This book examines the means and context of national implementation of Directive 2016/343, with which the European Union sought to harmonise the procedural guarantees of the accused persons’ right to be present and the presumption of their innocence. The book, which emanates out of an EU-fund- ed comparative research and training project is addressed to both law students, judges, police and practitioners and serves as a casebook, combining detailed studies of specific aspects, a comparative perspective, and a selection of Cypriot and European (CJEU, ECtHR) case law.

Η συμβολή του Ευρωπαϊκού Δικαστηρίου Δικαιωμάτων του Ανθρώπου στην ερμηνεία και εφαρμογή του τεκμηρίου αθωότητας όπως αυτό προστατεύεται από το Άρθρο 6.2 της Ευρωπαϊκής Σύμβασης Δικαιωμάτων του Ανθρώπου είναι αδιαμφισβήτητη. Θεωρούμενο ως δικονομική εγγύηση στο πλαίσιο της ποινικής δίκης, το τεκμήριο της αθωότητας επιβάλει όρους σχετικά κυρίως με το βάρος της απόδειξης, τα δικαστικά και τα νομικά τεκμήρια, τη διατύπωση από τον δικαστή της ουσίας ή κάθε άλλη δημόσια αρχή πρόωρων δηλώσεων ως προς την ενοχή κατηγορούμενου, το δικαίωμα να μην συμβάλει κανείς στην αυτοενοχοποίησή του και τη δημοσιότητα που μπορεί να λάβει η υπόθεση πριν την εκδίκασή της. Παράλληλα, το τεκμήριο αθωότητας ως στοιχείο της προσωπικότητας του ατόμου κατοχυρώνει τον σεβασμό της τιμής και της αξιοπρέπειας του. Σχόλια και δικαστικές κρίσεις μετά την παύση της ποινικής δίωξης ή της αθώωσης του κατηγορουμένου θα προσβάλουν το τεκμήριο αθωότητας εφόσον υποδηλώνουν την ενοχή του. Το τεκμήριο αθωότητας έχει, σχετικά πρόσφατα, εξοπλιστεί με πρόσθετες εγγυήσεις με τη θέσπιση της Οδηγίας 2016/343/ΕΕ «για την ενίσχυση ορισμένων πτυχών του τεκμηρίου αθωότητας και του δικαιώματος παράστασης του κατηγορουμένου στη δίκη του στο πλαίσιο ποινικής διαδικασίας». Σκοπός του παρόντος άρθρου είναι να αναλύσει ή/και να συζητήσει την εφαρμογή του τεκμηρίου αθωότητας στην κυπριακή έννομη τάξη υπό το πρίσμα της Ευρωπαϊκής Σύμβασης Δικαιωμάτων του Ανθρώπου και της ευρωπαϊκής Οδηγίας 2016/343/ΕΕ.
Abstract
The contribution of the European Court of Human Rights in the interpretation and application of the presumption of innocence as protected by Article 6.2 of the European Convention on Human Rights is indisputable. As a procedural guarantee in the context of criminal proceedings the presumption of innocence requires that certain conditions are met mainly in respect of the burden of proof, of legal presumptions of fact and law, of public statements by the trial court or other public officials regarding a defendant’s guilt or innocence before the conclusion of the trial, of the privilege against self-incrimination and of pre-trial publicity. At the same time, the presumption of innocence as an aspect of the personality of the individual safeguards the honour and dignity of the individual. The presumption of innocence will be violated by comments or expressions of judicial opinion suggestive of guilt after an individual’s acquittal of a criminal charge or following the discontinuance of criminal proceedings. The protection of the presumption of innocence has recently been reinforced with additional guarantees following the enactment of Directive EU/2016/343 “on the strengthening of certain aspects of the presumption of innocence and of the right to be present at the trial in criminal proceedings”. The aim of this article is to analyze and/or discuss the application of the presumption of innocence in the Cypriot legal order in light of the European Convention on Human Rights and the European Directive (EU) 2016/343.
