Dans une précédente analyse, nous avions abordé la définition de la notion de « Restitution ». Pour ce second volet de notre rencontre avec le philosophe Martin Vander Elst, nous cherchons à identifier les leviers juridiques, politiques et moraux ou symboliques sur lesquels les partisans de la restitution peuvent s'appuyer. Nous aborderons également la circulation des objets volés et la manière dont, par des liens que le chercheur qualifie de « secrets », les massacres coloniaux se révèlent inextricablement liés aux fétiches et autres artéfacts spoliés. Dans la dernière partie de l'entretien, nous découvrirons des aspects quasi ésotériques (dissimulation du contexte de violence dans lequel les objets ont été appropriés) voire sacrificiels – dans la mesure où des vies africaines ont été enlevées. Cette analyse nous invite à regarder les musées coloniaux sous un angle nouveau, celui d'une profonde injustice. Quels sont les instruments juridiques d'une véritable politique de la restitution ? Pour ce qui concerne les objets de la collection Storms, l'avocat Christophe Marchand, dans une interview réalisée par Michel Bouffioux 2 , met en avant deux notions issues du droit pénal, celle de « recel » et celle de « blanchiment ». 1. Inleiding De anti-witwaswet, verplicht alle meldingsplichtigen om atypische (financiële) transacties te rapporteren aan de Cel voor Financiële Informatieverwerking (CFI) in de strijd tegen het witwassen van geld en de financiering van terrorisme. Het witwasproces telt drie fases: injectie, opeenstapeling en integratie. Bij dit proces gaat het er vooral om de link te verbreken tussen het illegale fondsen en het oorspronkelijk misdrijf, waarna deze fondsen gemakkelijker in de legale economie kunnen worden geïntroduceerd. Meldingsplichtigen spelen een cruciale rol in die verschillende fases, vooral dan in hun functie van “deur-opener” tot de legale economie. Vanwege hun functie in het legaal commercieel gebeuren hebben zij als het ware de sleutel in handen om illegaal geld gemakkelijker in het legaal circuit binnen te loodsen. De klassieke AML/CFT-opleidingen (Risk Based Approach) concentreren zich vooral op de inhoud van de anti-witwaswet (inrichting van het kantoor, risk-based approach, eenvoudige en verscherpte waakzaamheid, …) terwijl deze opleiding u in inzicht geeft in de technieken (typologieën) die worden toegepast door witwassers evenals inzicht in de meldings-, onderzoeks- en vervolgingsketen van het anti-witwasproces. Dit opleidingstraject bestaat uit 5 verschillende modules: algemeen, (niet-) financiële misdrijven, cybercrime, modus opérandi en een workshop-analyse cases. Het betreft hier een complementaire opleiding (Typology Based Approach) aan de meer klassieke opleidingen. 2. Doelstelling Deze opleiding zal u leren inzicht verwerven in verloop van het witwasproces en de combinatie van verschillende typologieën. Verder zal men leren de verschillende typologieën te situeren het geheel van de bestrijding van het witwassen (crime time line). Na de opleiding zal men een inzicht hebben in de typologieën die worden gebruikt in non-cash-based economieën (financially included part) en cash-based economieën (financially excluded part). Vervolgens wil deze opleiding u ook een houding van “professioneel scepticisme” aanleren met het doel u bewust te maken dat er in uw professionele werksfeer witwassen in het spel kan zijn, en u ook een vragende geest en een kritische beoordeling te leren ontwikkelen van mogelijke aanwijzingen (typologieën).

This book presents a professional course of action for a financial and economic investigation – ‘Penal Investigations of Tax Fraud in Belgium’ and is intended for practical use.
The Penal Tax Fraud Investigation will mostly be set up after a report from the Competent Tax Administration, although the police can also start an official investigation by making an official report. The essence of the Penal Investigation must necessarily concentrate on those essentials, from which it can be discerned that the person or company in question is guilty of tax fraud. This must be expressed from the diverse interrogations by the responsible tax officials, the suspects, the accomplices and the witnesses, and also from the various obtained information and the analysis of the data gathered. Furthermore, the diversity of taxes (Income Tax, VAT, Registration and Inheritance Taxes, Customs & Excise Taxes…) and also the variety of tax offences must be taken into account.
Penal Tax Investigation differs from case to case. Each case has it own specification. In spite of these conclusions it is possible to specify a series of procedures which can be followed in each case of Tax Fraud Investigation. The content of this book is focussed on the manner in which a Penal Tax Dossier may be composed and what essentials the Penal Dossier must contain. Daily cases of tax fraud are being treated, rather than the more advanced cases of tax fraud, such as VAT Carousels and Cash Fund Companies.

Dit boek behandelt de manier waarop een fiscaal strafdossier kan worden samengesteld en welke elementen het strafdossier moet bevatten. Het spitst zich toe op de meest voorkomende gevallen van fiscale fraude. De meer gespecialiseerde vormen van fiscale fraude, zoals btw-carrousels en kasgeldvennootschappen worden buiten beschouwing gelaten.

In this paper, we present a soft computing model fortax fraud detection in small firms and businesses. Inputs to themodel are periodical finance reports and related informationabout market and inspection firms, and outputs are an inferenceof the tax fraud status. First, after using fuzzy inferences, thesystem determines a close business class to which the inspectedfirms belong. Next, training by statistical data from the businessclass, Neural Network (NN) is used to determine the fraud statusof the inspected firm. Training data for the NN is periodicalfinance reports, market information of the business class andfraud history of the inspected firms. Finally, we describe initialevaluations and our future works
