The method of accessing investments, dividing recompense into two or more countries, buying and selling in world trade or domestic market, solving international conflicts, dividing opportunities for all people in Human Rights, false government, untruthful data security, false bank, untrue stock exchange, untruthful judiciary, false corporate, untrue education, untrue Federal Bank, false fractional reserve system, false classical money, are causes that the effects are the collapse of the classical monetary system, classical trading system, classical government system, classical judicial system. The current monetary mechanism is bankrupt. How is the market and the relationship between people, companies, governments, banks, stock exchanges, jobs, investments, corporate governance, legal, recompense without the classic monetary system, no classic money, no classic jobs, no classic recompense, no bag of classical values? without the classic division of recompense, without classic money, without access to banks, without the judiciary to resolve conflicts? Centralized method The current system around the world has a centralized method. The government centralized, the Judiciary centralized, the power to draft rules and laws centralized, centralized control of the World Trade. Global investment control is centralized. The whole system in government and structure to control and resolve conflicts and money are centralized. If the individual or the companies have a conflict, the centralized method is to solve the problem by the Judiciary and its chain: lawyers, prosecutors, judges and others. If the individual or companies need money to invest in their projects, the centralized method is the bank, the government or the stock exchange. Monopoly of classical money. Company in isolated place in developing countries can send and receive investments from all over the world without classic stock exchange system, classic banking system, classic system of government, classic court system? Disruption or decentralized method The current system around the world has a centralized method. But there is a decentralized method that is the effect of the union of new technologies such as Blockchain, internet of things, Crypto-currency, general data protection, Smart contracts, self executable contract, artificial intelligence. If the individual or the companies have a conflict, the decentralized method will solve the problem immediately and automatically when the anomaly determined in the Smart contract and the Auto Executable Contract is detected by the System. The control is through the Internet of Things and stored in a Blockchain Database. This solution is Disruption with the classical method of the Judiciary and its chain to resolve any conflicts between peoples. The minimal intervention of governments in human rights is the basis of the decentralized method for resolving conflicts and leaving aside the classical structure. If the individual or companies need money to invest in their projects, the centralized method is the bank, the government or the stock exchange. Those of the classic coin monopoly. Few people and companies have access to capital for investment in the classic centralized monetary system. In the decentralized method any person or company anywhere in the world, with much or little money, can invest in any project. African, Brazilian, Chinese, any people, singer, musician, farmer, fisherman, actor, author, any work can send and receive investments from anywhere in the world without classical stock exchange system, classic banking system, system of the Judiciary. Company in all sectors of the national or global economy, in an isolated place, in developing countries can send and receive investments from all over the world without a classic stock exchange system, without a classic system of banks, without a classic system of government, without a system judiciary.

Osservazione Il Mar Mediterraneo è un bacino semi con una superficie di 2,6 milioni km2 e l'accesso all'oceano Atlantico dallo stretto di Gibilterra. Il bacino idrico ha un tempo di permanenza di circa 100 anni (Ramirez-Llondra et al., 2013; Cózar et al., 2015; Tuba et al., 2015). Il Mar Mediterraneo si distingue per la sua ricca biodiversità e ospita circa il 7,5% delle specie marine conosciute. (Ramirez-Llodra et al., 2013). Le zone litoranee della regione hanno un'alta densità demografica con +427 milioni abitanti (circa 7% della popolazione del mondo), attraggono un gran numero di turisti durante i mesi di estate (25% del turismo internazionale annuale) ed hanno un grande quantità di traffico commerciale e ricreativo Marino (il 30% del traffico marittimo globale passa attraverso il Mar Mediterraneo) (UNEP/MAP, 2011; Eurostat, 2017). Problema L'alta attività nella regione ha favorito l'accumulo di rifiuti come la plastica, il vetro, il legno e la gomma nel Mar Mediterraneo, e sono stati rinvenuti residui nella colonna d'acqua, nelle spiagge e nei fondali marini. La topografia della regione e la quantità di attività umane aumentano la probabilità di contaminazione dalla plastica e da altri tipi di rifiuti generati dall'uomo. La circolazione delle acque tra il Mediterraneo e l'oceano Atlantico è limitata, dando origine ad un accumulo di rifiuti che galleggiano nel bacino del Mediterraneo. Observation L'arbitrage est une méthode de résolution des conflits, dans laquelle les parties définissent qu'une personne ou une entité privée va résoudre la controverse présentée. La loi évolue. Les conflits qui sont les effets des relations entre les personnes évoluent dans la même dimension que la fourniture de services et la vente de biens destinés à la consommation, avec le soutien de nouvelles technologies. Tout d'abord, pour résoudre le conflit, il était nécessaire: les parties et les conflits entre eux, avocat, parquet, juge. Cette chaîne de résolution de conflits a eu de nombreux problèmes depuis des siècles. Dans les pays en développement, le problème de la magistrature est plus grand. La corruption, la lenteur, les salaires élevés, de nombreux privilèges pour ses membres, le coût élevé des services, une mauvaise assistance pour le peuple, ne sont que quelques-uns des nombreux problèmes concernant le modèle de justice qui dépend de la magistrature et de toute sa chaîne d'action bureaucratique. Il est dans le modèle de la magistrature, pour résoudre les conflits, l'évolution du système actuel. L'arbitrage est une méthode de résolution des conflits, dans laquelle les parties définissent qu'une personne ou une entité privée va résoudre la controverse présentée. Le modèle général de l'arbitrage est l'évolution de la résolution des conflits. C'est la perturbation de la chaîne de solution de conflit. Il s'écarte de la magistrature le problème juridique des individus et des entreprises. Le même modèle est la médiation. C'est l'évolution du système de solution de conflit qui supprime le pouvoir judiciaire. Sans aucun doute, la chaîne judiciaire est lente, a un coût élevé pour la personne et pour l'entreprise, est un processus complexe, difficile, précaire, sous réserve de la corruption à grande échelle dans tous les secteurs. Quelle est l'évolution de la résolution des conflits après l'arbitrage et la médiation? Cet article nous étudions la technologie blockchain, Internet des choses, la réglementation générale de la protection des données de la personne physique, cryptocurrencies (Crypto-coin), contrat exécutable automatique et la résolution des conflits par la perturbation de la chaîne judiciaire. The Law and Finance of Initial Coin Offerings

