    AFFIDAVIT

    I, Torcuato Avila Jr., of legal age, Filipino citizen and a resident of Brgy.
    Makinhas, Baybay, Leyte, after having been duly sworn in accordance with law hereby
    depose and state:

    1. That Virginia Dumaguing Mortgaged Lots 11285 and 11296 to us for the
    amount of One Hundred Thirty Thousand (Php 130,000.00) Pesos
    sometimes on Jan. 20, 1996;

    2. That during the effectivity of the Mortgaged I was receiving the share of
    Viginia Dumaguing on the proceeds of the Lots every harvest season;

    3. That on the year 1996 to 2010, we were the one receiving the share of
    Virginia Dumaguing of the proceeds of the lots every harvest.

    4. That after the death of Francisco Carta, his heir Danilo Carta replaced him
    as tenant of the Lots;

    5. That I fully understand the contents of this affidavit and that I freely and
    voluntarily execute this affidavit;

    6. As such, I execute this affidavit in truth for whatever legal purpose it may
    serve.

    IN WITNESS WHEREOF, I have hereunto set my hands this 24th of July 2019
    in MacArthur Leyte, Philippines.
