Reflection Points:
(1) What new insights about legal profession did you get from Justice Caguioa’s talk? Did
it confirm/negate your initial ideas/assumptions about lawyers and the legal profession?
How?

I learned that some of the fundamental values that lawyers must have are patience, dedication
and the passion to continue on with the legal profession and even the study of law. The thing
that struck me the most from Justice Caguioa’s speech is how he and his team of lawyers kept on
emphasizing the phrase “plod on”. A line that symbolizes how important it is to just keep going
at it and continue growing and living the life of a lawyer.

(2) Justice Caguioa said: “If we must sin, let it be out of weakness and not out of
wickedness.” What are the external and internal influences that can weaken a lawyer’s
resolve to abide by his/her morals and principles?

I think external influences come primarily from the people that some lawyers work with. It is
important that the people that we work with also possess the same values that we want to live
with. Thus, if the people who we work with are bad, then most likely, the things we do and the
the goals we accomplish are also bad and come from a place of wickedness.

Internal influences come from the self – what are the things that we think is right and just for
lawyers to do? This come from the values that have shaped us in the life that we have lived in
and the experiences that we have.

(3) Reflect on the readings for Part 3 of the syllabus (see gdrive) within the context of
havrutah case study no. 3.

The basic principles and the rule of law must always be upheld in every step of the way in the
path towards justice. I believe that the the government must see to it that due process must
always be exercised and manifested.

Case Study #1 Questions:


(1) What are your thoughts on Atty. X’s behavior? Justice Y’s behavior?

I think that Atty X’s behavior was very off-putting and extravagant. Being a partner of a big law
firm, I think that it is because of the perspectives and the outlooks that were given to him by
coming from a big law firm had made that kind of behavior. Or, it could even be otherwise, that

it is because of X’s behavior that got him into the position that he has now. For Justice Y, he was
very quiet and very accepting of the gifts that were given to him by X. All the praise he accepted
and eve commented that he liked Atty X’s speech the best.

(2) What ethical questions and issues, if any, arise in this case?

I think the most prominent ethical issue would be that the spending and the showing off of Atty
X’s extravagant life and financial capability.

(3) What internal and external influences are at work in this situation?

The people that he has been with and the peer pressure coming off of the environment. For
internal influences, the thinking and the values of X himself/herself.

Case Study #2 Questions:


(1) What are your thoughts on Atty. K’s behavior? Judge J’s behavior?

I think Atty K’s behavior was very Filipino and was very thoughtful. Judge J’s behavior was kind
and very humble.

(2) What ethical questions and issues, if any, arise in this case?

I think the ethical question in place is that the chocolates might become an issue of
professionalism between Atty K and Judge J being that they work together in forming the said
syllabi.

(3) What Filipino cultural traits are at work in this situation?

The trait of thoughtfulness and pasalubong. These are very Filipino family values that are at work
in even instances outside of the home.

Case Study #3 Questions:


(1) Comment on the arrest of Atty. L and the statement of the IBP.

I think the arrest of Atty L was not founded because it is only the job of the lawyer to protect his
clients and see to it that the due process is employed in every case and in every step of the way.
The arrest of Atty L was a malpractice of the police and should not have happened, especially
because the ground given was not even proven and not even meritorious. As for the statement
of the IBP, the IBP was right in the statement that it was indeed against the rule of law.
