The article, in response to decisions by Russian courts on the invalidity of derivative agreements and in order to prepare regulatory action, attempts to develop a typology of how regulatory action can look like. In order to do so, the article goes through different types of disclosure, namely
- disclosure that is oriented on the purpose of the transaction as typical to be regulatory aims in relation to tourism or consumer credit agreements,
the manners the transaction could potentially develop into
the effect a transaction can have for third parties, with preference in the article being given to disclosure linked to the concrete needs of the counterparty.
The court practice is contrasted against such general approaches and the conclusion taken that it's direction is not clear.

The article is devoted to the legal qualification of buyers’ actions in relation to goods that have not yet been paid for (acquired) under a retail contract. It justifies the illegality of consumption of unpaid goods pursuant to the civil legislation. The results obtained are used to further qualification of consumers’ actions under the Criminal Code of the Russian Federation (Art. 167) and the Code of the Russian Federation on Administrative Offenses (Art. 7.17).
