The thesis provides consideration of one of the sides of the transaction, conducted on the basis of the defect, which is known as a voidable transaction. The thesis provides actually all literary sources concerning this topic, published in Georgian. At that, it reflects the critical opinions available in scientific publications around the norm, regulating the mistake to identity and it as well provides the position of the author. As to Georgian judicial practice, despite the fact that judicial law of the Supreme Court of Georgia is scarce in terms of the mentioned issue, the thesis still provides consideration of the poor practice of our country. The poorness of Georgian judicial law concerning the topic for consideration must not mislead the reader in regards with importance and relevance of the issue. Moreover, I presume the analysis of the problems, discussed in the thesis, shall facilitate to simplification of practical application of Georgian legislation and establishment of uniform judicial practice in this regard.

The party agreement is the most prevalent means for autonomy implementation. Any agreement relies on mutual consent. However, sometimes there are some cases when exterior will does not coincide with the internal readiness or the will of the parties, – caused by various exterior factors and their influence proper. Therefore, this is the vivid example of insufficient will. Based on insufficient will, the agreement designed in such a framework is called a “disputed agreement”. The goal of the article is to consider the mistake relevant to contractors through the historical background and show this freedom, which is inherent to the current law regulating the issue concerned.

People tend to misclassify ambiguous individuals as members of the out-group rather than the in-group. This in-group overexclusion effect (IO effect) is thought to occur because people are motivated to maintain their in-group’s positivity by protecting it from potential out-group intrusions. The present research tested this explanation by asking university students (N = 122) to complete a self-esteem scale and then recall the group memberships of individuals who belonged to minimal groups. Consistent with predictions, participants misassigned significantly fewer individuals to the in-group than to the out-group when the in-group was positive and the out-group was negative but not when these valences were reversed. In addition, self-esteem negatively predicted the IO effect. Alternative explanations of the IO effect are discussed.
