The precautionary principle that calls for early measures to avoid and mitigate
uncertain environmental damages (and health hazards) in the future has come to the fore
in risk debates. This paper evaluates three criticisms which have been presented in
academic discourses, in political arenas, and also in public discussions in order to reject
the principle altogether. In particular, the criticisms are labelled as the argument from
vagueness, the argument from incoherence, and the argument from adverse effects. It is
argued that these objections do not result in the abandonment of the precautionary
principle on the whole, but only of its particular implausible interpretations. The conclusion
drawn is that the burden of proof remains with the ones who reject the principle.

The paper highlights shortcomings in the public consultation practices on the deliberate release and placing on the market of GMOs in the European Union and in one of its member countries, Finland. It is argued that current GMO consultation practices do not meet the aims and objectives on which their introduction is typically justified. Specifically, they do not serve democracy, increase consensus, enable better decisions to be made, or establish trust. We conclude that there is a clear need for the active development of the GMO consultation practices and for a further critical discussion on the ethical and socio-political foundation of public engagement.

The precautionary principle (PP) has come to the fore in agricultural biotechnology debate. It calls for early measures to avoid and mitigate uncertain environmental damage and health hazards in the future. This summary article reviews the discussion on the PP. Main arguments for and against invoking the principle in the context of genetically engineered crops are considered.

Ruokaan ja syömiseen liittyy monia eettisiä kysymyksiä. Onhan kaikki ravinnoksi kelpaava peräisin elävistä olennoista ja yhden elämän ylläpitäminen syömällä tarkoittaa usein toisen elämän loppua. Moraalisesti merkityksellistä ei ole vain se, mitä syömme, vaan myös se, miten ruokamme tuotetaan. Monet kuluttajat ovatkin kiinnostuneita esimerkiksi luomu- ja reilun kaupan tuotteista. Erilaisten eettisistä perusteista kumpuavien ruokavalioiden noudattaminen on yleistymässä. Viime aikoina ruoan etiikasta on Suomessa keskusteltu muun muassa liittyen sianlihan tuotantoon, koulujen kasvisruokapäiviin, ilmastonmuutoksen torjuntaan ja muuntogeenitekniikkaan. Nimensä mukaisesti Muuntogeenisen ruoan etiikka -kirjassa tarkastellaan muuntogeeniseen ruokaan ja sen tuotantoon liittyviä eettisiä ja yhteiskuntafilosofisia kysymyksiä ja näkökohtia.

Nykyaikainen biotekniikka ja erityisesti siirtogeenitekniikoiden käyttö ruoan tuotannossa ovat herättäneet keskustelua niin Suomessa, Euroopan unionissa kuin laajemminkin maailmalla. Suomessa (ja muuallakin) muuntogeenistä ruokaa koskeva julkinen keskustelu on ollut varsin polarisoitunutta. On perusteltua puhua erimielisyydestä ja keskustelijoiden jakautumisesta muuntogeenisen ruoan kannattajiin ja vastustajiin. Käsillä olevan kirjan lähestymistapa on maltillisempi, eikä sen ole tarkoitus toimia julistuksena muuntogeenisen ruoan puolesta tai sitä vastaan. Sen sijaan tavoitteena on avata erilaisia moraali- ja yhteiskuntafilosofisia näkökulmia muuntogeeniseen ruokaan ja sen tuotantoon. Kantavana ajatuksena on, että erilaisten perustelujen ja näkökohtien selventäminen mahdollistaa muuntogeenisen ruoan yhteiskunnallisen hyväksyttävyyden paremman arvioinnin. Se voi myös auttaa yksilöitä omien näkemystensä muodostamisessa ja tarjota perusteita henkilökohtaiseen päätöksentekoon koskien muuntogeenisen ruoan käyttöä.