The rise of new technologies is changing the way companies raise funds. Along with the recent increase of crowdfunding in the past years, a new form of funding has emerged more recently: the use of Initial Coin Offerings (ICOs). In 2017, companies raised more than $4 billion through ICOs in the United States, and more than $17billion has been raised in the first three quarters of 2018. In a typical ICO, a company raises cryptocurrencies giving some rights in return. The different nature and features of these rights, embodied in “tokens”, are generating many controversies among securities regulators around the world. Namely, it is not clear whether and, if so, when these tokens should comply with securities law. Securities regulators are addressing this issue in a very different manner across jurisdictions: while countries like the United States, Switzerland and Singapore are requiring companies to comply with existing securities rules only when a company issues “security tokens”, other jurisdictions, such as China and South Korea, have prohibited ICOs, and Mexico subject any issuance of tokens to a system of full control ex ante. Nevertheless, ICOs not only generate these challenges for securities regulators. They also arise many other issues from an accounting, finance, corporate governance, data protection, anti-money laundry and insolvency law perspective. By providing a comparative and interdisciplinary analysis of ICO, this paper seeks to provide regulators and policy-makers with a set of recommendations to deal with ICOs in a way that may promote innovation and firms´ access to finance without harming investor protection, market integrity and the stability of the financial system.

Cutting out the middleman: A case study of blockchain-induced reconfigurations in the Swiss financial services industry

Blockchain-technology promises to have far-reaching economic and social implications, which are not yet foreseeable in its extent. It threatens to disintermediate many well- established sectors of the economy, and incumbent businesses might be overtaken by ambitious newcomers. The financial services industry is particularly “ripe for disintermediation” since blockchain-technology has with Bitcoin and other cryptocurrencies its first real-world use case. Incumbent businesses have to react if they do not wish to perish. However, technological evolution also affects the State and other governmental bodies: institutional frameworks or territorial arrangements can become obsolete or detrimental to business activity and may need to be amended. This paper aimed to examine ongoing technology-induced reconfigurations in the financial services industry through a four lenses framework. The technology, actors and their discourses, as well as the regulatory environment and affected territories, need to be considered all at once. We have applied this framework to the case of Switzerland: a country with an influential financial services industry that has seen better days. We have found that (1) the Swiss Confederation has swiftly adapted its institutional framework to the new reality in order to foster competition and innovation; (2) there are some raucous controversies between challengers and incumbent businesses. However, a tacit compromise allows them to co- exist; (3) four “crypto-clusters” are emerging. These are located in traditional banking centers (Zurich, Zug, Lake Geneva region, Chiasso) that are seeking to strengthen their international visibility and improve their competitiveness.

