Your Agreement with Maxis comprises the General Terms and Conditions ("GTC"), Service Specific Terms &
Conditions (“SSTC”), this STC, Maxis Fair Usage Policy, policies and procedures related to a particular Service,
Registration Form and any addendum(s) (“Agreement”). GTC, SSTC, this STC and Maxis Fair Usage Policy are all
located on our official website at www.maxis.com.my/terms-conditions/personal/.
This Summary highlights some of the important terms of the Agreement only. When you purchase and use the
Maxis Service(s), the Agreement in its entirety (and not just this Summary) applies to you. Please read and
understand the contents of the Agreement in its entirety. Terms used in this Summary will have the same meaning
as defined in the GTC. In the event of any inconsistency or conflict between the Summary and the GTC, the GTC
will prevail.
You confirm and agree and give your consent to Maxis to process your Personal Information/ Personal Data
pursuant to Personal Data Protection Act 2010 and Maxis Group Privacy Notice
at https://www.maxis.com.my/privacy-statement/. Call us at 1800 82 1123 or +603-74922123 or call 123 (if you are an
existing customer) or e-mail us at customercare@maxis.com.my if you need a copy or should you have any queries
in relation to Maxis Group Privacy Notice.
You must:
comply with all applicable laws of Malaysia and instructions issued by us from time to time;
i. to send spam, unsolicited messages (including SMS' and emails), and messages against
public interest;
iii. for fraudulent, unlawful, illegal and improper purpose such as gambling, vice, porn,
infringement of intellectual property rights, publishing any defamatory or abusive material;
iv. for any activity which is likely to cause Network congestion; and
v. in contravention of any usage policies which may be stipulated by Maxis from time to time.
The Service(s) we supply, our liability and what you can expect of us:
Our Service(s) may not be available everywhere. Please check Our Network coverage area on our official website
at https://www.maxis.com.my/en/broadband/maxis-fibre/#fibre-checker for Maxis Fibre. Whilst we will make every
attempt to provide a fault free service, the Service(s) are not fault free from Matters Beyond Our Reasonable
Control. We are not liable to you or any other party, in contract, tort (including negligence), or otherwise for any
loss or damage that you may suffer in connection with the Service(s).
Request for a change of Service plan is based on our approval and at your cost.
We may suspend or terminate your Service(s) in a number of circumstances, including but not limited to where you
breach Our Agreement, late payment, Network related issues (including emergencies), or use the Service(s) for
improper or illegal purposes or for damaging our Network. If the Service(s) is/are suspended or terminated, you
must still pay all outstanding Charges and charges for Service(s) reconnection.
We may from time to time make any changes to our terms and conditions of the Agreement, including revising the
Charges.
What we can do in relation to the Mobile Device(s) under our Mobile Device ownership or Mobile Device leasing
programme:
We may block the device in the event you are suspected or found to be committed of fraud, you report to us that
the relevant device is missing or has been stolen and requested us to block the device. We may incrementally or
progressively suspend and/or block the Services and/or usage of the relevant Mobile Device if you default in the
payment of the Charges.
Complaints:
We appreciate any feedback about our Service(s), and are committed to resolving problems or complaints quickly.

You acknowledge that you have been provided with and have read and understood the Agreement in its entirety,
and you agree to the terms and conditions of the Agreement.
Service Specific Terms & Conditions
("SSTC") - Maxis Postpaid (Pre-15th August 2023)

General
1. Maxis Postpaid (“Plan(s)”):Comprises of Maxis Postpaid 98, 108, 128, 158, 188, 248 and 368 plans.
3. If you change your current rate plan to the new Maxis Postpaid, you will not be able to carry forward any
promotions/benefits that you are currently enjoying under your existing rate plan to your new Maxis Postpaid
subscribed to.
4. The use of the Plan(s) and Service(s) is subject to the General Terms & Conditions (“GTC”) at
https://www.maxis.com.my/en/terms-conditions/general/maxis-consumer/, Service Specific Terms &
Conditions (“SSTC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all
at maxis.com.my/terms-conditions/personal/.
5. Capitalised terms herein have the same meaning as defined in the GTC.
6. Any conflict or inconsistency between this SSTC, the GTC and Summary Terms and Conditions (“STC”), shall
be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
7. We reserve the rights without liability, to revise this SSTC, Plan(s) and our pricing. Where reasonably
practicable, we will give you reasonable advance notice of such changes and all previous versions of our user
guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on
the Plan(s) and Service(s) at maxis.com.my/tnc, including changes to the Agreement. If you do not accept such
revisions/changes, you are required to terminate the Plan and/or the use of the Services under the Plan in
accordance with this SSTC by giving us notice within 28 days from the Effective Date failing which you are
assumed to have accepted the changes. Save where terminated based on the foregoing, any continued use
of the Service(s), and/or the Plan (after the Effective Date of any revision/change to the terms and conditions
of the Agreement, Services, and/or Plan) shall constitute unconditional acceptance by you of such
revisions/changes and you shall be bound by the same.
Eligibility
8. You are ineligible for this Plan(s) if you owe us any payments.
9. This Plan(s) is inapplicable to you if you are a commercial user and/or bulk subscriber.
Charges
10. The Plan(s)’ structure together with the pricing, rate and allocation of data, voice and SMS are stated in the
appended Appendix and also published on our official website at https://www.maxis.com.my/mobile-plans/,
as updated by us from time to time. Charges published are exclusive of all applicable taxes.
11. A deposit of RM300 for Maxis Postpaid 98, 108, 128, 158 or 188 is chargeable to non-Malaysians subscribing
for the Plan(s) (“Deposit”).
12. Non-payment of bill of any one of the Plan(s) and Service package may result in suspension or barring of all
the Services until the outstanding amount is paid.
13. You acknowledge and accept, for the voice and SMS' allocated with the Plan(s), the unlimited voice minutes
and SMS' apply to:
a. domestic mobile/fixed ON-net & OFF-net usage for Maxis Postpaid 98, 108, 128, 158, 188, 248 and
368(excluding, video calls, calls to numbers with special charges e.g. 1-300/1-700/600, 121, TM100,
1MOCC & 080-prefix numbers for border calls to Brunei);
b. standard person-to-person calls or texts and not for any commercial and/ or non-personal usage; and
c. non multiple simultaneous calling, re-supply, call centre usage, telemarketing, bulk messaging,
application-to-person communication, continuously call forwarding, auto-dialing, machine-to-machine
communication (including by using your SIM card in any other devices), Cellular Trunking Units (CTUs), or
any other activity we consider to be non-standard usage.
Things we may do to the Service(s)
14. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend,
restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your
usage:
a. shows excessive usage or placing unusual burdens on our Network;
b. is for unlawful activities or for suspected fraudulent activities;
c. is not in accordance with the Maxis Fair Usage Policy (at maxis.com.my/FUP); or
d. is for commercial/non-personal purposes.
15. For data allocated with the Plan(s), you acknowledge and accept:
a. You will experience data browsing at reduced speeds and with no EXCESS charges if any usage exceeds
the allocated mobile internet;
b. The mobile internet package allocated within the Plan(s) is exclusively for domestic usage only;
c. You may purchase one-time passes to add more data. Such upgrade is available through your UMB,
Maxis app, Maxis Online Account or WAP menu and accessible through your Mobile Phone or other
available Devices or channels as we may inform you from time to time. Please refer to the attached
Appendix for Data Booster passes and/or Experiential passes;
d. You can opt for upgrades or downgrades of the Plan(s) at any Maxis stores or call our Contact Centres
(123) from your mobile; and
e. If you upgrade or downgrade your existing Plan(s) to another Plan(s), your monthly fee will be pro-rated
against your billing cycle date. You will be charged the full monthly fee from the second month onwards
but with full mobile internet package allocation from the first month.
Roaming
16. The price and rates outlined in the Plan(s) structure do not account for usages while on an overseas roaming
network. Whilst roaming overseas, the prevailing data roaming charges
at https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/
Termination
17. Subject to our GTC, a principal line holder may at any time terminate the Plan(s) as follows:
a. By calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;
b. By walking into our Maxis Centres listed on www.maxis.com.my; or
c. By writing in to customercare@maxis.com.my

