What Is the Byzantine Pineapple?
INTRODUCTION
How Did This Text Come into Existence?
T HIS TEXT IS the tenth revision of what was originally a fictional legal story created out of frustration to the legal challenges mounted against the (ironically named) Affordable Care Act (ACA) or Obamacare in the USA. The author is of the opinion that the legal argument approach to challenging ACA was completely misguided. The opinion of the author is that the individual mandate should have been challenged on the grounds that it creates an existence tax
and that the framers of both the Declaration of Independence and the US Constitution would consider the imposition of any existence tax to be in direct violation of the concept of unalienable Rights to life, liberty, and the pursuit of happiness.
The author wrote revision 1. Upon reading the first draft, the author realized areas that are legal argument flawed
based on existing Supreme Court rulings and that these issues needed to be addressed in the second revision. After creating the second revision, the author read the text and realized that this revision again had areas that are legal argument flawed
based on existing Supreme Court rulings and that these issues needed to be addressed in the third revision. After writing and reading the third revision and coming to the same conclusion again, the author woke up from "The Matrix" and realized that there is no legal argument for independence that cannot be overruled by prior US Supreme Court rulings. In essence, the system is rigged against independence. The system is rigged against freedom of life, liberty, and the pursuit of happiness.
The system is rigged by the existence of hundreds of thousands of arcane rules and laws and regulations that are impossible for any citizen to know, yet any single one of these hundreds of thousands of arcane rules and laws and regulations can selectively be used to prosecute and persecute a citizen who falls out of favor with the state. These hundreds of thousands of arcane rules and laws and regulations comprise a Byzantine construct.
This Byzantine construct of hundreds of thousands of arcane rules and laws and regulations all end up taking capital from the citizens via taxation, fees, etc., and the capital is redistributed to those who have government influence and friends. Those on the inside eat the fruit of the Byzantine pineapple.
The solution, then, became one of following the laws of nature. In nature, there is constant change and evolution. It is time to evolve the systems of governance. The existing Byzantine pineapple system needs to evolve to the new system—a new system without a Byzantine pineapple construct.
The trick is envisioning and creating an evolution of the existing system so that the new system replaces the Byzantine pineapple system with a simpler socioeconomic legal political (SELP) system that treats citizens in a more equitable manner.
