Whereas, the High Court of Gujarat intends to invite offers through the
eProcurement Portal for Supply, Installation, Testing, Commissioning &
Maintenance of Part-A: 2U Rack Servers, Part-B: Network Attached Storage,
Part-C: 20 KVA Online UPSs, Part-D: Gigabit Managed Network Switch, Part-E:
KVM Switches, Part-F: Firewall, Part-G: WAN Routers and Part-H: Development
Servers, for the High Court of Gujarat; this Request for Proposal (RFP) document
is published for e-tendering process, as follows:
1. Items, Quantity and Technical Specifications:
a. Items, quantity and Technical Specifications are given below:
i. Part-A: 2 Nos. of 2U Rack Servers of the specifications as given in
Annexure-T1 of this RFP.
ii. Part-B: 1 No. of Network Attached Storage (NAS) of the
specifications as given in Annexure-T2 of this RFP.
iii. Part-C: 2 Nos. of 20 KVA Online UPS of the specifications as given
in Annexure-T3 of this RFP
iv. Part-D: 1 No. of Gigabit Managed Network Switch of the
specifications as given in Annexure-T4 of this RFP
v. Part-E: 2 Nos. of ATEN 8 port USB/PS2 KVM Switch with all
necessary accessories with 3 / 5 Years onsite Warranty.
vi. Part-F: 1 No. of Firewall of the specifications as given in
Annexure-T5 of this RFP
vii. Part-G: 2 Nos. of CISCO C1-CISCO4331/K9 or equivalent CISCO
WAN Routers with all necessary accessories with 3 / 5 Years onsite
Warranty.
viii. Part-H: 4 Nos. of Development Servers of the specifications as
given in Annexure-T6 of this RFP
b. OEM published Specifications Datasheet shall have to be submitted for
each offered make & model with seal and signature of the Bidder.

c. The quantity may vary at the time of actual issuance of purchase order.
During the validity of Bid, High Court of Gujarat can place purchase
order for above items of more or less quantity at the finalised rates
under this Tender, hence the successful Bidder will have to accept
purchase order during the validity of Bid period.
d. The Bidder may quote for either Part-A or Part-B or Part-C or Part-D or
Part-E or Part-F or Part-G or Part-H or more or all the Parts. The Bidder
can offer more than one make & model for each or any of the Parts for
each of the warranty and technical specification options. Purchase
Order for each Part will be issued separately.
e. The High Court may place a Repeat Purchase Order of quantity, not
more than 50% of total quantity given in the Purchase Order, for either
a Part or Parts or all, within the period of 6 months from the date of
Purchase Order at the finalised rate.
2. Eligibility Criteria of the Bidder:
a. Bidder shall be a registered firm/company in India under the relevant
rules/regulations.
b. The Bidder must have one office in Ahmedabad/Gandhinagar and copy
of any two documents i.e. Property Tax Bill/Electricity Bill/Telephone
Bill/VAT/CST Registration/Lease Agreement should be submitted in
support of the same.
c. The Bidder must be actively involved in supply of Computers and /or
Servers and / or ICT hardware for at least three continuous years prior
to the publication of this RFP, as authorised distributor / dealer / seller
/ reseller of Computers / Servers / ICT hardware with OEM
authorisation certificate in this behalf, to be submitted.
d. The Bidder must bid with an OEM authorisation certificate specifically
for this RFP.
e. The Bidder must have a total sum of turnover of Rs.30 Crore (minimum
total for all three years taken together) in the three financial years i.e.
2020-2021, 2021-2022 and 2022-2023; and turnover of the financial