be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.

reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions
of our user guides or leaflets will be superseded. You accept you are responsible for regularly reviewing
information on the Maxis Postpaid Plan(s) and Service(s) at maxis.com.my/tnc, including changes to the
Agreement. If you do not accept such revisions/changes, you are required to terminate the Maxis Postpaid
Plan(s) and/or the use of the Services(s) under the Maxis Postpaid Plan(s) in accordance with this SSTC by
giving us notice within fifteen (15) working days from the Effective Date, failing which you are assumed to have
accepted the changes. Save where terminated based on the foregoing, any continued use of the Service(s),
and/or the Maxis Postpaid Plan(s) (after the Effective Date of any revision/change to the terms and conditions
of the Agreement, Services, and/or Maxis Postpaid Plan(s)) shall constitute unconditional acceptance by you of
such revisions/changes and you shall be bound by the same.
Eligibility
7. You are ineligible to subscribe for Maxis Postpaid Plan(s) if you owe us any payments.
8. Maxis Postpaid Plan(s) is inapplicable to you if you are a commercial user and/or bulk subscriber.
Charges
10. The Maxis Postpaid Plan(s) structure is set out in the attached Appendix and also published on our official
website at https://www.maxis.com.my/mobile-plans/, as updated by us from time to time. Charges published
are exclusive of all applicable taxes.
11. A deposit of RM300 is chargeable to non-Malaysians subscribing for any Maxis Postpaid Plan(s).
12. Non-payment for any one of the Service(s) under the Maxis Postpaid Plan(s) may result in suspension or
barring of all the Services until the outstanding amount is paid.
13. You agree and accept that the unlimited Minutes Allocation for voice and unlimited SMS Allocation applicable
to the Maxis Postpaid Plan(s) only applies to the following:
a. domestic mobile ON-net usage (Maxis to Maxis calls and SMS’) for Maxis Postpaid lite & start (excluding
OFF-net usage (calls and SMS’ from Maxis to other Service Provider), calls to fixed lines, video calls, calls
to numbers with special charges e.g. 1-300/1-700/600 & 121, TM100, 1MOCC and 080-prefix numbers for
border calls to Brunei).
b. domestic mobile/fixed ON-net & OFF-net usage for Maxis Postpaid 98, 108, 128, 158 & 188 (excluding,
video calls, calls to numbers with special charges e.g. 1-300/1-700/600, 121, TM100, 1MOCC & 080-prefix
numbers for border calls to Brunei).
c. standard person-to-person calls or texts and not for any commercial and/ or non-personal usage.
d. non multiple simultaneous calling, re-supply, call centre usage, telemarketing, bulk messaging,
application-to-person communication, continuously call forwarding, auto-dialing, machine-to-machine
communication (including by using your SIM card in any other devices), Cellular Trunking Units (CTUs), or
any other activity we consider to be non-standard usage.
14. Please refer to Appendix attached to this SSTC for applicable Charges on calls and SMS made outside of the
scenarios in Clause 13 above.
15. For data allocated with the Maxis Postpaid Plan(s), you agree and accept:
a. You will experience data browsing at reduced speeds and with no excess charges if any usage exceeds
the allocated mobile internet;
b. The mobile internet package allocated within the Maxis Postpaid Plan(s) is exclusively for domestic usage
only;
c. You may purchase one-time passes to add more data (non-recurring) BEFORE you exceed your mobile
internet package allocation. Such upgrade is available through your UMB, Maxis app, Maxis Online
Account or WAP menu and accessible through your Mobile Device or other available devices or channels
as we may inform you from time to time.
d. You can opt for upgrades or downgrades of the Maxis Postpaid Plan(s) at any Maxis stores or by calling
our contact centres (123).
e. If you upgrade or downgrade your existing plan to any Maxis Postpaid Plan(s), the monthly fees of your
existing plan and your new Maxis Postpaid Plan will be pro-rated against your billing cycle date. However,
you will start enjoying the Mobile Internet Package allocation of your new Maxis Postpaid Plan upon
effective upgrade or downgrade. You will be charged the full monthly fee applicable to your new Maxis
Postpaid Plan the following billing cycle.
Roaming
16. The rates outlined in the Maxis Postpaid Plan(s) structure do not account for usages while on an overseas
roaming network. Whilst roaming overseas, the prevailing data roaming charges
at https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/shall apply.
19. Maxis does not represent, warrant, undertake and/or guarantee that the 5G service(s) will be:
a. provided without errors;
b. uninterrupted; and/or
c. that your experience of the existing services which you are subscribing from Maxis on our other available
networks will not be impacted in an adverse manner,
and that Maxis will and is able to correct or rectify all or any part of the errors, interruption or such adverse
impact to the existing services. You understand and acknowledge that the services offered pursuant to the 5G
service(s) may be subject to limitations, delays and other problems inherent in communication facilities and
network and or the third party 5G network, including the internet and Maxis shall not be responsible to you
and/or any third party for any delays, delivery, failures, or other damage or loss resulting from or in connection
with such problems.
20. Without derogating from the disclaimers and limitation of liability under the GTC which are applicable to you,
Maxis makes no representation or give any condition, indemnity, warranty, guarantee, whether express or
implied, about whether the services offered pursuant to the 5G service(s) will operate and be compatible with
any Content, Equipment, hardware or software or that it will be compatible with the national 5G wholesale
network. You acknowledge and agree that Maxis relies on one or more third party service providers in
relation to the 5G service(s) (including its availability and continuity) and as such, to the fullest extent permitted
by law, Maxis excludes any liability and shall not be liable to you and/or any third parties whether in contract,
tort or otherwise for any loss, damage or liability incurred or sustained by you and/or any third party (including
loss of revenue or loss of services or connectivity) caused by or in relation to any delay, failure, breakdown,
inability to use or access, interruption or disruption by any of our third party service providers including Maxis’
third party service provider of the national 5G wholesale network or in respect of interruption or adverse
impact to existing services subscribed from Maxis arising from your purchase of the 5G service(s).
21. Notwithstanding anything to the contrary in this SSTC, you acknowledge and agree that:
a. you have not relied on any representation, warranty, statement or similar made by Maxis’ third party
service provider of the national 5G wholesale network in connection with your decision to use or the
manner in which you will make use of the 5G service(s) including where such 5G service(s) is provided to
you as part of products or services (or bundled products or services) by Maxis;
b. you are solely responsible for your decision to use, and the manner in which you will make use of, the 5G
service(s) and does so at your own risk (including where the 5G service(s) is used in connection with the
preservation of life or property);
c. you are solely responsible for making your own decisions on appropriate alternative redundancy,
connectivity and data solutions in the event the 5G service(s) is unavailable, disrupted or operate with
error;
d. the 5G service(s) will not necessarily operate without error and will not always be available;
e. Maxis’ third party service provider of the national 5G wholesale network does not owe you any duty of
care or similar duty and you release Maxis’ third party service provider of the national 5G wholesale
network from any liability arising from your use of the 5G service(s); and
f. you must not do anything that may interfere with Maxis’ third party service provider of the national 5G
wholesale network and/or connect or knowingly permit any third party to connect any equipment to the
5G network.
22. We reserve the rights at any time at our sole discretion whether with or without notice to you and without
being liable to you and/or any third party, to immediately interrupt, bar, suspend or restrict the Maxis Postpaid
Plan(s) (including 5G service(s)) for such time as we see fit, withdraw or terminate, discontinue or disconnect
the services including if:
a. any technical failure occurs in services pursuant to the Network (which includes any network operated by
any third party which are connected to Maxis’ network);
b. the services pursuant to the 5G services(s), our Network or systems are being upgraded, modified or
maintained;
c. your usage shows excessive usage or placing unusual burdens on our Network;
d. in our determination that the Maxis Postpaid Plan(s) is or may be used by you for unlawful activities or for
suspected fraudulent activities;
e. your usage is not in accordance with the Maxis Fair Usage Policy (at maxis.com.my/FUP) or contrary to any
of the terms and conditions of this SSTC and/or the GTC;
f. is for commercial/non-personal purposes;
g. where matters beyond our reasonable control prevents us from performing and/ or continuing our
obligations this SSTC, the GTC and/or the Maxis Fair Usage Policy;
h. you have relocated or have been relocated to an area outside the 5G network coverage area; or
i. we are required to do so by law, statute, enactment, regulations, code or by any relevant authorities,
including the Maxis’ third party service provider of the national 5G wholesale network;
and where no prior notice is provided, Maxis may to the extent commercially reasonably practicable give you
notice of such changes in any form as Maxis deem reasonable or appropriate.
23. If you change your current rate plan to a new Maxis Postpaid Plan(s), all promotions/ benefits that you are
currently enjoying under your existing rate plan may be forfeited and you may not be able to carry forward any
promotions/benefits to your new Maxis Postpaid Plan(s).
24. In connection to any Maxis Postpaid Plan(s) survey, comments, suggestions and/or feedback submitted by you
to Maxis, you agree that Maxis may use all comments, suggestions and feedback collected in any manner
without restriction or obligation for any purpose, including but not limited to incorporation or implementation
of such comments, suggestions and feedback into Maxis’ product or service, to develop, improve and/or
evaluate the Maxis Postpaid Plan(s). Except for personal data, no comments, suggestions and/or feedback will
be deemed as your confidential information.
Termination
25. Subject to our GTC, a principal line holder may at any time terminate the Maxis Postpaid Plan(s) as follows:
a. By calling our customer care line at 1-800-82-1123or dial 123 from your mobile;
b. By walking into our Maxis Centres listed on maxis.com.my; or
c. By writing in to customercare@maxis.com.my.
26. For customer who subscribe to the TV for Maxis Postpaid Customers plan, you will be subject further to the
Service Specific Terms & Conditions – TV for Maxis Postpaid Customers ("TV for Maxis Postpaid Customers
SSTC"), available at www.maxis.com.my/en/terms-conditions/devices/tv-for-maxis-postpaid-customers. Any
conflict and inconsistency between this SSTC and the TV for Maxis Postpaid Customers SSTC, the TV for
Maxis Postpaid Customers SSTC shall take precedence.

