SUBJECT : ALLEGED ILLEGAL CUTTING OF TREES LOCATED AT


BRGY. ALUBIJID , BUTUAN CITY

DATE : October 19, 2022

In compliance to the instruction of Deputy CENRO/DMO III Sidney G.


Kalinawan, in relation to the complaint of Mr. Carlos T. Javelosa Sr
(administrator) personally lodged by him before the office of CENRO Nasipit
on October 6, 2022, approximately at 10:00 in the morning, regarding on
the alleged cutting of natural grown trees committed at the private property
registered under the name of Rodolfo P. Maquiling, located at Brgy. Alubijid,
Butuan City.

Please be informed that the team on October 11, 2022, were invited by
the complainant to attend a hearing at the Brgy. Hall of barangay Alubijid
and was appreciated by the barangay captain Ricky A. Awa. During the
hearing the team explained its main participation about the incident which
is to verify the veracity of the complaint. The actual visit on the ground was
postponed and re-scheduled on October 18, 2022, as it was agreed by the
complainant and the team.

ACTION TAKEN:

1. A courtesy call made by the team to Mr. Carlos T. Javelosa Sr.


(administrator)
2. Coordinated with Brgy. Captain. Ricky A. Awa of Barangay Alubijid,
Butuan City

FINDINGS:

1. That the team immediately conducted investigation on the reported


alleged illegal cutting of trees together with Mr. Benjamen L. Labador
(caretaker of the private property), a resident of Purok 2, Brgy.
Alubijid, Butuan City. Upon arrival at the area, the team witnessed
the stumps and some remains of natural grown species of trees
(Tugas, Ilang-Ilang, Bakan).
2. That according to the complainant the lumber of the cut trees were
used by one of the perpetrators certain Edgar to fix his house.
3. That Mr. Benjamin Labador pinpointed the boundaries of the private
property and determined that the illegally cut trees were inside the
property of Rodolfo P. Maquiling administered by Mr. Carlos T.
Javelosa Sr.
4. That the complainant Mr. Carlos T. Javelosa Sr (administrator)
informed the team that the perpetrators namely Saturnino Malig-on,
Arman Gamil and Edgar were conspiring and confederating to cut the
trees and did not ask his consent, and without permit from DENR,
which caused him to file a complaint before the office of barangay
Alubijid, against the wrongdoers.
5. That the complainant informed the team that he would be the one to
file a complaint relative to the violation of Presidential Decree 705,
section 77 as amended, otherwise known as Forestry Code of the
Philippines, if warranted by sufficient evidence after the investigation
and the hearing conducted by the concerned Barangay.
RECOMMENDATION:

Based on the investigation, the team finds that the cut trees are all
natural grown and the perpetrators did not secure license from Department
of Environment and Natural Resources CENRO-Nasipit prior to the cutting
of the said trees. Hence, they violated Section 77, of Presidential Decree 705
as amended. Cutting, Gathering and/or collecting Timber, or Other Forest
Products Without License. – Any person who shall cut, gather, collect,
removed timber or other forest products from any forest land, or timber from
alienable or disposable public land, or from private land, without any
authority, or possess timber or other forest products without the legal
documents as required under existing forest laws and regulations, shall be
punished with the penalties imposed under Articles 309 and 310 of the
Revised Penal Code. Hence, the team recommends for the filing of a case
particularly violation of Section 77, Presidential Decree 705, as amended, for
cutting natural grown trees without license obtained from Community
Environment Natural Resources office of the Municipality of Nasipit.