year 2022-2023, should be at least Rs.10 crores. The copies of Audited
Annual Accounts for these three financial years, with certification of the
Chartered Accountant shall be submitted along with the Bid as per
Proforma P1.
f. The product being offered by the Bidder must be of a reputed OEM
company having authorised service centres at major cities of Gujarat
State; supported by an authenticated list of service centres situated
across the State of Gujarat.
g. Bidders, who wish to participate in this Bid, will have to submit all
Financial and Technical bids, online on eprocurement portal
(https://tender.nprocure.com/) and there shall be no submission of
Financial/Commercial Bids in hard copy.
3. Earnest Money Deposit (EMD):
a. The Bidder will have to submit Earnest Money Deposit (EMD) in a
separate cover while submitting physical Technical Bid Document and
Bidder Eligibility Documents, as follows, specifying therein as “EMD for
Part- ____ of the Tender No. ITC/RFP/06/2023”:
i. Rs.1,20,000/- (Rupees One Lakh Twenty Thousand Only) for
Part-A,
ii. Rs.30,000/- (Rupees Thirty Thousand Only) for Part-B,
iii. Rs.30,000/- (Rupees Thirty Thousand Only) for Part-C,
iv. Rs.15,000/- (Rupees Fifteen Thousand Only) for Part-D,
v. Rs.6,000/- (Rupees Six Thousand Only) for Part-E,
vi. Rs.75,000/- (Rupees Seventy Five Thousand Only) for Part-F,
vii. Rs.18,000/- (Rupees Eighteen Thousand Only) for Part-G,
viii. Rs.36,000/- (Rupees Thirty Six Thousand Only) for Part-H.
b. EMD shall be submitted in the form of Demand Draft (D.D.) or in the
form of an unconditional Bank Guarantee (B.G.) (which should be valid
for 3 months from the last date of online Bid submission for this RFP)

of any Nationalised Bank including Public Sector Bank or Private
Sector Banks or Banks (operating in India having branch at
Ahmedabad/Gandhinagar) as applicable vide Government Resolutions
/ instruction issued by the Finance Department from time to time. The
D.D. / B.G. should be in the name of “Registrar, High Court of Gujarat"
payable at Ahmedabad. The proforma of EMD in case of Bank
Guarantee is attached herewith at Proforma P2.
c. Failing to submit EMD while submitting physical Technical Bid
Document and Bidder Eligibility Documents, shall lead to rejection of
the Bid.
d. Unsuccessful / disqualified Bidder’s EMD will be returned without any
interest as promptly as possible, but not later than 15 days after the
expiry of the period of Bid validity OR upon the successful Bidder
signing the Contract and furnishing the Performance Bank Guarantee
@ 5% of the total order value, whichever is earlier.
e. In exceptional circumstances, the High Court of Gujarat may solicit the
Bidder’s consent to an extension of the period of validity of the EMD.
The request thereof and the responses thereto shall be in writing. A
Bidder may refuse the request without forfeiting its EMD. A Bidder
agreeing to the request will not be permitted to modify the submitted
Bid.
f. EMD of successful Bidder of concerned Part will be returned without
any interest upon the Bidder signing the Contract and furnishing the
unconditional Performance Bank Guarantee @ 5% of the total order
value.
g. EMD may be forfeited:
i. If the Bidder withdraws its Bid during the period of Bid validity.
ii. In case of a successful Bidder of concerned Part, if the Bidder fails:
1. To sign the Contract as required by this RFP within the
stipulated time limit mentioned in this RFP / Purchase
Order and / or

