Fight against corruption

Bu araştırma, Türkiye Felsefe Kurumu Derneği (TFK) tarafından Avrupa Birliği finansmanı ile gerçekleştirilen “Sosyal Hizmetlerde Yolsuzluk ve Diğer Etik Sorunları Aşmada ve Önlemede Bir Yol Olarak Etik Kapasite Geliştirme Projesi” kapsamında yapılmıştır. Projenin ortağı Sosyal Hizmet Uzmanları Derneğidir (SHUDER). Çocuk İhmali ve İstismarını Önleme Derneği, Hayat Sende Gençlik Akademisi Derneği, Kadın Çalışmaları Derneği, Kuçuradi Felsefe ve İnsan Hakları Vakfı, Maltepe Üniversitesi İnsan Hakları Araştırma ve Uygulama Merkezi, Toplumsal Etik Derneği ve Türkiye Biyoetik Derneği ise projeye iştirakçi olarak katılmıştır. Proje kapsamında “sosyal hizmetler alanında, hizmet alırken ve hizmeti sunarken ortaya çıkan etik sorunların görünür olmasına ve nihaî olarak azalmasına katkı sunmak” amaçlanmaktadır. Bu çerçevede Proje, alan araştırması, sosyal hizmet uzmanlarına yönelik eğitim programı ve sosyal hizmet mesleği etik kodunun yeniden yazılması olarak üç aşamadan oluşmaktadır…

Bu rapor, “Sosyal Hizmetlerde Yanlış Uygulamalar, Etik İhlaller ve Sorunlara İlişkin Bir Araştırma” başlığını taşıyan araştırmanın sonuçlarını içermektedir. Araştırma ekibi, isimleri aşağıda yazılı akademisyen ve sosyal hizmet uzmanlarından oluşmaktadır:

Araştırma, Türkiye’de sosyal hizmetler alanında yolsuzluk, etik ihlâl ve sorunları ele alan, bugüne kadar yapılmış en kapsamlı çalışmadır. Araştırma kapsamında, farklı alanlarda çalışan sosyal hizmet uzmanları, hizmet alanları temsil eden sivil toplum örgütleri ve anahtar kişilerle gerçekleştirilen derinlemesine görüşmelerde, oldukça zengin veri elde edilmiştir. Bu kapsamlı verilerin sistematik hale getirilmesi ve araştırma amaçları çerçevesinde analiz edilmesi oldukça zorlu bir süreç olmuştur. Araştırma verilerinin tamamını rapora aktarmak için azami çaba harcanmıştır. Bu sınırlılık çerçevesinde, elde ettiğimiz veriler, görüşülen kişilerin değerli katkıları, özünü kaybetmeden, bütünlüklü ve mümkün olduğunca kısa bir şekilde aktarılmaya çalışılmıştır. Elimizden geldiğince, hizmet alanlar ve hizmet verenler tarafından “inşa edilen gerçekliği” anlamaya ve anlatmaya çalıştık. Bu konudaki sınırlılığımız, araştırmacıların karşı karşıya kaldıkları temel sınırlılıklardan biri olarak da görülebilir.
Araştırma boyunca “dinleyiciler” olarak bizleri oldukça derinden etkileyen, kimi zaman dehşete kapılmamıza neden olan, öte yandan sosyal hizmet mesleğine ve meslekdaşlarımıza olan inancımızı da perçinleyen pek çok anlatıyla karşılaştık. Araştırmamızda en büyük paya sahip olan katılımcılarımızın her birine, ayırdıkları zaman, paylaştıkları bilgi, deneyim ve sahip oldukları mücadeleci ruh için teşekkür ederiz. Yolsuzluk ve etik ihlâller üzerine konuşmak, etik olanı ve olmayanı tartışmak −belki de günümüzde sosyal hizmetler alanında bir savunma mekanizmasını tetiklediğinden− kolay olmamaktadır. Ancak, başlangıç noktası fark etmek ve tartışmaktır. Bu araştırmanın bu kapsamda sadece ilk adım olduğunu düşünüyor ve bu alandaki sorunların çözümü için bir kıvılcım yaratmasını ümit ediyoruz.

