You may be going through this major life change yourself, or maybe you have a friend or family member going through divorce or separation. Well-intended family and friends often tell stories about what happened to someone they know who lost everything in their divorce, or the nightmare it was going to Court. Unfortunately, most of the time their information is wrong, and you go through unnecessary stress, anxiety and worry. This book will give you the "real goods" on many questions you have about family law, divorce and separation, and the unique issues teachers face. It is not designed to cover every specific topic, and some of these principles may not apply to your particular situation. Instead, it is designed to give you a fair overview of the issues you are likely to see.

THE LAW
Am I Legally Separated?
Many people mistakenly think that they need to file some document with the Court to be separated. This is not true. There is nothing formal you need to do.
You are legally separated when you or your partner decide to break up, and there is no chance of getting back together. You need to be living separate and apart
(no, this does not mean you are necessarily living in separate homes).
This separation date matters in family law.
Why is the Separation Date Important?
For equalization and common law trust claims the assets and debts are valued on the date of separation. This is why this date is so important.
Are we Living Separate and Apart in the Same Home?
Possibly, yes. Many couples cannot afford two separate homes while they figure out the financial terms of their separation. Other couples don’t want to live in temporary apartments during this time. Multiple moves are expensive and stressful, and it is hard on the kids.
