ORDER:

In the G.O. 1st read above, certain guidelines were issued for laying of
Optical Fibre Cables along State properties with a proviso in Para 5(e) that the
agency shall restore the road or the road margin which has been dug, to its
original quality and to the satisfaction of the ENC (R&B), ENC (PR), Principal
Chief Conservator of Forests, as the case may be, by the Service Providers at
their costs. An amendment was issued to clause 5(e) of the G.O.Ms.No.5, F&P
(Plg.IT&C) Dept., dated 11.02.2000, vide G.O.Ms.No.45, ITE&C Department,
dated 17.10.2001, in which it was stated that if the Service Provider under takes
road cutting in any Urban and Rural areas, the Service Provider shall pay the
road cutting charges prescribed by the department concerned or in the event
no such charges are fixed, they shall restore the road or the road margin, which
has been dug, to its original quality at their own cost and to the satisfaction of
the department concerned.

2. The Chief Secretary, Government of A.P. conducted a meeting on


03.07.2014 and 08.07.2014 regarding 4G communication expansion. During the
meeting, it was decided to follow the provisions enumerated in G.O.Ms.No.5,
Finance and Planning (Plg.IT&C) Dept. dt: 11.02.2000 and it was reiterated that
wherever the Service Provider lays the cables, the first option should be given to
him to restore the road to its original level at his cost and to the satisfaction of
the concerned department. The connectivity to all nooks and corners of the
state in terms of 4G extension is the priority area for the State Government. To
facilitate the same both in terms of laying of cables as well as setting up of
towers and to sort out any issues with the Service Providers, the Commissioner –
MA&UD (for Municipal areas) and the Commissioner - PR (Panchayat areas) are
appointed as nodal officers.

3. In the Govt., Memo 4th read above, the CDMA and Commissioner, PR had
been requested to examine and send a report for taking necessary action in the
matter.

4. The CDMA and Commissioner, PR, after conducting a meeting on laying


of Optical Fibre Cables along road / road margins for 4G system expansion in
the State of A.P. with the ENC (PR), ENC (R&B) and ENC (PH), submitted
proposals suggesting terms and conditions with charges and requested the
Government to issue necessary orders in the matter.

5. The Government after careful examination of the matter and keeping in


view the proposal submitted by the CDMA for laying optical Fibre Cables along
road / road margins in Urban and Rural areas in the State of A.P., for 4G System
expansion, hereby issue the following terms and conditions to the Service
Providers as follows :

a) The Service Providers shall have to restore the road cut portions
themselves in the entire Urban and Rural areas subject to condition
that the following securities be kept by way of Bank guarantees with
the departments concerned for the prescribed period of one year
and also to be responsible for restoration of road to the original
profile in accordance with the prescribed specifications / conditions.

b) The Service Provider shall restore the road to the original profile to
the satisfaction of the Quality Control Engineer of the department
concerned and the Third Party Quality Assurance Agency deployed
by the department concerned. If the Service Provider fails to do the
work as per the specifications and to the satisfaction of the
concerned Engineer/Quality Assurance Agency or damages the
utilities and does not restore the same, the above Performance Bank
Guarantee shall be invoked by the Government Departments /
Local Bodies concerned for making good of the damages / defects
in restoration.

c) If the Service Provider resorts to open trench cut method and desires
that the restoration of road in the Urban and Rural areas shall be
done by the department, he shall be liable to pay the following
charges :

1. CC Roads - Rs.1569/- Rmt


2. BT Roads - Rs.1998/- Rmt
3. Footpath - Rs.670/- Rmt

d) The above charges are exclusive of VAT and labour cess. These
charges are applicable to 2013-14 year only and are subject to
revision every year according to the SSR. Further to avoid
complications, the restoration work should be carried out entirely i.e.,
in each department either by the Service Provider or by the
department concerned, as the case may be.

e) The Service Provider shall not be permitted to take up partial


restoration and ask the department concern to do the remaining job
on payment.