The trend of occurring reality in understanding and practicing corruption is largely dependent upon the mode of its presentation and publicity throughout writing. It is, therefore, essential to look deep into the way that corruption is narrated and revealed in the course of literature. To find the current exhaustive articles, the word ‘corruption’ was typed in the sage database (www.sagepub.com) and five articles were identified that had the word 'corruption' in their titles during period from August to November 2010 (4 months). Out of these five articles, one article entitled Police Corruption: Deviance, Accountability and Reform in Policing, was about the review of several books and lacked the in-depth analysis of the data. Since this article did not serve the purpose of this study, the remaining four articles were reviewed. Only methodological processes of the reviewed articles were taken into account for the purpose of this study.

All four articles published during the period had their ontological standpoints of foundationalism. The research conducted to write these articles were quantitative with descriptive and inferential statistical technique. These techniques provided sufficient information about the relationship between the variables under investigation to enable prediction and control over future outcomes. However, except in an article, to some extent, the methodology dismisses the experiences of the individual as unimportant, which demonstrates and regards human beings as merely reacting and responding to the environment.
In the present context of globalization, every issue is looked at from the lens of capitalist economy and political process. Non-market values such as trust, ethics of care and compassion, a politics of recognition and respect, are not given importance. The grounded reality that the corruption is associated with socio-cultural factors is not given much importance and the differences in terms of time, space, culture and individual are not considered. This masks some vital practices lying in the margin and minority in the form of ideas, emotions and subtle experiences of the people. Thus, this misses subjective dimension of uncovering the truth. As the interaction is based on a particular social setting and the meaning that is shaped in a particular social setting and cultural context has its uniqueness and may not be generalized in another social setting, the present trend of 'only' generalizing the issue and trying to find widely applicable meaning is to be revisited.

This book explores the nexus between foreign aid and corruption in post-conflict settings. It particularly focuses on the experiences of some of the countries that have received foreign aid in order to initiate or accelerate their economic  reconstruction and state building efforts after experiencing a violent conflict during the post-Cold War period.

La contratación administrativa es uno de los ámbitos de mayor riesgo para que se materialicen actos de corrupción, dado que precisamente por medio de los contratos públicos se disponen de fondos públicos para particulares, de allí que sea necesario instaurar mecanismos preventivos en esta área. En las siguientes líneas se desarrollan propuestas como la mejora en el régimen de prohibiciones, inhabilitaciones e incompatibilidades para contratar con el Estado, los sistemas de contratación electrónica, certificaciones éticas para proveedores, inclusión de cláusulas antisoborno y actos de corrupción en los contratos públicos. Necesidad de un observatorio de compras públicas, inclusión de criterios de transparencia, acceso a los datos públicos

y participación ciudadana en contratación administrativa, entre otras iniciativas que se explican de manera detallada en el texto.

Public sector employees receive lower salary than their counterpart in the private sector in Somalia and this creates an environment where government employees are at risk of committing the offence due to low wages, there is some consensus that suggests low wages for civil servant in developing economies can be blamed since employees don’t receive enough salary to live for, studies insisted that the poorly paid civil servant will likely to seek bribes.In this article I will explore Reasons behind Corruption in Somalia, It’s good to increase civil servants salary as a tool to prevent corruption but it will not eliminate corruption unless there are elements of good governance in government.

