    EHS OFFENCES PENALTY MATRIX

    Non-compliance or non-conformance with EHS Requirements stated (refer Ready Reckoner


    A and Ready Reckoner B) or implied shall be treated as offence. Contractor, its staff and
    workers will be penalized for each offence as per the EHS PENALTY MATRIX given below:

    Penalty shall be imposed to individual as well as contracting company as per the conditions
    stipulated in the matrix. However, the amount of penalty accrued shall be deducted from
    the payment due to the contracting company. If offence is repeated in spite of the penalty,
    Contractor shall be disbanded based on the recommendation of Project Head or corporate
    EHS Head.

    1 Failure to provide ID Card to workers Rs. 200/- per person
    2 Failure to provide requisite amenities in the Labour Rs. 5,000/- per amenity
    Camp.
    4 Smoking in the construction zone and/or working under Rs. 500/- per violation
    influence of alcohol/prohibited drugs.
    5 Burning of waste or smouldering of combustible Rs. 500/-
    materials on site without written permission.
    6 Failure to wear Personal Protective Equipment (PPE) or Rs. 500/- per individual if PPE
    its improper use. supplied but not worn by personal;
    Rs. 1,000/- per individual if PPE not
    provided by the contractor
    7 Working without EHS Induction Rs. 500/- per personal and working
    day to be dismissed
    8 Not attending EHS Meetings or any other EHS Rs. 1,000/- per individual
    Programme/Function
    9 Failure to Implement TATA Housings EHS Documents Rs. 10,000/- each instance
    (EHS Plan, Work Method Statement, Emergency Plan)
    10 Failure to submit report on incident , Rs. 5,000/- each instance
    accidents and near misses with in the
    stipulated time
    11 Failure to comply with infringement notice Rs. 2,000/- each instance
    12 Misuse/damage to property/equipment/ infrastructure Rs. 1,000/-; in addition contractor to
    pay for the cost of items damaged
    13 Unsafe work (act/condition) not covered otherwise Rs. 2,000/-; & immediate
    rectification
    14 Poor Housekeeping and stacking of materials Rs. 2,000/- & cessation of work till
    satisfactory rectification
    15 Obstruction of passageways, entrances, doorways, stairs, Rs. 2,000/- & immediate rectification
    access to Fire Fighting Equipment etc.
    16 Use of equipment without Inspection tag or its Rs. 1,000/-& immediate rectification
    unauthorized use and alterations
    17 Use of damaged or uncertified lifting tackles Rs. 2,000/- & confiscation of such
    items
    18 Unsafe lifting method Rs. 2,000/- & cessation of work till
    satisfactory rectification

    19 Failure to provide for and use unsafe working platforms, Rs. 2,000/-& cessation of work till
    means of access to the work place, where work is satisfactory rectification
    required to be carried out beyond a persons normal

    31 Failure to comply with an order (written or otherwise) Rs.10,000/-

    32 Threatening EHS personnel, misbehaving, fighting or Rs. 10,000/- and


    intentionally causing harm to any person Personal to be banned from the site
    and a report will be made to the

    33 Failure to deploy competent EHS Personnel in adequate Rs. 10,000/- per incidence
    number (ref. EHSP-01 & 02 : EHS Requirement Ready
    Reckoner)
    34 Lost Time Injury as a result of negligence as established Rs. 25,000/- each incidence
    by Accident Investigation Report
    35 Fatality Rs. 100,000/- each case
    36 Environmental incidence ( major spillage/persistent high Rs, 25,000/- each incidence
    noise/unabated dust in work environment)
    37 Failure to constitute and run Safety Committee or non- Rs. 25,000/-
    representation of workers in the committee
    38 Failure to constitute Emergency Response Team Rs. 25,000/-
    39 Use of Mobile Phone in any form while on work Rs. 500/- per person per incidence