Kirja koostuu johdannosta ja yhdeksästä artikkelista. Kirjoittajat ovat turkulaisia bio- ja geenietiikan parissa työskenteleviä filosofeja. Kirjassa perehdytään kuluttajien itsemääräämisoikeuden kunnioittamiseen, muuntogeenisen ruoan merkintävelvoitteen eettisiin perusteisiin ja muuntogeenisten tuotantoeläinten etiikkaan. Muuntogeenistä ruokaa verrataan muuntogeenisiin lääkkeisiin ja muuntogeenisten organismien nykyistä hyväksymismenettelyä kritisoidaan. Kirjoittajat tarkastelevat kysymystä kasvien geenimateriaalin omistamisen mahdollisuudesta ja kysyvät, millaisia korvausvelvoitteita muuntogeeniseen ruokaan voisi liittyä. Muuntogeenistä ruokaa käsitellään myös ilmastonmuutoksen ja kehitysmaiden nälkäongelman näkökulmista. Kirja on suunnattu paitsi filosofeille ja eetikoille, myös kaikille aiheesta kiinnostuneille.

In this book, I apply a philosophical approach to study the precautionary principle in environmental (and health) risk decision-making. The principle says that unacceptable environmental and health risks should be anticipated, and they ought to be forestalled before the damage comes to fruition even if scientific understanding of the risks is inadequate. The study consists of introductory chapters, summary and seven original publications which aim at explicating the principle, critically analysing the debate on the principle, and constructing a basis for the well-founded use of the principle. Papers I-V present the main thesis of this research. In the two last papers, the discussion is widened to new directions.

The starting question is how well the currently embraced precautionary principle stands up to critical philosophical scrutiny. The approach employed is analytical: mainly conceptual, argumentative and ethical. The study draws upon Anglo-American style philosophy on the one hand, and upon sources of law as well as concrete cases and decision-making practices at the European Union level and in its member countries on the other. The framework is environmental (and health) risk governance, including the related law and policy.

The main thesis of this study is that the debate on the precautionary principle needs to be shifted from the question of whether the principle (or its weak or strong interpretation) is well-grounded in general to questions about the theoretical plausibility and ethical and socio-political justifiability of specific understandings of the principle. The real picture of the precautionary principle is more complex than that found (i.e. presumed) in much of the current academic, political and public debate surrounding it. While certain presumptions and interpretations of the principle are found to be sound, others are theoretically flawed or include serious practical problems.

The analysis discloses conceptual and ethical presumptions and elementary understandings of the precautionary principle, critically assesses current practices invoked in the name of the precautionary principle and public participation, and seeks to build bridges between precaution, engagement and philosophical ethics. Hence, it is intended to provide a sound basis upon which subsequent academic scrutiny can build.

This paper spells out and discusses four assumptions of the deficit model type of thinking. The assumptions are: First, the public is ignorant of science. Second, the public has negative attitudes towards (specific instances of) science and technology. Third, ignorance is at the root of these negative attitudes. Fourth, the public’s knowledge deficit can be remedied by one-way science communication from scientists to citizens. It is argued that there is nothing wrong with ignorance-based explanations per se. Ignorance accounts at least partially for many cases of opposition to specific instances of science and technology. Furthermore, more attention needs to be paid to the issue of relevance. In regard to the evaluation of a scientific experiment, a technology, or a product, the question is not only “who knows best?,” but also “what knowledge is relevant and to what extent?.” Examples are drawn primarily from the debate on genetic engineering in agriculture.

The precautionary principle has come to the fore in risk discourse. It calls for early measures to avoid and mitigate environmental damage and health hazards in the face of uncertainty. This paper reviews the history of and current research on the principle and suggests areas where further scrutiny is needed. The origin of the precautionary principle is traced back to three sources: (1) the general idea of precaution, (2) specific nonjudicial codes of conduct and arguments from precaution, and (3) law texts. Much of the current theoretical study has been concerned with analysis of different aspects of the precautionary principle and with assessment of specific versions of the principle in different regulatory contexts. Issues related to terminology, to basic structure shared by different formulations of the principle, and to the distinction between strong and weak interpretations are considered. Discussion on different versions of the precautionary principle as (1) rules of choice, (2) procedural requirements, and (3) epistemic rules or principles is briefly revisited. General arguments leveled at the principle are spelled out. Despite the attention the precautionary principle has received in academic literature, there remain areas of research which deserve more thorough scrutiny. Formal methods of inquiry have been insufficiently utilized. Topics which deserve further study include the normative underpinnings of the principle, the status of the principle in scientific risk analysis, and the principle’s relationship with stakeholder/public engagement.