RESUMEN El presente documento aborda la ética pública como piedra angular para el adecuado desarrollo de la gestión pública y su vinculación con otras figuras escenciales tales como el acceso a la información pública, el Gobierno Abierto, la transparencia, ren-dición de cuentas, participación ciudadana, la innovación colaborativa, la creación de valor público, la lucha contra la corrupción, los objetivos de desarrollo sostenible y finalmente, el derecho al buen gobierno que los engloba, dado que para desarrollar todos éstos aspectos es necesario contar con un marco ético sólido. Luego del desarrollo de este marco teórico conceptual se procede a diagnosticar la si-tuación actual y los avances alcanzados en materia ética en la región latinoamericana en general, en donde se reconoce en primer lugar las dificultades y limitaciones que se posee en la materia, pero también los esfuerzos y acciones implementadas por los países para alcanzar niveles éticos adecuados. Finalmente, como tercer acápite se desarrollan los desafios que en materia ética po-seen las instituciones públicas latinoamericanas y la sociedad en general y que deben ser superados para alcanzar niveles éticos que permitan el fortalecimiento del sistema democrático de la región. ABSTRACT This document speaks about public ethics as a cornerstone for the proper development of public management and its connection with other essential figures such as access to public information, Open Government, transparency, accountability, citizen participation, innovation collaborative, the creation of public value, the fight against corruption, the objectives of sustainable development and finally, the right to good governance that encompasses them, given that to develop all these aspects it is necessary to have a solid ethical framework. After the development of this conceptual, theoretical framework, we proceed to diagnose the current situation and the progress made in ethical matters in the Latin Ame-rican region in general, where the difficulties and limitations that are possessed in the

Države nemaju monopol nad informacijama, pa je utoliko i uloga civilnog društva u monitoringu javnih politika i postizanju strateških ciljeva još važnija. Odlika zemalja u tranziciji je nedostatnost zvanične statistike, nepotpunost podataka koji bi omogućili donošenje odluka zasnovano na dokazima, ali i nepouzdanost zvanično predstavljenih podataka o primjeni javnih politika. Civilno društvo stoga treba da igra svoju korektivnu ulogu u odnosu na nadležne institucije, kako na nacionalnom tako i na regionalnom nivou.

Proces primjene Razvojne strategije Jugoistočna Evropa 2020 (JIE 2020), regionalnog strateškog dokumenta, koji je nastao po uzoru na reformsku agendu Evropske unije (EU) Evropa 2020, pruža okvir za veće uključivanje civilnog društva u procese koji usmjeravaju svekupni društveni i ekonomski razvoj regiona i izgradnju institucija u zemljama, koje se još uvijek nalaze u procesu konsolidacije demokratije. Naročito je “upravljanje usmjereno na rast”, sveprožimajući stub strategije koji se odnosi na unapređenje pružanja javnih usluga, borbu protiv korupcije i reformu pravosuđa, oblast u kojoj organizacije civilnog društva mogu da pruže poseban doprinos. Sama činjenica da su javni zvaničnici izloženi sve izraženijim političkim uslovima od strane EU, koji nerijetko mogu dovesti u opasnost njihove lične karijere i ukazati na korumpiranost institucija, ukazuje na važnost uloge spoljnog, nezavisnog kontrolora, koju civilno društvo može da preuzme.

Za potrebe ove publikacije, koja za cilj ima da pruži smjernice organizacijama civilnog društva za uključivanje u praćenje Upravljanja usmjerenog na rast, monitoring definišemo kao sistematičan način prikupljanja podataka sa ciljem da se ostvari uvid u primjenu javnih politika u odnosu na njihove prethodno postavljene ciljeve i rezultate. Ova definicija odslikava promjenu paradigme kada je u pitanju monitoring javnih politika, tj. promjenu sa nekadašnjeg procesnog monitoringa, fokusiranog prvenstveno na implementaciju određene politike, ka monitoringu orijentisanom na rezultate, kao instrumentu koji omogućava zainteresovanim stranama i donosiocima odluka da prate napredak i uticaj određene politike. Kao takav, monitoring je prirodan uvod u evaluaciju javnih politika, odnosno procjenu učinka određene politike nakon određenog perioda njene primjene.

Corruption is a global phenomenon that causes poverty, obstructs development, and drives away investment. The issue of corruption has gained a prominent place on the global agenda since the mid-1990s with the creation of organizations that can promote models of stemming corruption; especially in developing countries where governmental corruption is widespread. International organizations have adopted conventions with the requirements that their members enact laws prohibiting bribery and extortion.