2. To furnish unconditional Performance Bank Guarantee as
required in this RFP / Purchase Order and / or
3. To submit the copy of purchase order with acceptance
thereof within 3 days of receipt of the Purchase Order and /
or
4. If the Bidder is found to be involved in fraudulent practices.
h. The High Court of Gujarat also reserves the right to blacklist such
Bidder(s) whose EMD has been forfeited as above, from participating in
future tenders if sufficient cause exists.
4. Tender Timelines:
a. This tender RFP has been made available on the High Court website at
https://gujarathighcourt.nic.in/tenders from 8.00 pm of 26/12/2023.
Bid Document download from eProcurement Portal would start from
the afternoon of 27/12/2023 on eprocurement portal
(https://tender.nprocure.com/).
b. Online submission of financial and technical bids on eprocurement
portal (https://tender.nprocure.com/) will be accepted till 10:00 PM on
14/01/2024. There shall be no submission of financial bids in hard
copy.
c. The Bidders shall submit EMD, technical bid documents and bidder
eligibility documents, duly signed and sealed, in hard copy (except the
financial Bid), at 12 noon on 15/01/2024 i.e. next working day of the
closure of timelines for submission of online Bids on the eprocurement
portal, at the office of the IT Cell of the High Court of Gujarat before
team of authorised officers of the IT Cell. Bidders and/or their
representatives authorised as mentioned at Annexure-A1 shall have to
remain present on that date and time with EMD, technical bid
document and bidder eligibility documents, duly signed and sealed, in
hard copy (except the financial Bid) at the IT Cell of the High Court. No
Bid cover will be accepted through any messenger / delivery person in

absence of the authorised representative. All these documents (not the
financial/commercial Bid) shall be opened at that time and an
acknowledgement in the prescribed proforma shall be given to the
Bidders by the team of officers and also countersigned by the Registrar
(SCMS & ICT). The eligibility criteria and technical evaluation shall be
undertaken based on these physically submitted documents only.
d. Bids shall be valid for 60 days from the date of submission of the Bid.
A Bid valid for a shorter period shall be rejected as non‐responsive. The
Bid validity may be extended for a further period from the date of expiry
of Bid validity in consultation with the successful Bidder(s). Any delay
caused by the Bidder in resolving any queries raised during Technical
Evaluation will be considered as extension of validity of the Bid.
e. If required, the High Court of Gujarat may modify the Last date and
time of submission of online Bid by prior notice to be published on the
eprocurement portal and also official website & Telegram Channel of
the High Court.
5. Evaluation & Negotiation:
a. Evaluation:
i. Evaluation of the EMD, technical bid documents and bidder
eligibility documents that are physically submitted, will be carried
out by a Team of the High Court and thereafter Financial Bids
submitted online as per Proforma P3 by the bidders who have
qualified in evaluation of EMD, technical bid documents and
bidder eligibility documents, will be opened.
ii. For arriving at L1 Bidder for any particular warranty option, the
quoted price for a particular Part will be compared with the other
quotes received for that particular warranty option only. In case of
only a single quote received, it would not be necessary to compare
such quote with any other quote to decide the L1 bidder. The High

Court may choose any warranty option and/or technical
specification option while selecting the final successful Bidder.
iii. The products shall be shortlisted also considering the OEMs' brand
image, their service support, reputation and experience of the High
Court with OEMs in such hardware performance & quality.
iv. For the purpose of technical evaluation, a demo/test unit of the
exact product offered will have to be submitted by the successful
Bidder within 7 days from the date of request made.
b. Negotiation:
i. The price offers (financial/commercial Bids) that would be
submitted by the bidders on the eprocurement portal, shall be
preliminary offers while the High Court reserves its right to
negotiate with all technically qualified bidders; so as to achieve the
best possible competitive rates of the offered products.
ii. The method of negotiation for the same would be as given in the
document ‘Method of Negotiation before the Hon’ble Committee of

iii. The L1 Bidder shall be decided upon the final accepted rate to be
finalised during the negotiation with all the qualified Bidders. The
Committee may also opt for selection of more than one Bidder as
successful Bidders with mixed quantities / vendor / OEM /
warranty / technical specifications options etc.
iv. The Bidder who has quoted less than the L1 Bidder during the
negotiation of the concerned Part, but could not succeed, shall be
informed about the reasons concerning the particular Bidder only.
v. After Negotiation, if L1 Bidder of concerned Part fails to comply
with the terms & conditions of timelines and/or other formalities

