Car, outre les relations que la commune entretenait avec l'Eglise, les rapports entre popolo et magnats et les divisions au sein même du popolo sont les lignes de force au long desquelles s'est élaborée la stratégie — on devrait dire plutôt les stratégies – et s'est construite la répression en matière somptuaire. Qu'apporte à l'analyse ce volume particulier ? La soi-disant « Prammatica del vestire » de 1343 porte mal son nom 1 , car le terme de « prammatica » a ultérieurement désigné des recueils de mesures mis à la disposition des employés communaux chargés de les appliquer — il s'agit, en l'occurrence, de celles qui combattaient les écarts somptuaires. Une nouvelle compilation mettait hors d'usage la précédente et en causait généralement la perte ou l'oubli 2. Avant les années 1350, les lois somptuaires et la consignation de leurs applications sont dispersées entre des fonds variés, et aucun recueil d'envergure n'a survécu — si l'on excepte celui qui figure dans les statuts communaux de 1322-1325 —, aucun en tout cas qui ait été préparé pour les employés de la ville occupés à traquer quotidiennement les infractions. Notre registre ne relève pas de la catégorie des « pragmatiques ». Pour en comprendre l'intérêt et les limites, on rappellera brièvement les modalités de la lutte contre les excès vestimentaires et festifs au XIV e siècle. Dans la plupart des grandes communes du Centre Nord italien, les premières législations somptuaires ne se singularisent que dans la seconde moitié, voire le derniers tiers du XIII e siècle 3. A Florence même, les premiers indices d'un contrôle communal des dépenses excessives remontent à 1281. Ce contrôle fait écho aux incitations à la modération émanant, l'année précédente, du légat pontifical, le cardinal Latino. En 1281, les citoyens florentins semblent avoir surtout cherché à brider le faste des funérailles et c'est après 1290 que le terrain de l'enquête se fait plus solide 4. Un débat des instances communales montre que sont alors concernées les infractions vestimentaires proprement féminines – celles-là mêmes qui, un demi siècle plus tard, seront principalement touchées par le registre de 1343. Les délibérations dont il est resté trace auraient pris dans leur mire les femmes qui porteraient des vêtements contrevenant aux lois de la modestie 5. Sumptuary laws, the legislative measures of the Roman republic and early imperial era, were aiming to restrain extreme and extravagant expenditure via limiting the amount of money spent on feasts, games, funerals, weddings and other social events. Not much interest is shown in sumptuary laws: contemporary jurisprudence regards it as a limitation of property, a minority of authors deem these laws the results of a social legislation, whereas earlier secondary works put a stress on their historic impact. As a first step in the detailed research of the topic of sumptuary laws, this paper intends to give an outline of the actual content of these laws, in a chronological order. Such a primary source-based analyses could serve as the first step towards a better understanding of the Roman concept of limitation of property.

The study analyses two bundles of official documents from the Moravian Provincial Archive in Brno and the Provincial Archive in Opava that emerged in the connection with the Verordnung über die Einfuhr fremder Industrie- Erzeugniße decree issued by Empress Maria Theresa in 1749. Because the law prohibited the application of gilding to works of art in sacral buildings, the state authorities were often in the position of having to make decisions on the many applications submitted by parishes, church dignitaries, and laypersons to be granted an exemption. In this process they frequently had to resolve aesthetic and ethical questions and problems that in the church sphere only became more pertinent later on, in the 1780s, during the Enlightenment reforms of Emperor Joseph II. The requests for exemptions reveal that the gilding on works of art in sacral buildings was regarded as a quality in its own right that was difficult to separate, for example, from the value and quality of the artistic work. As well as such aesthetic categories as honour and respect, the applicants also assigned key importance to the universal aesthetic and ethical order and formal unity of a work, qualities associated with harmony and the sublime, two other aesthetic categories typical of the late 17th and early 18th centuries. It is also, however, possible to newly find in sources from the middle of the 18th century concepts that were emerging from modern empirical philosophy and art criticism and to observe a transformation of the existing system of values, including a new understanding of the concept of luxury and its economic value. The archive sources indicate the continuation of the early modern perception of the value of a work of art within the context of a universal symbolic order, but they also reveal early signs of the Enlightenment’s ‘disenchantment of the world’ and of the shift where the old way of trying to understand the world’s mysteries, the creation, and God’s wisdom on the basis of analogy and similarity was replaced with a modern approach of studying and comparing differences and distinctions between things on the basis of empirical knowledge.

Durante las últimas décadas, desde los estudios culturales se han venido haciendo propuestas teórico-metodológicas en torno al surgimiento y el desarrollo de las leyes sobre el vestido así como la regulación suntuaria, dada su importancia en la escritura e interpretación de los discursos sobre nuestro pasado más reciente.