Na dan 1. 1. 2016. godine, kada je trebalo da bude u potpunosti funkcionalna, Agencija za sprječavanje korupcije zapošljava manje od 50% predviđenog broja službenika, nema adaptirane i opremljene prostorije za rad, niti ispu-njene brojne druge preduslove za nesmetano vršenje zakonom definisanih kompleksnih poslova. Tokom njenog uspostavljanja prekršeno je više za-kona, uključujući zakone o Državnoj revizorskoj instituciji, sprječavanju ko-rupcije, sprječavanju sukoba interesa, uz " potencijal " dodatnog kršenja njih nekoliko. Uz to, kontroverzan izbor direktora i jednog člana Savjeta stavio je upitnik na mogućnost ove insitutucije da bude nezavisno i nepristrasno antikorupcijsko tijelo faktički i prije formalnog početka rada. I drugi koraci u uspostavljanju Agencije izazvali su brojne polemike. Pre-dlog budžeta je utvrđen u minimalnom iznosu koji je definisan Zakonom o sprječavanju korupcije. Direktor je zaobišao zakonsku proceduru i isključio Savjet i Skupštinu iz formulacije nacrta budžeta. Budžetske kategorije su, u najvećoj mjeri, određivane " paušalno " , budući da je prvo utvrđen predlog budžeta na Vladi pa tek onda usvojena sistematizacija i definisan ukupan broj radnih mjesta. Pravilnik o sistematizaciji bitno odstupa od sugestija eksperata Evropske komisije. Zainteresovana javnost nije konsultovana tokom procesa izrade podzako-nskih akata iz nadležnosti Ministarstva pravde, a nisu usvojeni ni svi akti koje je Savjet Agencije bio u obavezi da odobri. Agenciji tek predstoji ozbi-ljan posao u vezi sa izradom automatskog sistema za umrežavanje podataka državnih organa. Od izbora direktora Agencije prisutni su njegovi konstantni pokušaji ograničavanja javnosti rada Savjeta, kao i druge opstrukcije. Izigravanje za-kona, slabi kapaciteti, neažurnost u ispunjavanju administrativnih obave-za, kao i ustaljeni obrasci ponašanja rukovodećeg kadra ne daju previše ohrabrenja da nova Agencija može ispuniti zacrtrane ciljeve. O dredbama Zakona o sprječavanju korupcije 1. januara 2016. go-dine prestale su sa radom Uprava za antikorupcijsku inicijativu i Komisija za sprječavanje sukoba interesa čije je nadležnosti, zaposlene, prava obaveze, predmete i opremu u potpunosti preuzela novonastala Agencija za sprječavanje korupcije. 1 Pored toga, ovim za-konom definisane su i dodatne nadležnosti Agencije: kontrola finansira-nja političkih subjekata i izbornih kampanja, zaštita zviždača i lobiranje. O caso recente de corrupção na maior empresa brasileira, a Petrobras, classificada dentre as maiores empresas globais, uma das maiores empresas de petróleo do mundo e, mais recentemente, classificada como a maior produtora de petróleo dentre as empresas privadas, traz à tona a questão da confiança nas corporações e como elas agem no contexto da sociedade, nas relações ora tácitas, ora explícitas, que estabelecem com outras organizações, outras pessoas e até mesmo com o Estado, estando este último, muitas das vezes, se apresentando como o pivô nas questões de agressão contra a sociedade, ora pela sua conivência, ora pela sua omissão. (The recent case of corruption in Brazil's largest company , Petrobras , ranked among the largest global companies , one of the largest oil companies in the world and most recently ranked as the largest oil producer among private companies , brings up the question confidence in corporations and how they act in the context of society, in either tacit relationships , sometimes explicit , established with other organizations , other people and even with the State , the latter , often , appearing as the pivot in aggression issues against society , sometimes by their connivance , sometimes by their omission).
