    SUBJECT : COORDINATION WITH THE ASSIGNED PROSECUTOR IN


    FILING OF CASES OF PD 705 AND SENDING OF LETTER/
    NOTICE TO THE COURT WHERE THE CASE IS FILED

    This is in relation to PENRO memoranda dated May 11, 2021 and January 26,
    2022 which the fundamental purpose of the same is to actively provide legal assistance
    to CENRO’s of this province. This office observes that respondent/owner of
    apprehended conveyance loaded with illegal forest products files motion to release
    before the court where the case is pending and secure an order for release while our
    summary administrative confiscation proceeding is still ongoing. The said circumstance
    affects the conduct of the summary administrative confiscation proceedings. To prevent
    the same, the following must be taken:

    1. Upon apprehension by DENR apprehending officer or PNP personnel, the


    assigned Legal Assistant must be directed by CENROs to coordinate with the assigned
    prosecutor for purposes of monitoring the criminal case until it is recommended for filing
    before an appropriate trial court.

    2. When the case is already filed before an appropriate court, a letter addressed
    to the Office of the Clerk of Court where the case is filed be sent informing that a
    summary administrative confiscation proceeding is already initiated; and

    3. After the summary administrative confiscation proceeding, the court must be


    provided with the result of the confiscation proceedings.

    The afore mentioned acts will help to inform the court of our on-going
    administrative confiscation/forfeiture proceeding on the apprehended conveyance and
    would also result to non-issuance of a release order in favor of the owner/respondent of
    the conveyance.

    Anent to this, you are directed to cause the implementation of the above-cited
    items and to strictly monitor the filing of criminal case of PD 705 thru your assigned
    Legal Assistant.