Eligibility
8. Subscriptions for this Plan must be made and submitted by walking into any Maxis Centres, Maxis Exclusive
Partners or authorized dealers of Maxis in East Malaysia (Sabah, Sarawak, WP Labuan).
9. You must be a Malaysian who reside in Sabah, Sarawak or WP Labuan and have a valid billing address in
East Malaysia (Sabah, Sarawak, WP Labuan). You are ineligible for this Plan if you owe us any payments.
10. This Plan is inapplicable to you if you are a commercial user and/or bulk subscriber, permanent, contract,
temporary employees of Maxis and staffs of Maxis Centres & Maxis Exclusive Partners (MEPs).
Usage
11. A principal line must be registered in your name and be an active account under the Plan offered by us. You
will not be entitled to the bill rebate if your account under the Plan is suspended at the point of bill rebate
assignment.

appended Appendix and also published on our official website at https://www.maxis.com.my/en/terms-
conditions/products-services/mobile/postpaid-east-malaysia/ , as updated by us from time to time. Charges
published are exclusive of all applicable taxes.

numbers with special charges e.g. 1-300/1-700/600, 121, TM100, 1MOCC, 02-prefix numbers for IDD calls to
Singapore & 080-prefix numbers for border calls to Brunei);
(b) standard person-to-person calls or texts and not for any commercial and/ or non-personal usage; and
(c) non multiple simultaneous calling, conference calling (unless you are subscribed to the conference calling
service with Maxis), re-supply, call centre usage, telemarketing, bulk messaging, application-to-person
communication, continuously call forwarding, auto-dialing, machine-to-machine communication (including by
using your SIM card in any other devices), Cellular Trunking Units (CTUs), or any other activity we consider to
be non-standard usage.
(c) is not in accordance with the Maxis Fair Usage Policy (at www.maxis.com.my/FUP ); or
(a) You will experience data browsing at reduced speeds and with no EXCESS charges if any usage exceeds
the allocated mobile internet;
(b) The mobile internet package allocated within the Plan is exclusively for domestic usage only;
(c) You may purchase one-time passes to add more data Such upgrade is available through your UMB ,
MyMaxis App, Maxis Online Account or WAP menu and accessible through your Mobile Phone or other
available Devices or channels as we may inform you from time to time. Please refer to attached Appendix for
Data Booster passes/Experiential passes;
(d) You can opt for upgrades or downgrades of the Plan at any Maxis store or call our Contact Centres (123)
from your mobile;
(e) If you upgrade or downgrade your current Plan to another plan(s), your monthly fee will be pro-rated
against your billing cycle date. You will be charged the full monthly fee from the second month onwards but
with full mobile internet package allocation from the first month.
Roaming
18. The price and rates outlined in the Plan’s structure (as per the Appendix) do not account for usages while on
an overseas roaming network. Whilst roaming overseas, the prevailing data roaming charges at
https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/ apply.
Termination
19. Subject to our GTC, a principal line holder may at any time terminate the Plan as follows:
(a) By calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;

13. The Maxis Postpaid Plan(s) structure is set out in the attached Appendix and also published on our website
at https://www.maxis.com.my/en/mobile-plans/maxis-postpaid-69-and-99, as may be updated by us from time
to time. Charges published are exclusive of all applicable taxes.
14. A deposit of RM300 is chargeable to non-Malaysians subscribing for the Maxis Postpaid Plan(s).
15. Non-payment for any one of the Service(s) under the Maxis Postpaid Plan(s) may result in suspension or
barring of all the Services until the outstanding amount is paid.
16. You agree and accept that the unlimited Minutes Allocation for voice and unlimited SMS' Allocation applicable
to the Maxis Postpaid Plan(s) only applies to the following:
a. domestic mobile ON-net usage (Maxis to Maxis calls and SMS’) for Maxis Postpaid lite & start (excluding
OFF-net usage (calls and SMS’ from Maxis to other Service Provider), calls to fixed lines, video calls, calls
to numbers with special charges e.g. 1-300/1-700/600 & 121, TM100, 1MOCC and 080-prefix numbers for
border calls to Brunei).
b. domestic mobile/fixed ON-net & OFF-net usage for Maxis Postpaid 98, 108, 128, 158 & 188 (excluding,
video calls, calls to numbers with special charges e.g. 1-300/1-700/600, 121, TM100, 1MOCC & 080-prefix
numbers for border calls to Brunei).
c. standard person-to-person calls or texts and not for any commercial and/ or non-personal usage.
d. non multiple simultaneous calling, re-supply, call centre usage, telemarketing, bulk messaging,
application-to-person communication, continuously call forwarding, auto-dialing, machine-to-machine
communication (including by using your SIM card in any other devices), Cellular Trunking Units (CTUs), or
any other activity we consider to be non-standard usage.
17. Please refer to Appendix attached to this SSTC for applicable Charges on calls and SMS made outside of the
scenarios in Clause 16 above.
18. For data allocated with the Plan(s), you agree and accept that:
a. You will experience data browsing at reduced speeds and with no excess charges if any usage exceeds
the allocated mobile internet;
b. The mobile internet package allocated within the Maxis Postpaid Plan(s) is exclusively for domestic usage
only;
c. You may purchase one-time passes to add more data (non-recurring) BEFORE you exceed your mobile
internet package allocation. Such upgrade is available through your UMB, Maxis app, Maxis Online
Account or WAP menu and accessible through your Mobile Device or other available devices or channels
as we may inform you from time to time.
d. You can opt for upgrades or downgrades of the Plan(s) at any Maxis stores or by calling our contact
centres (123);
e. If you upgrade or downgrade your existing plan to another Maxis Postpaid Plan(s), the monthly fees of
your existing plan and your new Maxis Postpaid Plan will be pro-rated against your billing cycle date.
However, you will start enjoying the Mobile Internet Package allocation of your new Maxis Postpaid
Plan(s) upon effective upgrade or downgrade. You will be charged the full monthly fee applicable to your
new Maxis Postpaid Plan the following billing cycle.
Roaming
19. The rates outlined in the Maxis Postpaid Plan(s) structure do not account for usages while on an overseas
roaming network. Whilst roaming overseas, the prevailing data roaming charges
at https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/shall apply.
22. Maxis does not represent, warrant, undertake and/or guarantee that the 5G service(s) will be:
1. provided without errors;
2. uninterrupted; and/or
3. that your experience of the existing services which you are subscribing from Maxis on our other available
