Starting from a brief view of the history of the two main accusatorial and inquisitorial systems, and the current validity of a highly diverse mixture of models, this paper focuses on highlighting the defining features, convergence among all of them and the need to achieve a model of " common minimum standards " which would allow us to both safeguard inalienable guarantees and identities established in the history and culture of each society, perhaps based on commonly accepted International Declarations.

As a result of a long and consistent legislative evolution of more than a century of development of the model of criminal procedure, the Brazilian Constitution of 1988 adopted the accusatorial system, following the world trend of democratic countries. Although in legislation formulas which are typical to the inquisitorial system still exist, their validity and interpretation must be adapted to the constitutional paradigms. However, the tradition of the previous model still influences the legal practice and creates obstacles to the implementation of some aspects of the accusatorial system in Brazil. Thus, the main difficulties are not in the legislation, but in the bias and behavior of various agents of the criminal prosecution system. This article aims to point out some of these obstacles and to analyse more closely the role of the investigative police and the judiciary.

The inquisitorial systematic was nevera guarantor; the accusatory one, without a doubt, is. The guar-antor's legal process is not dull paternalism. lt does not have, of course, moral commitments. The guarantor's legal process, even the functionalism, is a way to approach man. Man gets privileged from the guarantor's legal process, beca use it recognizes that the manis the reason of being of the State. Manis miscible.