to be carried out as per this RFP, the High Court of Gujarat
reserves the right to take up further evaluation/negotiation
process as mentioned above to decide the lowest Bidder from the
remaining Bidders and also negotiate to get L1 or better price for
concerned Part.
vi. For the purpose of ascertaining the best price possible for the
products being procured, if and as required, the High Court of
Gujarat may resort to the process of price discovery of the
products in the open market while also keeping in consideration
the requirements of this RFP.
vii. At the end of the aforesaid exercise, the High Court reserves the
rights to select the best suitable product.
6. Inspection and Sample Testing:
a. The High Court of Gujarat, if required, will select at least 1 sample unit
for testing purposes for the item quoted by the successful bidder of the
particular Part. The successful bidder may also have to offer the
inspection of the sample, as may be selected by the High Court, at
EQDC, Gandhinagar or in the manner as decided by High Court of
Gujarat before/after delivering at the customer site. The cost of the
same has to be borne by the successful Bidder. Any deviation found in
the specification of the produced goods or delivered goods after
inspection from the tender specifications will lead to the cancellation of
the order, forfeiture of EMD/PBG and prohibition from participation in
the future purchase of the High Court of Gujarat.
b. The High Court of Gujarat will not be responsible for any delay which
may arise due to any deviation from the technical specifications bid,
found at the time of inspection. The successful bidder(s) has to supply,
install, test and commission the ordered goods within the prescribed
time limit.
c. During the validity of tender, if bidder will offer OR request High Court
of Gujarat to accept higher model for product instead of quoted model,
due to technical reasons, i.e. EOL of quoted model etc., then High

Court of Gujarat will also test the new higher model to be offered at the
same quoted price.
d. All the charges, if any, to carry out testing shall be borne by the
successful bidder(s). Selection of the sample(s) shall be done by the
High Court technical inspection team as per the standard norms and
procedure.
e. The High Court’s right to inspect, test and, where necessary, reject the
Goods after the Goods arrival at customer site shall in no way be
limited or waived by reason of the Goods having previously been
inspected, tested and passed by the High Court of Gujarat or its
representative.
f. In case the bidder fails to submit a demo/test unit of the exact offered
product within 7 days from the date of request made, the next L1
bidder will be considered for further process as mentioned in this RFP.
g. Whether the offered product was tested or not as a demo/test unit
during the evaluation or before delivery, before making the final
payment, it shall be ensured that the delivered products have been
tested for compliance to all the technical specifications, including any
performance parameters therein, during the installation and testing
process.
7. Delivery, Installation, Testing & Commission:
a. Delivery, Installation, Testing and Commission of the product shall
have to be done as expeditiously as possible not later than 45 days
from the date of issuance of purchase order.
b. The location for Delivery, Installation, Testing and Commission of the
products will be at the High Court of Gujarat.
c. Successful bidder has to paste a non-removable sticker on the item(s)
with details of Tender No., bidder’s Name, address, contact details,
service centre/help line number and warranty expiry date, as may be
finalised by the High Court at the time of delivery and installation of the
item.

d. Copy of delivery challan and installation certificate shall be submitted
by the successful Bidder within 7-10 days of delivery, installation,
testing and commissioning with counter signing of the authorised
Court Officer(s).
e. The Successful Bidder shall replace the damaged / broken item(s), if
found during the delivery, installation and testing, with new item(s).
f. Any deviation found in the specifications of the delivered goods from
the tender specifications, will lead to cancellation of the order, forfeiture
of EMD/PBG and prohibition from participation in any future
procurement process of the High Court of Gujarat.
8. Payment Terms:
a. Upon successful delivery, installation, testing and commissioning of
item(s) with compliance of all requirements as per this RFP, full
payment, as per the Purchase Order, shall be made
9. Penalty Clause for Delays, Termination etc.:
a. Penalty Clause for delay in delivery, installation, testing and
commissioning:
i. If the successful Bidder fails to deliver, install, test or
commission all the items as per this RFP and Purchase Order
within 45 days from the date of issuance of the purchase order
or any extension given by the High Court, then a late delivery
penalty of sum equivalent to one percent (1%) of the total order
value shall be charged and deducted from Billed amount or
Performance Bank Guarantee for each calendar week of delay or
part thereof.
ii. Delay in excess of four weeks, after the given delivery timeline,
will be sufficient cause for termination of the contract by the
High Court. In that case, the Performance Bank Guarantee of
the successful Bidder will be forfeited.
iii. In case, if the successful Bidder of any Part does not supply,
install, test and commission the ordered item(s) for any reason