networks will not be impacted in an adverse manner,
and that Maxis will and is able to correct or rectify all or any part of the errors, interruption or such adverse
impact to the existing services. You understand and acknowledge that the services offered pursuant to the 5G
service(s) may be subject to limitations, delays and other problems inherent in communication facilities and
network and or the third party 5G network, including the internet and Maxis shall not be responsible to you
and/or any third party for any delays, delivery, failures, or other damage or loss resulting from or in connection
with such problems.
23. Without derogating from the disclaimers and limitation of liability under the GTC which are applicable to you,
Maxis makes no representation or give any condition, indemnity, warranty, guarantee, whether express or
implied, about whether the services offered pursuant to the 5G service(s) will operate and be compatible with
any Content, Equipment, hardware or software or that it will be compatible with the national 5G wholesale
network. You acknowledge and agree that Maxis relies on one or more third party service providers in
relation to the 5G service(s) (including its availability and continuity) and as such, to the fullest extent permitted
by law, Maxis excludes any liability and shall not be liable to you and/or any third parties whether in contract,
tort or otherwise for any loss, damage or liability incurred or sustained by you and/or any third party (including
loss of revenue or loss of services or connectivity) caused by or in relation to any delay, failure, breakdown,
inability to use or access, interruption or disruption by any of our third party service providers including Maxis’
third party service provider of the national 5G wholesale network or in respect of interruption or adverse
impact to existing services subscribed from Maxis arising from your purchase of the 5G service(s).
24. Notwithstanding anything to the contrary in this SSTC, you acknowledge and agree that:
a. you have not relied on any representation, warranty, statement or similar made by Maxis’ third party
service provider of the national 5G wholesale network in connection with your decision to use or the
manner in which you will make use of the 5G service(s) including where such 5G service(s) is provided to
you as part of products or services (or bundled products or services) by Maxis;
b. you are solely responsible for your decision to use, and the manner in which you will make use of, the 5G
service(s) and does so at your own risk (including where the 5G service(s) is used in connection with the
preservation of life or property);
c. you are solely responsible for making your own decisions on appropriate alternative redundancy,
connectivity and data solutions in the event the 5G service(s) is unavailable, disrupted or operate with
error;
d. the 5G service(s) will not necessarily operate without error and will not always be available;
e. Maxis’ third party service provider of the national 5G wholesale network does not owe you any duty of
care or similar duty and you release Maxis’ third party service provider of the national 5G wholesale
network from any liability arising from your use of the 5G service(s); and
f. you must not do anything that may interfere with Maxis’ third party service provider of the national 5G
wholesale network and/or connect or knowingly permit any third party to connect any equipment to the
5G network.
25. We reserve the rights at any time at our sole discretion whether with or without notice to you and without
being liable to you and/or any third party, to immediately interrupt, bar, suspend or restrict the Maxis Postpaid
Plan(s) (including 5G service(s)) for such time as we see fit, withdraw or terminate, discontinue or disconnect
the services including if:
a. any technical failure occurs in services pursuant to the Network (which includes any network operated by
any third party which are connected to Maxis’ network);
b. the services pursuant to the 5G services(s), our Network or systems are being upgraded, modified or
maintained;
c. your usage shows excessive usage or placing unusual burdens on our Network;
d. in our determination, your usage of mobile data, voice and SMS’ is used or originating from outside of
the Selected Region that you have registered with us for more than three (3) consecutive months;
e. in our determination, the Plan(s) is or may be used by you for unlawful activities or for suspected
fraudulent activities;
f. your usage is not in accordance with the Maxis Fair Usage Policy (at maxis.com.my/FUP) or contrary to any
of the terms and conditions of this SSTC and/or the GTC;
g. is for commercial/non-personal purposes;
h. where matters beyond our reasonable control prevents us from performing and/ or continuing our
obligations this SSTC, the GTC and/or the Maxis Fair Usage Policy;
i. you have relocated or have been relocated to an area outside the 5G network coverage area;
j. we are required to do so by law, statute, enactment, regulations, code or by any relevant authorities,
including the Maxis’ third-party service provider of the national 5G wholesale network;
and where no prior notice is provided, Maxis may to the extent commercially reasonably practicable give you
notice of such changes in any form as Maxis deem reasonable or appropriate.
26. If you change your current rate plan to a new Maxis Postpaid Plan(s), all promotions/ benefits that you are
currently enjoying under your existing rate plan may be forfeited and you may not be able to carry forward any
promotions/benefits to your new Maxis Postpaid Plan(s).
27. In connection to any Maxis Postpaid Plan(s) survey, comments, suggestions and/or feedback submitted by you
to Maxis, you agree that Maxis may use all comments, suggestions and feedback collected in any manner
without restriction or obligation for any purpose, including but not limited to incorporation or implementation
of such comments, suggestions and feedback into Maxis’ product or service, to develop, improve and/or
evaluate the Maxis Postpaid Plan(s). Except for personal data, no comments, suggestions and/or feedback will
be deemed as your confidential information.
Termination
28. Subject to our GTC, a principal line holder may at any time terminate the Plan(s) as follows:
a. By calling our customer care line at 1-800-82-1123or dial 123 from your mobile;
b. By walking into our Maxis Centres listed on maxis.com.my; or
c. By writing in to customercare@maxis.com.my.
29. For customer who subscribe to the TV for Maxis Postpaid Customers plan, you will be subject further to the
Service Specific Terms & Conditions – TV for Maxis Postpaid Customers ("TV for Maxis Postpaid Customers
SSTC"), available at www.maxis.com.my/en/terms-conditions/devices/tv-for-maxis-postpaid-customers. Any
conflict and inconsistency between this SSTC and the TV for Maxis Postpaid Customers SSTC, the TV for
Maxis Postpaid Customers SSTC shall take precedence.

