell'Università. Avevo sentito qualcuno aggirarsi nel corridoio e sporgersi nella sala della biblioteca. La biblioteca che da tempo era stata svuotata, perché si stava traslocando al Palazzo del Capitanio. Ero, da pochissimo, professore. E che fossi in Istituto di prima mattina, dipendeva dallo scomodo orario dei treni e dal pendolariato ferroviario al quale ero costretto. Aprii la porta dello studio, che dava sul corridoio deserto. A quell'ora, nessuno ancora sentiva il bisogno di essere presente. In fondo al corridoio, sulla porta della Biblioteca, c'era Toni. Guardava la sala dove da giovanissimo aveva studiato e nella quale non era più entrato negli ultimi trent'anni.

El presente texto pretende problematizar las figuras zoopolíticas que Deleuze evoca respecto a la... more El presente texto pretende problematizar las figuras zoopolíticas que Deleuze evoca respecto a la adaptación de la vida, específicamente de la vida resistente al biopoder, término introducido por Foucault para aludir a las transformaciones relacionadas con el sistema capitalista. Es así que el texto se encuentra dividido en dos partes; en la primera se establece un punto de entrada en la relación que hace Foucault entre la biopolítica y el significado de "gobernar la vida". En la segunda parte se hace una reflexión a partir de Deleuze sobre el control disciplinario y las sociedades de control a partir de las figuras conceptuales de el topo y la serpiente propuestas por el autor.
Thinking of a global conceptual history requires a self-reflective inquiry into the histo- rian’s... more Thinking of a global conceptual history requires a self-reflective inquiry into the histo- rian’s theoretical standpoint and the ability to question and overcome these boundaries: this means in the first place dropping the Eurocentric or at least Atlantic vocation of modern concepts and meeting the challenge of de-colonizing history from the theoretical shadow of the modern State. This paper addresses the modern concept of sovereignty as a multivocal and conflictual semantic field, arguing for the necessity to trace its genealogy based on the structural tensions that haunt its logic – as well as its representations – ra- ther than on a linear historiographic reconstruction of its trajectories. The problematic balance between “imperium” and “dominium” is here assumed as the turning point of the rise of sovereign power as originally rooted in the very production and governance of a global space, thus giving up all Eurocentric narratives of modernity. Taking as a starting point four of Thomas Hobbes’s famous frontispieces (Philosophical Rudiments, the translation of Thucydides’ Peloponnesian Wars, De Cive, and Leviathan), the paper shows how these lines of force traverse the heart of modern European conceptuality.

An introduction to Political Philosophy, this article suggests considering political philosophy to belong in the «bastard» plane (Plato) connecting the history of practices to the history of political theory.This means: i. the necessity of referring to both the history of political concepts and to the history of philosophy; ii. the enhancement of a materialistic-political realistic study of politics and political practices; iii. a notion of philosophy (as well as of intellectual practice and intellectual responsibility) capable of analyzing, discussing and improving its own role in the field
The present article aims to interrogate the history and actuality of the concept of political rep... more The present article aims to interrogate the history and actuality of the concept of political representation from an analysis of its imbrication in the conceptual device of modernity and its aporetic character. Informed by the heuristic perspective of conceptual history as political philosophy, the text develops a journey through the modulations of representation by analyzing the main landmarks of this political concept, from the formation of the modern state to the beginnings of the paradigm of governmentality, resorting the work of Näf, Hobbes, Sieyès, Guizot and Moreno. The aim is to highlight the aporias in the history of the concept in order to reflect on its relationship with the western state, liberalism and democracy. We also wonder about the possibility of overcoming these aporias based on Guizot's theory of representative government and the value of the plural and active character of citizenship in the representative relationship. Świadomość rezultatów długoletnich dyskusji na łonie II Mię- dzynarodówki, doświadczeń zwycięskiej rewolucji październikowej, wstecznej drogi NEP-u czy powolnego pogrążania się Związku Radzieckiego w morzu stalinowskiego terroru (którego echa musiały docierać do Benjamina) nakazywała temu przenikliwemu flozofowi, jak i całemu pokoleniu, głęboko wątpić w słuszność teorii nieuchronnego czy automatycznego krachu kapitalizmu [Zusammenbruchstheorie]. W Ideologii niemieckiej znajdujemy znane twierdzenie Marksa i Engelsa, że wszelkie formy rządu rodzą się i zmieniają wraz z przemianami w sferze sił wytwórczych, a sama struktura spo- łeczna oraz państwo wywodzą się zawsze z procesu życiowego określonych jednostek takich, jakimi są w rzeczywistości, tj. jak działają, jak wytwarzają materialnie1. Nie sposób zatem oczekiwać, że w warunkach funkcjonowania niemal niezmienionych przemysłowych sił wytwórczych zrodzi się nowy, sprawiedliwy system komunistyczny. Nie inaczej było w wypadku Związku Radzieckiego, gdzie Lenin, zainspirowany efektywnością fordystyczno-taylorowskiego reżimu, zaprojektował i położył fundamenty pod nowe stosunki produkcji społeczeństwa świeżo wyzwolonego spod jarzma caratu. Przyjmujemy za Marksem, że kapitalizm rodzi swych własnych grabarzy. Jednak, jak pokazuje historia, nim się go pochowa, wpierw należy uśmiercić, a nie sposób zrobić tego, posługując się jego własną bronią. Dowiódł tego ostatecznie nieudany, blisko siedemdziesięcioletni eksperyment sowieckiego realnego socjalizmu. Podobną klęskę poniosły oparte na kontrakcie spo- łecznym, zawartym między kapitałem a związkami zawodowymi, państwa dobrobytu [welfare], od późnych lat siedemdziesiątych dwudziestego wieku podlegające postępującemu rozkładowi, przepoczwarzające się ostatecznie w hybrydyczne, neoliberalne państwa długo-bytu [debtfare]. Środkowo- i wschodnioeuropejskie kraje transformacji ustrojowej wyprzedziły Zachód w wyścigu rozkładania instytucji społecznych, a relacja między naśladującym i naśladowanym w przewrotny sposób uległa odwróceniu. To one, ciekawie dekonstruując Marksowski ewolucjonizm z pierwszych stron Kapitału, jawią się krajom Europy Zachodniej jako ich własna przyszłość. Adam Michnik miał ponoć stwierdzić, że „najgorsze w komunizmie jest to, co następuje po nim”. Choć dzieje się to obecnie wbrew jego ówczesnym intencjom, okazuje się, że miał całkowitą rację. W jaki sposób jednak możemy dzisiaj ponownie zapytywać o możliwości i horyzonty dla komunistycznej praktyki politycznej i teoretycznej?

