Everytext.com Rental Agreement and Policies.

  • Rental Agreement Parties and Jurisdiction
  • This Rental User Agreement is considered to be a contract between you and Everytext.com, LLC. By placing an order you agree to the terms and conditions of this agreement, our privacy policy, our terms of use, and any other documents incorporated into the website. You agree that this User Agreement is legally binding between you and Everytext.com, LLC. Everytext.com, LLC may modify this agreement from time to time. Any modification shall be effective upon posting on the website. You agree to be bound to any changes to this agreement when you use the website or the service after the change is posted. This agreement is a subset of our more comprehensive User Agreement. The following agreement, any legal disputes and all matters of arbitration are subject to the Laws of the State of California, County of Santa Clara.

  • Rental periods and shipping options
  • You may rent books for 60, 90 or 120 days or you can choose your own due date (Custom Due Date)
  • Once you add the book to your basket to rent, you can see the actual due date by which the package must be postmarked.

  • Shipping is FREE both ways. When it is time to return your rental book, we will send you a prepaid return shipping label. Simply print that label and use it to send the book(s) back to us. However, you can choose a faster shipping option during checkout (Expedited Shipping) for an additional shipping fee.

  • You must package every book you return carefully. Use a sturdy box for heavier books and padded envelopes for lighter/smaller books. Failure to pack books properly when returning may cause damage to the book(s) or they can get lost in the mail.

  • All rental orders are shipped out through USPS standard/expedited mail with a tracking number. Once you place your order, you will be given a tracking number via email and the tracking number will appear on your account menu under the "Rental Order Details" page.

  • Book condition and care.
  • The condition of our rental books vary. Some of our books are brand new and some previously rented books are in a very good condition. You may write/highlight in the book; but out of consideration to your fellow students, please do not highlight/write excessively and to the point where readability is affected.

  • Rental books may or may not include all ancillaries as issued by the publisher (CD's, DVD's, Online Access Codes, etc). You may use these ancillaries but they must be returned along with the book once your rental period is over. Please note that ACCESS CODES are almost never available with rental books. If you must have the access code present in the book, do not rent it.

  • Problems with your order.
  • If you do not receive your rental book(s) within 7-10 business days, we will investigate the matter and if the book is lost in the mail or is otherwise undeliverable, we will resend you another copy or cancel the order as per your instructions. However, if your book was not delivered to you because of an incorrect address, we may charge you a small shipping fee to resend the book(s) to you. Such a shipping fee would be anywhere between $3.00 - $10.00 (depending on the size of the rental order).

  • If you have damaged the book in any way or if the book is lost, we will charge your credit card for the price of a used copy of that book. This "buyout price" is determined at the time of such an incident and is nominally higher that the rental price already paid by you. On the other hand, you can also choose to buy the book at the end of the rental period. For a price quote, please email us at support@everytext.com.

  • You can extend your rental due date to any date you wish. Simply visit the rental order details page and click on the 'Extend Due Date' button. There is a nominal charge to extend your order which is shown when you pick your new due date. The link to extend your rental order is also sent to you via email before your order is due back.

  • We understand that you may drop the class or simply change your mind about renting books and choose to buy instead. If you want to cancel the order after you have placed it, you need to email us immediately at support@everytext.com and let us know the Rental Order Number. Once the book(s) have been shipped out, you have 21 days to return them for a full refund less shipping charges of $3.99.

  • Returning the rental book(s)
  • Once your rental book(s) become due, you will be sent a prepaid USPS Media Mail return shipping label. You can also print this label by logging into your account and clicking on the rental order details link in the account menu.

  • Please use USPS Media Mail only to return your books using your own packaging material or the packaging material in which the book was originally delivered to you. You cannot use USPS priority mail packaging to send the book(s) back. Doing so will cost us extra shipping fee which we may deduct from your credit card once we receive the book(s) back.

  • Do not send any book(s) back to the return address from where it originally came from. Only use the prepaid return shipping label provided to you once your book(s) become due. If you need to return the book(s) before the due date, please contact us at support@everytext.com. Books that are sent to an address other than the address given on the return label will be deemed lost and we will charge your card the full purchase price of such book(s).

  • If the rental books are not returned or put in the mail by the due date, we will assume that you are keeping the book(s) and charge your credit card for the full purchase price of the book(s). If the credit card we have on file is declined for such charges, we will forward the account to a collections agency for further recovery. All accounts sent to collections will be assessed further charges (minimum collections charge is $25.00). You will be notified via email/phone of all such actions. Also ,once your account has been forwarded to collections, you will not be able to return the book since at that point the book is assumed to be sold to you.

  • You are solely responsible for returning all rental book(s) to Everytext.com. We are not responsible for lost, damaged or stolen books. If the book is not postmarked by the due date, your credit/debit card on file will be charged for the full purchase price of the book.

  • Action(s) Taken For Non-Returned Rental Books
  • We will make every effort to inform you of your due date (via email and/or phone) to ensure you are able to return the rental book on time. If you are not able to return the book by the due date, you can simply extend your rental order by choosing a new due date on the rental order details page or get help by emailing/calling our customer support team.

    However, if you do not return the rental book on time and do not extend your order, we may take one or more of the following actions to recover our property and/or funds.

    • Charge a late fee of $25.00 from the credit card we have on file once the book is 3 days past due.

    • Charge the full purchase price of the textbook from the credit card we have on file. You will be notified of any such charges beforehand with an opportunity to return the book.

    • If the attempt to charge the above purchase price is unsuccessful, or is disputed later; we may send the account to a collections agency. Any such actions will result in higher charges (due to fees levied by the collections agency). Furthermore, the collections agency will call you to advise you of your payment options. Any collections initiated against you may also be reported to various credit bureaus which can damage your credit ratings etc.

    • At our discretion, we may choose to initiate legal action in a Small Claims Court in the County of Santa Clara, California. You will be notified of such a legal action before we initiate it at our end and you will be given an opportunity to return the book before any legal action is commenced to recover our property/funds.