restrict the Service(s) for such time as we see fit or terminate, discontinue or disconnect the Service(s) if your
usage:
a. shows excessive usage or placing unusual burdens on our Network;
b. is for unlawful activities or for suspected fraudulent activities;
c. is not in accordance with the Maxis Fair Usage Policy (at maxis.com.my/FUP);
d. is for commercial/non-personal purposes; or
e. in our determination, your usage of mobile data, voice and SMS’ is used or originating from outside of

d. any Maxis Postpaid 69 or 99: SSTC – Regional Maxis Postpaid (https://www.maxis.com.my/en/terms-

8. You are ineligible to subscribe for this Plan if you owe us any payments.
9. This Plan is inapplicable to you if you are a commercial user and/or bulk subscriber.

8. We reserve the rights without liability, to revise this SSTC, Plan(s) and our pricing. Where reasonably
practicable, we will give you reasonable advance notice of such changes and all previous versions of our user
guides or leaflets will be superseded. You accept you are responsible for regularly reviewing information on
the Plan(s) and Service(s) at https://www.maxis.com.my/terms-conditions/personal/, including changes to the
Agreement. Your continued use of the Service(s) and/or Plan(s) (after the Effective Date of any
revision/change to the terms and conditions of Services and/or Plan(s)) shall constitute unconditional
acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept such
revisions/changes, you will terminate the Plan(s) and/or the use of the Services by giving us notice within
fifteen (15) Working Days from the Effective Date failing which you are assumed to have accepted the
changes.
Availability of Service(s)
9. Maxis Fibre is only available in certain coverage areas. Call 123 (from your mobile), 1800 82 1123 or log
onto https://www.maxis.com.my/broadband/maxis-fibre/coverage/to check if you are within the coverage
area.
Eligibility
10. You are not eligible for this Plan if you have any outstanding payments with us.
11. This Plan is not applicable to you if you are a commercial user and/or bulk subscriber.
12. The provision of Service(s) is contingent on your Premises being-fibre ready and having a termination point
within the Premises.
13. Notwithstanding the above, Maxis reserves the right to change the eligibility criteria for the Plan from time to
time.
Charges
14. The Plan's structure and applicable Charges are stated in the appended Appendix and/or published on our
official website at https://www.maxis.com.my/family/maxis-unlimited-postpaid-fibre/, as updated by us from
time to time.
15. Charges displayed do not include any applicable taxes.
16. You are responsible for payment of all Charges associated with the Plan.
19. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar, suspend,
restrict the Service(s) under the Plan (including downgrade your Maxis Postpaid plan) for such time as we see
fit or terminate, discontinue or disconnect the Service(s) under the Plan if your usage:
a. shows excessive usage or placing unusual burdens on our Network;
b. is for unlawful activities or for suspected fraudulent activities;
c. is not in accordance with the Maxis Fair Usage Policy at https://www.maxis.com.my/terms-
conditions/personal/general/maxis-fair-usage-policy/; or
d. is for commercial/non-personal purposes.
20. For data allocated with the Plan, you acknowledge and accept:
a. if the combined mobile data usage of your principal line, your shared lines and your Maxis 4G Backup
exceed 500GB in a month, Maxis may at its absolute discretion limit the quality of video streaming and/or
browsing speed;
b. the mobile internet package allocated within the Plan is exclusively for domestic usage only;
c. you can opt for upgrades or downgrades of your Maxis Postpaid plan under the Plan at any Maxis Service
Centre or Maxis Exclusive Partners (MEP) or call 123 from mobile; and
d. If you upgrade or downgrade to another Maxis Postpaid plan, your monthly commitment fee will be pro-
rated against your billing cycle date. You will be charged the full commitment fee from the second month
onwards but with full mobile internet package allocation from the first month.
Roaming
21. The rates outlined in the Plan structure do not account for usages while on an overseas roaming network.
Whilst roaming overseas, the prevailing data roaming charges at https://www.maxis.com.my/lifestyle/roaming-
idd/international-roaming/.
22. You will only be able to enjoy the benefits of the Plan after the successful activation and installation of the
Service(s) for your subscribed (a) Maxis Postpaid plan; and (b) Maxis Fibre plan under the Plan(s). For clarity:
a. if for any reason, the Service(s) for your subscribed Maxis Postpaid plan and/or Maxis Fibre plan under
the Plan(s) fails to be activated or installed, your registration for the Plan will be deemed unsuccessful;
and
b. if only either of the Service(s) for your subscribed Maxis Postpaid plan or Maxis Fibre plan is successfully
activated or installed, then only the plan for such Service(s) will be deemed to have registered. However,
your registration for the Plan will be deemed unsuccessful.
23. Upon registration for the Plan, your registered Maxis Postpaid plan and Maxis Fibre plan must be kept active
and cannot be suspended for whatsoever reason to enable you to continue to enjoy the benefits of the
unlimited Services.
24. Maxis Fibre 4G Backup Service is an optional service under this Plan and is only available to Maxis Unlimited
Postpaid and Fibre customers.
25. If you subscribe to Maxis Fibre 4G Backup Service, we will provide you with a 4G dongle at no additional cost.