within the prescribed time; such Bidder will be liable to pay the
difference amount to the High Court, over and above the
Performance Bank Guarantee; which the High Court of Gujarat
has to pay to the next or other selected Bidder for the purpose of
supply, installation, testing and commissioning of item(s).
b. Termination for Default
i. The High Court of Gujarat may, without prejudice to any other
remedy for breach of contract, by written Notice of default sent
to the successful Bidder of a period of 30 days; terminate the
Contract in whole or part,
1. If the successful Bidder fails to deliver, install, test and
commission any or all items within 45 days from the
date of issuance of purchase order, or within any
extension thereof granted by the High Court of Gujarat
or within delay of 4 weeks there from with late delivery
penalty.
2. If the successful Bidder(s) fails to submit a report of
delivery and installation of any or all the supplied items
within 7-10 days of its delivery.
3. If the successful Bidder(s) fails to perform any
obligation(s) under the Contract/Purchase order.
4. If the successful Bidder(s), in the judgement of the High
Court of Gujarat, has engaged in corrupt or fraudulent
practices in competing for or in executing the Contract.
ii. For the purpose of this clause:
1. “Corrupt practice” means the offering, giving, receiving or
soliciting of any thing of value or influencing the action of a
public official in the procurement process or in contract
execution.
2. “Fraudulent practice” means a misrepresentation of facts in
order to influence a procurement process or the execution of

a contract to the detriment of the purchaser, and includes
collusive practice among Bidders (prior to or after Bid
submission) designed to establish Bid prices at artificial
non‐competitive levels and to deprive the purchaser of the
benefits of free and open competition.
iii. In the event of High Court of Gujarat terminating the Contract in
whole or in part, for default of the successful Bidder(s), under
this clause; the High Court of Gujarat may procure, upon such
terms and in such manner as it deems appropriate, item(s)
similar to those undelivered and the Bidder shall be liable to the
High Court of Gujarat for any excess costs for supply,
installation, commissioning and testing of such similar items.
However, the Bidder shall continue the performance of the
Contract to the extent that is not terminated.
10. Warranty & Maintenance Support:
a. Comprehensive onsite warranty and support by the successful
Bidder(s), directly with back to back spare parts support of the OEM or
by / through the OEM, for the item(s) for full term of the warranty
period as mentioned in the respective Purchase Order, shall have to be
efficiently and promptly provided.
b. The onsite warranty support will be at the High Court of Gujarat where
the product would be used.
c. The successful bidder(s) is required to produce OEM’s confirmation on
OEM letterhead with Sr. Nos. of product(s) supplied for back to back
warranty support as mentioned in the Purchase Order as specified in
this RFP.
d. If any equipment gives recurring trouble for more than 3 times within
one month, excluding time period taken for repair, during the warranty
period or does not work at all as required, the successful Bidder(s) shall
replace the same, with new equipment having the same or higher
configuration without any additional cost to the High Court of Gujarat.

e. In case, during the warranty period, if the defective item is not available
in the market, the successful Bidder(s) will have to supply a higher
version as replacement with prior approval of the High Court of
Gujarat, without any additional cost.
f. Maintenance service: Free onsite preventive maintenance services on
quarterly / half yearly basis shall be provided by the successful Bidder
during the period of warranty.
g. In case, the successful Bidder(s) does not provide satisfactory support
& causes unwarranted delay in providing warranty and maintenance
support, the High Court of Gujarat reserves the right to
repair/maintain the equipment at the risk & cost of the successful
Bidder(s).
h. During the warranty period, if the complaint is not resolved within the
initial 3 working days of making the complaint, the following penalty
will be imposed for each day of delay, which will be recovered from
Performance Bank Guarantee submitted by the successful Bidder(s).

