Zakljucenjem ugovora o prodaji bilo međunarodnog bilo domaceg karaktera, ugovorne strane imaju određena prava i obaveze: prodavac da isporucii robu, preda dokumenta koja se na robu odnose i prenese vlasnistvo na robi, dok je kupac dužan isplatiti cijenu i preuzeti isporuku. Za izvrsenje preuzetih obaveza, odgovaraju i kupac i prodavac. Upravo povredom ugovornih obaveza bilo koje od ugovornih strana mogu nastati složeni pravni i ekonomski problemi. Ovaj rad rezultat je proucavanja odredbi Becke konvencije o ugovorima o međunarodnoj kupoprodaji robe iz 1980. godine i Zakona o obligacionim odnosima BiH koje uređuju odgovornost prodavca kod ugovora o prodaji robe. Bosna i Hercegovina propisima na različitim nivoima reguliše oblast prava privrednih društava na ... more Bosna i Hercegovina propisima na različitim nivoima reguliše oblast prava privrednih društava na više ili manje harmoniziran način zbog specifi čnog ustavnog uređenja. Najmanji broj propisa je donesen na državnom nivou zbog nadležnosti entiteta za regulisanje ove oblasti. Materijalnopravni propisi o statusu privrednih društava su doneseni na nivou entiteta Federacije Bosne i Hercegovine, Republike Srpske i u Brčko Distriktu BiH. Procesni propisi koji uređuju postupak osnivanja društva doneseni su također na nivou entiteta, ali na državnom nivou postoji Okvirni zakon o registraciji poslovnih subjekata koji propisuje obavezu usaglašavanja procedura u entitetima njihovim procesnim propisima. Sporazum o stabilizaciji i prodruživanju Bosne i Hercegovine sa Europskom Unijom je stupio na snagu 2015. godine, te su započete određene reforme sa ciljem usaglašavanja prava Bosne i Hercegovine sa pravnom stečevinom Europske Unije. By conclusion of the contract of sale, in international or domestic law, the parties have certain rights and obligations: the seller has obligation to deliver the goods, hand over documents relating to the goods and transfer ownership of the goods, while the buyer is obliged to pay the price and take delivery. Both the buyer and the seller are liable to carry out these commitments. To carry out the commitments correspond to both the buyer and the seller. It is a violation of the contractual obligations of any Contracting Party may arise complex legal and economic issues.Violation of the contractual obligations of any contracting party may arise complex legal and economic issues. This paper is the result of analyzing the provisions of the Vienna Convention on contracts for the international sale of goods in 1980. and the Law on Obligations of Federation of Bosnia and Herzegovina regulating the responsibility of the seller in international contracts of sale of goods. This paper will primarily determine the scope of aplication of the provisions of seller's liability from Article 30 to 54 Vienna Convention, then the conditions of existence liabilitey, as well as exemptions from liability provided for by the Convention. These solutions will then be compared with the rules of the Law on Obligations of the Federation of Bosnia and Herzegovina.