A minimum commitment period of 12-months applies to the Maxis Fibre 4G Backup Service starting on the
date of SIM Card activation (“12-Months 4G Backup Commitment Period”). In the event you terminate the
Maxis Fibre 4G Backup Service or this Plan within the minimum commitment period, an early termination fee
of RM200 will apply.
26. In the event your Residential Gateway (“RGW”) is not compatible with the 4G dongle, upon your request Maxis
will perform a RGW swap from existing RGW to a new RGW that supports the 4G dongle, subject to the
following conditions:
a. You must re-contract a new minimum 24-month commitment period on your Maxis Fibre plan (“New
Maxis Fibre Commitment Period”) starting from the date of installation of the RGW swap.
b. In the event you terminate Maxis Fibre Plan within the New Maxis Fibre Commitment Period, an early
termination charge will apply as provided under your Maxis Fibre
planat https://www.maxis.com.my/terms-conditions/personal/broadband/maxis-fibre/.
27. You are strictly not allowed to remove the Maxis Equipment (including any SIM Card) from the RGW or remove
the RGW from the physical fibre cable without Maxis’ written permission. The specific device warranty for the
dongle may be void and Service(s) may be barred or terminated if SIM Card is removed from the 4G
dongle/RGW.
28. You are strictly not allowed to use the Maxis Fibre 4G backup SIM Card in any other location other than the
registered Maxis Fibre plan installation address. Services may be barred or terminated if Maxis Fibre 4G
Backup SIM Card is used in a location other than the registered Maxis Fibre installation address.
29. You are strictly not allowed to use the Maxis Fibre 4G Backup when your subscribed Maxis Fibre is connected
and there are no service interruptions. Maxis reserves the right to bar or terminate the Service(s) if we detect
your Maxis Fibre 4G Backup is used when your subscribed Maxis Fibre is connected and there are no service
interruptions.
30. In the event that the Maxis Equipment (including any SIM Card) is lost or broken, you will be charged
accordingly for the replacement and delivery of Maxis Equipment. The charge will appear in the next monthly
bill.
31. There is no guarantee of speed. Availability of the Services depends on mobile data or fibre coverage.
32. Suspension or barring or termination of the Service(s) or this Plan will also cause Maxis Fibre 4G Backup to be
suspended or barred or terminated at the same time.
33. The roaming functionality of the SIM Card for Maxis Fibre 4G Backup is disabled by default. However if you
wish to enable roaming using the said SIM Card, you will need to call our customer care line (at 1-800-82-1123
or dial 123 from your mobile) to request and you will be charged the prevailing roaming charges as set out in
the Pay-Per-Use Tariff as stated in https://www.maxis.com.my/lifestyle/roaming-idd/international-roaming/.
34. For any issue related to the delivery or lost of SIM Card for Maxis Fibre 4G Backup, you are required to
contact Maxis to make arrangement for delivery or replacement of such Sim Card.
Termination
35. Subject to our GTC and this SSTC, a principal line holder may at any time terminate the Plan as follows:
a. by calling our customer care line at 1-800-82-1123 or dial 123 from your mobile;
b. by walking into our Maxis Centres listed on maxis.com.my; or
c. by writing in to customercare@maxis.com.my.
36. Upgrade or downgrade of the Maxis Postpaid or Maxis Fibre under this Plan is allowed.
37. Maxis shall have the right to immediately terminate this Plan if:
a. you terminate either or both your Maxis Postpaid plan and/or Maxis Fibre plan under this Plan; or
b. you transfer your Maxis Postpaid line or Maxis Fibre under the Plan to another account holder.
c. after signing up to this Plan, you fail to make full payment of any amount due within 30 days of the
statement due date.
38. Upon termination of the Plan as per Clause 37 above, all the benefit(s) under the Plan will automatically cease
to be applicable to you. For the avoidance of doubt:
a. for termination of Maxis Fibre plan, you may be liable for the applicable early termination charges under
the SSTC - Maxis Fibre (available at https://www.maxis.com.my/terms-
conditions/personal/broadband/maxis-fibre/); and
b. if only one of the Services under the Plan is terminated, the other remaining Services will continue as
normal but without the benefit(s) of the Plan.
39. For any planned interruption of Service(s) under the Plan, adequate notice will be provided via a valid mobile
number and/or any other mode of communication as we may deem appropriate.
Others
40. Upon your subscription to the Plan, you are eligible to enter into selected device contracts with us, which are
subject to the respective device contract terms and conditions including device warranty (if any). Subscription
to the Plan does not affect your existing device contracts with us (if any).
41. For Porting out request after your subscription to the Plan, subject to the terms and conditions under Maxis
Fibre plan, you are required to contact Maxis to detach Maxis Fibre from the Plan before any Porting out
request.
42. For customer who subscribe to the TV for Maxis Postpaid Customers plan, you will be subject further to the
Service Specific Terms & Conditions – TV for Maxis Postpaid Customers ("TV for Maxis Postpaid Customers
SSTC"), available at www.maxis.com.my/en/terms-conditions/devices/tv-for-maxis-postpaid-customers. Any
conflict and inconsistency between this SSTC and the TV for Maxis Postpaid Customers SSTC, the TV for
Maxis Postpaid Customers SSTC shall take precedence.