1. Fault with any part of the item causing issues in working of the
item will be considered for levying the penalty.
2. While the complaint is in the process of being resolved, if during
the aforesaid penalty durations, similar or higher configuration

working item is provided for use against the faulty item, the
penalty will not be levied for the duration during which such
substituted working item was provided.
11. Security Deposit / Performance Bank Guarantee (PBG):
a. The successful Bidder has to submit unconditional Performance Bank
Guarantee (Proforma P5) of any Nationalised Bank including Public
Sector Bank or Private Sector Banks or Banks (operating in India
having branch at Ahmedabad/Gandhinagar) as per applicable
Government Resolution / instructions issued by the Finance
Department from time to time @ 5% of total order value within 7 days
from the date of issuance of Purchase order with validity of the
warranty period with additional 3 months.
b. In any case, the successful Bidder is required to maintain Performance
Bank Guarantee @ 5% of the total order value throughout the period of
comprehensive onsite warranty. In case of any penalty claimed from the
submitted Performance Bank Guarantee during the warranty period,
the successful Bidder(s) is required to submit the additional
unconditional Performance Bank Guarantee of the amount equal to the
penalty claimed for the duration up to the validity of original
Performance Bank Guarantee.
c. Successful Bidder(s) will have to sign the contract within 7 days after
receiving the Purchase Order.
12. Other terms & conditions:
a. Prospective Bidders should not approach the High Court or its Officers
in person or in writing, for any technical query or request for change in
technical specifications. No request for any change in the technical
specifications will be entertained or responded to.
b. Prospective Bidders are specifically directed NOT to make or cause to
make any contact with any Officer/Staff of the High Court for meeting
or discussions to influence the procurement process or its outcome.

Any such unauthorised / unofficial contact shall cause for immediate
disqualification / debarment of the Prospective Bidder.
c. The Bidder should not have been blacklisted / banned / declared
ineligible / declared having dissatisfactory performance by any
Government / Quasi-Government Authority in India. The Bidder
should declare this in writing along with the Bid.
d. The Bidder is expected to examine all instructions, forms,
specifications, terms and conditions of this RFP. The Bid must be
precise, complete and in the prescribed format as per the requirement
of this RFP. Failure to furnish all information as required in this RFP or
submission of a Bid not responsive to this RFP in every respect, will be
at the Bidder’s risk and may result in rejection of the Bid.
e. Bidders are required to mention the exact and full Make & Model of the
product/s offered in Proforma P4 itself with supporting documents of
OEM published specifications data sheet for each of the offered make &
model with seal and signature of the Bidder.
f. The Bid shall be non‐transferable.
g. Incomplete Bids will be treated as non‐responsive and will be rejected.
h. “End of Life” or “End of Sale” items should not be quoted. Make &
Model quoted by the Bidder should be available till the Bid validity,
duly supported for spares / OEM support during the offered warranty
period.
i. The Bidder shall bear all the costs associated with the preparation and
submission of the Bid, and the High Court of Gujarat, in no case, will
be responsible or liable for these costs, regardless of outcome of
Bidding process.
j. The Bidder has to submit the compliance letter on the letterhead duly
signed by the authorised signatory along with other supporting
documents as per Proforma-P6. Failing to submit the same or
non‐compliance/deviation from any terms and conditions, eligibility
criteria or technical specifications, may result in rejection of the Bid.