Historical work is necessary when confronted with the political problems of the present. All the ... more Historical work is necessary when confronted with the political problems of the present. All the more so when the present seems crushed by the catastrophe of meaning and extended as a mere surface of the hectic leafing of the chronicle. For more than a year, Russia has been invading Ukraine. In the military occupation of the public stage by political scientists, generals, international relations experts, and journalists accusing one side or the other of pro-Putinism or pro-American imperialism, few voices have yet been raised to place the war within the framework of the longterm structures that pervade history. In his latest work, Claudio Ingerflom, who describes his research as a contribution to the «history of the present», uses his deep expertise as a historian of Russia to deconstruct the political (and for that very reason: illegitimate) use of history cultivated by the inner circle of politicians, intellectuals, and lawyers close to Vladimir Putin. In doing so, on the one hand, he clarifies the meaning of the «special military operation» launched on February 24, 2022, by situating it within the oft-repressed and long history of Russian imperial colonialismimperialism that precedes NATO's expansionism eastward in the crisis triggered by the collapse of the Soviet regime. On the other hand, his conceptual assumptions deconstruct the state-centered rhetoric codifying the «mission» that Putin's Russia projects into the global future.

Per questo occorre anzitutto interrogare l’istituzione all’interno della quale avviene l’insegnamento di questa disciplina e che è la sede di validazione dei saperi filosofici: l’Università. Si scopre allora che l’Università non è affatto un luogo neutro di trasmissione del sapere filosofico, né è sempre stata la sede nella quale veniva praticata la filosofia. Si tratta tutto sommato di un’invenzione recente, la quale ha effetti di potere sui filosofi stessi e sulla pratica del pensiero. Effetti non positivi quando l’Università diventa un’istituzione del neoliberismo. Per questo alla filosofia oggi spetta il compito di fare politica.

Michel Foucault and the 'Confessions of the Flesh'.
The fourth volume of the History of Sexuality reveals some decisive problematizations of Foucault's power analytics. Displaced from its preliminary inclusion in the judicial framework and from its contamination with the inquisitorial practices of torture - a theme that recurs between Surveiller et punir and the Courses of 1974-75 - the "confession", in the double meaning of the sacramental practice (aveu) and of the "profession" of faith (confession), returns to the centre of Foucauldian research, as a "governed" form of veridiction and access to that particular dimension of Christian subjectivity - the "western" form of subjectivity, Foucault was to recognize - which, starting from the first centuries and not to date from the post-tridentine era, decisively marks the culture to which we belong. This research on Christianity is only preliminary and serves not only to set up a genealogy of the techniques of veridiction historically functional to the emergence of the governed form of subjectivity, but also to formulate the problem of that 'politics of ourselves' that will occupy until the last Foucault. The research conducted between 1980 and 1982 therefore maintains a transitional role . And it is probably for this reason that Foucault gave up publishing Les aveux de la chair.

Discussing a possible relation between politics and philosophy, with reference to Furio Cerutti’s Conceptualizing Politics. An introduction to Political Philosophy, this article suggests considering political philosophy to belong in the «bastard» plane (Plato) connecting the history of practices to the history of political theory.This means: i. the necessity of referring to both the history of political concepts and to the history of philosophy; ii. the enhancement of a materialistic-political realistic study of politics and political practices; iii. a notion of philosophy (as well as of intellectual practice and intellectual responsibility) capable of analyzing, discussing and improving its own role in the field