16. Non-payment for any one of the Services under the Plan may result in suspension or barring of all
the Services under the Plan until the outstanding amount is paid.
17. We reserve the rights at any time, without being liable to you or any third party, to interrupt, bar,
suspend, restrict the Service(s) under the Plan (including downgrade your Maxis Postpaid plan) for
such time as we see fit or terminate, discontinue or disconnect the Plan or the Service(s) under the
Plan if your usage:

shared lines exceed 1TB in a month, Maxis may at its absolute discretion limit the quality of
video streaming and/or browsing speed;
b. for Maxis Home WiFi plans, the mobile internet data allocation to the respective plans is
specified in the Appendix;
c. for Maxis Home WiFi 158, if the mobile internet data usage exceeds 500GB in a month, Maxis
may at its absolute discretion limit the quality of the video streaming and/or browsing speed;
d. for Maxis Home WiFi 138, if the mobile internet data usage exceeds 300GB in a month, Maxis
may at its absolute discretion limit the quality of the video streaming and/or browsing speed;
e. for Maxis Home WiFi 68, once your allocated mobile internet data finishes, the speed will be
managed to a lower speed until your next billing cycle. To continue enjoying the Maxis Home
WiFi 68 services under the Plan at regular speeds, you may purchase one-time passes (non-
recurring). Such passes are available through your Maxis app accessible through your Mobile
Device or Maxis Care Portal (maxis.com.my);
f. for Maxis 5G Home WiFi 99 or 139 plans, if the 5G mobile internet data usage exceeds 1000GB
on 5G in a month, Maxis may at its absolute discretion limit your usage by reducing the speed
until your next billing cycle;
g. for Maxis 5G Home WiFi 69, once your allocated 5G mobile internet data finishes, the speed
will be managed to a lower speed until your next billing cycle. To continue enjoying the Maxis
5G Home WiFi 69 services under the Plan at regular speeds, you may purchase one-time
passes (non-recurring). Such passes are available through your Maxis app accessible through
your Mobile Device or Maxis Care Portal (maxis.com.my);
h. For Maxis 5G Home WiFi plans with 4G Backup, once your allocated 5G data finishes or if you
are not in 5G coverage,
You may tap into your 4G Backup data allocation, with the allocated data and speeds
specified in the Appendix.
Once your allocated 4G Backup data finishes, the speed will be managed to a lower
speed until your next billing cycle. To continue enjoying the Service under the Plan at
regular speeds, you may purchase one-time passes (non-recurring) through your Maxis
app accessible through your Mobile Device or Maxis Care Portal (maxis.com.my).
i. the mobile internet package allocated within the Plan is exclusively for domestic usage only;
j. you can opt for upgrades or downgrades of your Maxis Postpaid plan at any Maxis Service

a. if for any reason, your subscribed Maxis Postpaid plan and/or Maxis Home WiFi under the Plan

b. if only either of your subscribed Maxis Postpaid plan or Maxis Home WiFi plan is successfully
activated or installed, then only such plan will be deemed to have been registered. However,

at https://www.maxis.com.my/terms-conditions/personal/broadband/maxis-home-4g-wifi-device-
contract/and you may be liable for early termination charges, if applicable; and
b. if only one of the Services under the Plan is terminated, the other remaining Services will
continue as normal but without the benefit(s) of the Plan.

General
3. The Plan is not valid with any other offers and/or incentives, which have or may have been offered by
Maxis or Hotlink under any other offers from time to time.
4. You: Person(s) signing up for the Maxis Zerolution Plan.
5. The use of the Service(s) is subject to the postpaid General Terms & Conditions ("GTC") at