k. Amendments/Corrigendum:
i. At any time, prior to the last date of online submission of Bids, the
High Court of Gujarat may, for any reason, modify the RFP.
ii. In order to allow prospective Bidders reasonable time to take into
consideration the amendments while preparing their Bids, the
High Court of Gujarat, at its discretion, may extend the last date
and time for the online submission of Bids.
l. Once submitted, no Bid will be allowed to be modified.
m. Prices shall be quoted in Indian Rupees only.
n. Price shall be inclusive of all freight, forwarding, transit insurance and
installation charges. Prices shall be inclusive of excise duties. The unit
Price without GST and with GST and the Rate of applicable GST shall
have to be specifically mentioned in the respective column of Financial
Bid.
o. In case successful Bidder(s) is found in breach of any condition(s) of
Bid or Purchase Order/Contract, at any stage during the course of
supply, install, commission, testing and maintenance or warranty
period, legal action as per rules/laws, shall be initiated against the
Bidder and the EMD/PBG shall be forfeited, besides debarring and
blacklisting the Bidder for the time period as decided by the High Court
of Gujarat, for further dealings with the High Court of Gujarat and
District Courts in the State of Gujarat. Such debarment/blacklisting
shall also be communicated to the State Government.
p. The High Court of Gujarat reserves the right to accept or reject any Bid,
to annul the Bidding process and reject all Bids at any time prior to
awarding the Contract, without any obligation to inform the affected
Bidder(s) of the grounds for such decision and without thereby,
incurring any liability to the affected Bidder(s).
q. The High Court of Gujarat reserves its right to reject any proposal,
modify or scrap the whole tender at any time without assigning any
reason or incurring any liability.

r. Whether a particular annexure/proforma has been referred to
hereinabove or not, all the annexures/proforma as given hereinbelow
will have to be submitted duly filled and signed by the authorised
signatories with requisite authentication/execution/attestation etc. as
applicable/written therein. Also that, if a certain document/ certificate/
undertaking/letter etc. is not mentioned in the annexures/proforma
hereinbelow but have been referred to in this RFP for being submitted
by the Bidder, the same will have to be submitted accordingly.
s. The successful Bidder(s) will not be allowed to reassign/subcontract
the Purchase Order issued. Any such act will render the EMD/PBG
forfeited and make the contract liable to be cancelled.
t. Wherever the term ‘working days’ is mentioned in this RFP, the same
would mean the working days as per the calendar of the High Court
published on the official website.
13. Force Majeure:
a. Force Majeure shall mean and be limited to the following:
i. War / hostilities
ii. Riot or Civil commotion
iii. Earthquake, flood, tempest, lightening or other natural physical
disaster.
iv. Restrictions imposed by the Government or other statutory bodies
which prevents or delays the execution of the order by the
successful Bidder(s).
b. The successful Bidder(s) shall advise the High Court of Gujarat by a
registered letter duly certified by the local statutory authorities, the
beginning and end of the above causes of delay within seven (7) days of
the occurrence and cessation of such Force Majeure conditions. In the
event of delay lasting over two months, if arising out of causes of Force
Majeure, the High Court of Gujarat reserves the right to cancel the
order.

c. Completion period may be extended due to circumstances relating to
Force Majeure by the High Court of Gujarat. Successful Bidder(s) shall
not claim any further extension for completion of work. The High Court
of Gujarat shall not be liable to pay extra costs under any conditions.
d. The successful Bidder(s) shall categorically specify the extent of Force
Majeure conditions prevalent in their works at the time of submitting
their Bid and whether the same has been taken into consideration or
not in their Quotes.
e. In the event of any Force Majeure cause, the successful Bidder(s) shall
not be liable for delays in performing their obligations under this order
and the delivery dates can be extended for the successful Bidder(s)
without being subject to Penalty for delayed delivery, as stated
elsewhere.
f. It will be the prerogative of the High Court of Gujarat to take the
decision on Force Majeure conditions and the decision of the High court
of Gujarat will be binding to the Bidder.