This paper argues for the Triad Thesis, the claim that the acceptability of the precautionary principle depends on the justifiability of three imperatives. The precautionary principle calls for early measures to avoid and mitigate serious environmental and health effects in the face of scientific uncertainty. The imperatives are as follows: First, the onus of proof should fall on risk imposers; they need to show that a proposed activity is safe enough. Second, indications of danger that do not qualify as scientific knowledge should be taken into account and may be decisive. Scientific proof is not a prerequisite for taking pre-emptive actions to mitigate risks. Third, serious and irreversible environmental and public health hazards override economic benefits related to an activity. Applying standard Cost-Benefit Analysis is misplaced. The Triad Thesis points to the need for a careful assessment of the nature and extent of justification that the three imperatives can provide.

We identify four issues in the decision framework for species conservation management under climate change proposed by Shoo et al. (2013) Clim Chan 119:239–246 and suggest ways to address them. First, binary-decision flow charts require Yes/No answers, which are not appropriate in most conservation decisions. A quantitative framework is preferable and action-guidance should be obtained even when the realistic answer to some questions remains “we simply do not know”. Second, the proposed flow chart imposes an a priori order of precedence and does not explicitly allow simultaneous actions. A workable framework should enable optimal allocation between multiple kinds of conservation efforts and permit complementary actions. Third, the probability of success, co-benefit to non-target species, and cost are unlikely to have a simple, consistent relationship across taxa. These variables need to be assessed case-by-case for each conservation measure and species. Finally, the decision framework disregards the legal, social, and ethical aspects pertaining to decision-making.

Synteettisen biologian herättämien eettisten kysymysten kanssa samankaltaisia eettisiä kysymyksiä on käsitelty aiemmin erityisesti geenietiikan ja uusien teknologioiden etiikan yhteydessä. Argumentoin, että ainakin synteettiseen biologiaan liittyvät bioturvaamisnäkökohdat ovat kuitenkin osin uudenlaisia. Koska synteettinen biologia kuuluu Euroopan unionissa geenitekniikkasääntelyn piiriin, voi bioturvaamisnäkökohtien eroavuus toimia perusteena tarkistaa siihen liittyvää lainsäädäntöä sekä hallinnollisia ja viranomaisvalvonnan menettelytapoja. Tässä kirjoituksessa tarkastelen siis sitä, liittyykö synteettiseen biologiaan uudenlaisia eettisiä kysymyksiä vai ovatko kysymykset enemmän tai vähemmän toisintoja geenietiikan ja yleisemmin bioetiikan jo paljon keskustelluista aiheista. Perustan analyysini bio-, geeni- ja synteettisen biologian etiikkaa koskevaan akateemiseen kirjallisuuteen, oikeuslähteisiin sekä julkaistuihin raportteihin.

Assisted migration is a controversial conservation measure that includes moving species threatened by climate change beyond their indigenous range. Sandler argues that assisted migration exhausts most of the value of the species moved and that assisted migration, thus, fails to be a workable conservation measure. We show how accepting the moral relevance of species’ indigenous range helps to reconcile Sandler’s argument with earlier arguments about value loss in ecosystem restoration by Elliot and Katz. Contrary to Sandler, they do not favour losing a biological unit to retaining it in a human-influenced form. Drawing on the distinction between property- and history-based understandings of naturalness, we further argue that the outcomes of assisted migration to the predicted range are more natural in the property-based sense of the term, and thus retain more value, than the outcomes of “assisted migration” elsewhere.
