19 using Microsoft Word. A very important rule in Law is that an unrebutted affidavit stands as truth. An
20 affidavit is a signed declaration wherein the ‘affiant’ (one making the declaration of facts or events)
21 has that declaration Notarized. The Notary is an agent of the court and can attest to you ‘swearing’ it’s
22 true. Once your Notice (in this case “Contempt of Court”) is sent to the court although not notarized,
23 you have a pre-existing agreement with them, and you give them a reasonable amount of time to
24 respond say 21 days or ? as your time constraints allow, and they don’t respond it goes to default and
25 it becomes the truth. So a time limit has to be set. Once the fail to respond and they always do. Then
26 send in the default.
