Law and the Visual Arts

The topic I will present for the 25th anniversary Studium Conference aims at reflecting on a special type of paintings which were used during the public staging of capital punishment in the late medieval and early modern world. Beyond the usual canons of Art History, I wish to understand how people perceived these objects, interpreted what they see and more importantly, how Art and Law were combined in a particularly compelling way. In those days, judicial practices were highly ritualized acts. From taking animals to court to brutal shaming practices, judicial officers would also perform trials by ordeal. These types of paintings are usually not well-known. The problems these artifacts pose are rarely addressed by Art Historians, because they mainly keep to the description of styles and schools and they rarely question visual dispositives through the approach of affective justice. In my examination of these panels, I wish to arouse a cross-disciplinary conversation on what might comprise an adequate understanding of these tools for “dying well”. These highly ritualistic practices (showing small images in the face of the condemned) would rely on the assumption that the poor foes would accept them because the terror of the spectacle they participated to also held out a promise: do not resist, repent your sins and you will be redeemed in heaven. The underlying assumption of my talk might be something like this: our sense of punishment, both individually and collectively, is made and remade through the visual, and therefore these ritualistic uses of images might appear as participatory (if we accept that through images of martyrdom, criminals could genuinely hope for their redemption), but they were also technologies of control: staged spectacles of justice being seen to be done, in a spectacularly brutal way.

Peggy Guggenheim rühmte sich, 1939 einen Sieg gegen den Direktor der Tate Gallery und gegen das britische Zollgesetz und für die moderne Kunst errungen zu haben. Doch wer sollte an der Grenze entscheiden, was Kunst ist: Zollbeamte oder (selbst konservative) Kunstspezialisten? Eine Frage, die nicht nur zu Beginn des 20. Jahrhunderts aktuell war, sondern auch im 21. Jahrhundert ihre Neuauflage erlebte.

Um das Phänomen institutioneller Selbstzensur in der russischen, vor allem in der Moskauer Kunst- und Ausstellungspraxis fassbar zu machen und zur Diskussion zu stellen, eröffnete der Kurator Andrej Erofeev mit der Ausstellung Verbotene Kunst 2006 (Zapretnoe iskusstvo – 2006) eine ursprünglich auf mehrere Jahre angelegte Reihe. Vom 7. bis 31. März 2007 waren im Moskauer Sacharov-Zentrum Kunstwerke zu sehen, die im Verlauf des Jahres 2006 in Moskauer Galerien und Museen entweder von ihren Direktoren oder den dafür zuständigen internen Kommissionen nicht zur Ausstellung freigegeben worden waren – jedoch nur durch kleine Gucklöcher in den Stellwänden, sodass die Ausstellung zur Peepshow wurde und der Betrachter zum Voyeur. Doch anstatt eine Diskussion über Selbstzensur und den damit einhergehenden vorauseilenden Gehorsam in staatlichen wie privaten Kunstinstitutionen zu eröffnen, endete die Ausstellung mit einem Prozess wegen Erregung nationaler und religiöser Feindschaft­ unter Ausnutzung der beruflichen Position.

Prozesse wie gegen den Regisseur Kirill Serebrennikow sind die jüngste Stufe des Repressionsrevivals in Russland: Erst wollten die Orthodoxen die Kunst kontrollieren, jetzt will der Staat die KünstlerInnen selbst unschädlich machen – mit Methoden aus der Sowjetzeit.