UNDERSTANDING BLOCKCHAIN TECHNOLOGY AND HOW TO GET INVOLVED

Introduced in 2009 as the core mechanism for the Bitcoin, Blockchain technology enables the creation of a decentralized environment, where transactions and data are not under the control of any third party organization. Any transaction ever completed is recorded in a public ledger in a verifiable, secure, transparent and permanent way, with a timestamp and other details. In the first part of the paper, we explore the blockchain technology and platforms. Next, there are presented existing global and governmental initiatives, together with potential applications of blockchain in different domains, with focus on education. The need to learn about this emerging technology is discussed, together with pioneering cases in formal and informal learning settings. There are also introduces the educational projects developed by the author, such as OpenEduChain, a permissioned blockchain designed as a repository for open educational assets, but also for issuing digital certificates. Offering a fresh perspective over blockchain technology and educational initiatives, the paper could be useful for educational actors and policy makers wanting to explore and to integrate blockchain in institutional projects and curricula.

The Path of the Blockchain Lexicon (and the Law

The terminology around blockchain technology is notoriously confusing, with disputes over whether a blockchain is the same as a distributed ledger, or whether an appcoin is the same as a protocol token. In this article, I examine the difficulties the rapidly shifting, contested vocabulary poses for regulators seeking to understand, govern, and potentially use blockchain technology, and offer suggestions for how to fight through the haze of unclear language. In Part I, I provide examples of the fluctuating, contested language in the blockchain technology space, and describe the forces at play in shaping the language. In Part II, I lay out the problems the language raises for regulators, including challenges in identifying the facts about the technology, distinguishing among the many variations of the technology, and communicating clearly about the technology, as well as increasing the chances of regulatory capture, inconsistent regulation across jurisdictions and subject domains, and " perverse innovation. " In Part III, I closely analyze the use of the term " immutable " in blockchain discourse, to illuminate the confusion a single term can cause for regulators (and the public at large). I argue that the widespread use of the term " immutable " as a defining feature of blockchain technology is misleading, given that (i) real world events have demonstrated that the unchangeable nature of a blockchain record is always limited by the decisions of its human governors to change it, and (ii) the source of a blockchain record's " immutability " is disputed, meaning that it is unclear whether any particular variation of the technology may be fairly described as creating an " immutable " record. This is problematic as regulators have already begun to craft legislation describing the records created by blockchain technology as immutable, and are making decisions to use the technology in large part because of its " immutability. " In Part IV, I suggest ways regulators can become better educated about blockchain technology, as is essential for them to responsibly govern or use the technology. I also recommend that regulators take a highly critical approach that (i) seeks to separate hype from reality; (ii) is sensitive to how incentives may shape the way blockchain technology is portrayed by industry and those sponsored by industry, and how misleading terminology appears in publications of the highest prestige levels; (iii) includes diverse perspectives from proponents and critics of the technology, multiple disciplines, and from across the gender, race, geographic, and economic development spectrums; (iv) takes nothing, including descriptions of the technology itself, at face value, but deeply interrogates and scrutinizes the technology and its stated capabilities; and (v) asks regulators to think for themselves about the technology and its benefits rather than succumbing to herd behavior.

Corporate Governance for Complex Cryptocurrencies? A Framework for Stability and Decision Making in Blockchain-Based Organizations

Cryptocurrencies such as bitcoin or ethereum are gaining ground not only as alternative modes of payment, but also as platforms for financial innovation, particularly through token sales (ICOs). All of these ventures are based on decentralized, permissionless blockchain technology whose distinguishing characteristics are their openness to, and the formal equality of, participants. However, recent cryptocurrency crises have shown that these architectures lack robust governance frameworks and are therefore prone to patterns of re-centralization: they are informally dominated by coalitions of powerful players within the cryptocurrency ecosystem who may violate basic rules of the blockchain community without accountability or sanction. Against this background, this paper makes two novel contributions. First, it suggests that cryptocurrency and token-based ecosystems can be fruitfully analyzed as complex systems that have been studied for decades in complexity theory and that have recently gained prominence in financial regulation, too. It applies these insights to three key case studies: the Bitcoin Hard Fork of 2013; the Ethereum hard fork of 2016, following the DAO hack; and the ongoing Bitcoin scaling debate. Second, the paper argues that complexity-induced uncertainty can be reduced, and elements of stability and order strengthened, by adapting a corporate governance framework to blockchain-based organizations: cryptocurrencies, and decentralized applications built on top of them via token sales. Most importantly, the resulting “comply or explain” approach combines transparency and accountability with the necessary flexibility that allows cryptocurrency developers to continue to experiment for the sake of innovation. Eventually, however, the coordination of these activities may necessitate the establishment of an “ICANN for blockchains”.
