HDB Materity Leave & Benefit Policy
(1) This policy may be called the HDB Maternity Leave and Benefit Policy.
(2) It extends to the all HDB Employees with effect from 01-April-2017.
2. Objective –
(1) To regulate the employment women in the organization for certain period of leave / benefit before and
after the child birth, mis-carriage and termination.
(2) Provide the Maternity Benefit from the ESI for insured women in the organization under ESI Act.
(3) Ensure that the organization meets all obligations as mandated by the statutes of the states.
3. Applicability –
This policy applicable to women those are in Permanent, Probationer and Trainees.
(1) Any woman employed in an organization and entitled to maternity benefit under the provisions of this
policy may give notice / intimation in writing in such form as may be prescribed, to immediate Reporting
Manager / Regional HR.
(2) On receipt of the notice, the Reporting Manager / Regional HR shall permit such woman to absent
herself from the establishment during the period for which she receives the Maternity benefit after the
approval from Central HR Team.
(1) If a woman exempted from ESI, actually worked in the Company for a not less than Eighty-Days in the
twelve months immediately preceding the date of her expected delivery.
(2) For Insured Woman under the ESI, shall be qualified to claim maternity benefits for a confinement
occurring or expected to occur in a benefit Seventy Days in the immediately preceding two consecutive
contribution periods.
(1) The maximum period for which any woman shall be entitled to maternity benefit shall be Twenty-Six
Weeks (182 Days) of which not more than Eight Weeks (56 Days) shall precede the date of her
expected delivery.
(2) “Commissioning Mother“means a biological mother who uses her egg to create an embryo implanted
in any other woman.
(3) A woman who legally adopts a child below the age of three months or a commissioning mother shall be
entitled to maternity benefit for a period of Twelve Weeks (84 Days) from the date the child is handed
over to the adopting mother or commissioning mother, as case may be.
7. Classifications of women disease covered under Maternity Benefit and Leave with Wages –
(1) Miscarriage or Medical Termination – on production of such proofs, entitled to leave for period of Six
Weeks (42 Days) immediately following the day of her miscarriage.
(2) Tubectcomy Operation – In case of Tubectomy operation, a woman shall, on production of such proofs
as may be prescribed, be entitled for leave for period of Two Weeks immediately following the day of
her tubectomy operation.
Further provided that, Insured Women (IW) covered under the ESI Act, Maternity Benefit / Claims will be
settled by ESI Branch Office on production of proofs as case may be.
If a woman entitled to maternity benefit or any other amount, dies before receiving such maternity benefit or
amount, the Company shall pay such benefit or amount to the person nominated by the woman in the notice
given and in case there is no such nominee, to her legal representative.
If a woman works in the Company after she has been permitted by her Reporting Manager / Regional HR to
absent herself under the rule 4 (2) for any period during such authorized absence, she shall forfeit her claim
to the Maternity benefit for such period.
(1) The maternity benefit amount (the salary) will be paid to a female employees exempted from ESI as
regular process.
(2) The maternity benefit amount (the salary) to an insured female employees covered under the ESI Act,
shall be paid from ESI Corporation / ESI Branch officer as per the provision of the ESI act. Insured
female employees shall visit to nearest ESI branch office along with the required documents for availing
ESI maternity claim benefit.
The application should be supported by a medical certificate confirming the pregnancy and expected
date of child birth.
The applicant can avail Eight Weeks i.e. (52 Days) maternity leave before the date of the expected
delivery and Eighteen-Week i.e (126 Days) maternity leave for post natal-care (after delivery).
The weekly offs, and holidays falling during this period will be part of the leaves availed.
