MEMORANDUM
Please be informed that the team on October 11, 2022, were invited by
the complainant to attend a hearing at the Brgy. Hall of barangay Alubijid
and was appreciated by the barangay captain Ricky A. Awa. During the
hearing the team explained its main participation about the incident which
is to verify the veracity of the complaint. The actual visit on the ground was
postponed and re-scheduled on October 18, 2022, as it was agreed by the
complainant and the team.

FINDINGS:
Based on the investigation, the team finds that the cut trees are all
natural grown and the perpetrators did not secure license from Department
of Environment and Natural Resources CENRO-Nasipit prior to the cutting
of the said trees. Hence, they violated Section 77, of Presidential Decree 705
as amended. Cutting, Gathering and/or collecting Timber, or Other Forest
Products Without License. – Any person who shall cut, gather, collect,
removed timber or other forest products from any forest land, or timber from
alienable or disposable public land, or from private land, without any
authority, or possess timber or other forest products without the legal
documents as required under existing forest laws and regulations, shall be
punished with the penalties imposed under Articles 309 and 310 of the
Revised Penal Code. Hence, the team recommends for the filing of a case
particularly violation of Section 77, Presidential Decree 705, as amended, for
cutting natural grown trees without license obtained from Community
Environment Natural Resources office of the Municipality of Nasipit.