7. Capitalised terms herein have the same meaning as defined in the GTC.
8. In the event of any conflict or inconsistency between this SSTC and the GTC, the SSTC shall prevail over
the GTC over such conflict or inconsistency.
9. We reserve the rights without liability, to revise this SSTC, the GTC, the Plan, the Participating Postpaid
Plans and our pricing. Where reasonably practicable, we will give you reasonable advance notice of such
changes and all previous versions of our user guides or leaflets will be superseded. You accept you are
responsible for regularly reviewing information on the Plan and Service(s) at
https://www.maxis.com.my/en/terms-conditions/, including changes to the GTC and other applicable
terms and conditions. Your continued use of the Service(s) and/or Plan (after the Effective Date of any
revision/change to the terms and conditions of Services and/or Plan) shall constitute unconditional
acceptance by you of such revisions/changes and you shall be bound by the same. If you do not accept
such revisions/changes, you will terminate the Plan and/or the use of the Services by giving us notice
within fifteen (15) Working Days from the Effective Date failing which you are assumed to have accepted
the changes.
Eligibility
10. A principal line must be registered in your name and be an active account under an eligible Participating
Plans offered by
11. You are ineligible for this Plan if you (a) have any outstanding payments with us; or (b) are a commercial
user and/or bulk
12. You are responsible for payment of all Charges associated with the Plan.
13. Depending on your credit check result and applicable Minimum Commitment Period (as defined below),
we may collect from you Mobile Device advance payment (“Advance Payment”). If we collect Advance
Payment from you, such advance amount will be refunded to you by way of rebate directly to your
monthly bill or such other manner as Maxis deems fit over a period of 24-months or 36-months, as the
case maybe.
14. By accepting this Plan, you will enjoy one (1) Mobile Device at the price as offered by us on our website
and/or sales material, which is exclusive of all applicable taxes ("Maxis Zerolution Fee"). For clarity,
subject to your eligibility and credit check result, you may purchase and sign up more than one Mobile
Device under the Plan on each Maxis Postpaid principal line.
15. The minimum commitment period of this Plan shall be: -
1. a period of twenty-three (23) months; or
2. a period of thirty-five (35) months,
from the date of registration of the Plan ("Minimum Commitment Period"). Where you are currently on
different Mobile Device plan and you are entitled under that plan to upgrade or switch to this Plan, where
applicable, your previous Mobile Device offer contract is deemed terminated as at the date of execution
of this Plan subject to you first paying any early termination charges payable under the said previous
contract.
16. You shall not, during the Minimum Commitment Period, also during the Extended Period (hereinafter
defined):
a. terminate your Maxis Zerolution Plan;
b. terminate your Maxis Postpaid account or port out to another mobile service provider;
c. have your Maxis Postpaid account terminated for non-payment of monthly bills;
d. downgrade your Participanting Plan to the rate plan below your entry rate plan to Maxis
Zerolution Plan. If you do downgrade to a lower rate plan, you will incur a Mobile Device
remaining balance charge as stipulated in this SSTC;
e. change your Participating Postpaid Plan to a rate plan that is not eligible for this Plan. The
Participating Postpaid Plans eligible for this Plan are stated in Clause 2 above; or
f. change or transfer ownership of this Plan to another person.
17. You acknowledge and agree that if any of the events in Clause 16 above occurs, you shall pay us the early
termination charges as stipulated in Clause 18 below (“Early Termination Charge”). Payment of the Early
Termination Charge is without prejudice to the collection of all monies owing to us by you in accordance
with your account up to the time of early termination. You will receive a final statement of account which
will be due and payable by you to us immediately upon receipt. All outstanding amounts due and owing
to us shall be subject to all applicable taxes.
18. You agree we have the right to impose on you the Early Termination Charge, which you shall be
responsible to pay if this Plan is terminated for whatsoever reason before the expiry of the Minimum
Commitment Period. The Early Termination Charge is calculated as follows:
a. For 23-months Minimum Commitment Period: [(Recommended Retail Price (RRP) ÷ 24 months)
x remaining month(s) of the Minimum Commitment Period].
b. For 35-months Minimum Commitment Period: [(Recommended Retail Price (RRP) ÷ 36 months)
x remaining month(s) of the Minimum Commitment Period].
19. In addition to Clause 18, in the event of early termination of this Plan before the expiry of the Minimum
Commitment Period, you shall be further liable to pay us a MobileDevice non-return fee to be
determined by us based on the Mobile Device model and its residual value or as stated in the
Registration Form. You are not required to return the Mobile Device upon payment of the Mobile Device
non-return fee by you to us.
20. If any of the account(s) / Service(s) under the Plan is suspended during the Minimum Commitment Period
due to any reason whatsoever, the Maxis Zerolution Fee will continue to be charged to you.
21. You agree we have the rights to block the IMEI of the Mobile Device if:
a. you are suspected of fraud or found to have committed fraud;
b. after signing up to this Plan, you fail to make full payment of any amount due within fourteen (14)
days of the statement due date; or
c. you have reported to us that the Mobile Device is missing or has been stolen and have
requested us to block the IMEI of the Mobile Device.
22. You are responsible for any loss, theft or damage to the Mobile Device at all times and shall continue to
pay the Maxis Zerolution Fee for the Minimum Commitment Period and Extended Period, if applicable,
notwithstanding that the Mobile Device is lost or damaged.
23. You accept and acknowledge you have the obligation to observe and fulfill the terms and conditions of
this Plan, including the Minimum Commitment Period, Mobile Device, payment and charges for the Plan
and Accessory (if any), any Early Termination Charge and Mobile Device non-return fee under the Plan,
these terms and conditions and the General Terms and
24. You accept and acknowledge that the Mobile Device title and ownership does not belong to you during
the Minimum Commitment Period. The Mobile Device is provided under this Plan to you and you are
accountable for the use and safety of the Mobile Device. Nothing in this SSTC shall be construed as
transferring the title or ownership of the Mobile Device to you unless otherwise expressly stated. You
shall not directly or indirectly give or allow another person to give any interest in or lien over the Mobile
Device. You shall promptly, at your own costs and expenses, take all such actions as may be necessary to
duly discharge or eliminate any such liens over the Mobile Device upon obtaining actual knowledge
thereof.
25. The Mobile Device is to be returned to us in good working order upon the expiry of the Minimum
Commitment Period.
26. In the event that the Mobile Device is not returned to us upon the expiry of the Minimum Commitment
Period, this Plan shall continue to be valid and effective for another one (1) month (“Extended Period”)
wherein the Maxis Zerolution Fee shall continue to be payable to us. This Plan shall be terminated on the
expiry of the Extended Period.
27. Within the Extended Period:
a. if you wish to terminate the Plan and you return the Mobile Device to us in good working order,
this Plan shall be terminated and you shall not be liable to any Mobile Device non-return fee.
b. if you wish to terminate the Plan or when the Plan is terminated but you failed to return the
Mobile Device to us on the termination of the Plan, a Mobile Device non-return fee (as stated in
the Registration Form) will be charged as compensation. You are not required to return the
Mobile Device upon payment of the Mobile Device non-return fee by you to us.
28. For the avoidance of doubt, notwithstanding anything to the contrary, we are not obliged to accept the
Mobile Device should you seek to return the Mobile Device after the Extended Period.
29. In any event if the Mobile Device is returned to us but the same is not in good working condition,
a. we shall be entitled to charge you for any cost of repair to make good the Mobile Device and
you shall pay the same unless the cost of repair is partially or fully covered under the Maxis Safe
Device (MSD) plan subscribed by you. Any portion of the cost not covered under the Maxis Safe
Device (MSD) plan shall be borne by you; and/or
b. notwithstanding sub-paragraph (a), we may, at our sole discretion, decide not to accept the
return of the Mobile Device irrespective of whether you have a Maxis Safe Device (MSD) plan
and irrespective of whether you wish to pay for the cost of repair, where we determine that the
condition of the Mobile Device is not acceptable to us. In such instance, you will be charged the
Mobile Device non-return fee as stated in the Registration Form. Upon payment of the Mobile
Device non-return fee by you to us, the Mobile Device shall be regarded as belonging to you.
30. The payment of the Mobile Device non-return fee (if any) by you is without prejudice to any other charges
and fees due to us including charges under the Participating Plan and early termination charges. It shall
be your obligation to return the Mobile Device in accordance with the terms and conditions stated herein.
Accessory
31. If you have subscribed to any Maxis Postpaid plan, you have the option to purchase accessories such as
handphone cases, screen protectors, power bank, charging adaptors, USB cable, add-on speakers,
headphones, stands, selfie sticks, car kits, replacement batteries, smart watch and other products or
items related to the Mobile Device (“Accessory”) at the price as offered by us, which is exclusive of all
applicable
32. Accessory may be subject to a contract term commences from the date of purchase and continues for
one (1) year (“Term of Accessory”).
33. If Term of Accessory is applicable, you will be billed for the Accessory purchase price in equal monthly
installments under Maxis Zerolution Plan.
34. You agree we have the right to impose the Accessory remaining balance charge, which you shall be
responsible to pay if you decide to terminate before the expiry of the Term of Accessory. The Accessory
remaining balance charge is calculated as follows: [(Recommended Retail Price (RRP) ÷ 12 months] x
remaining month(s)].
35. Accessory is not applicable to Hotlink Postpaid plan subscriber.
36. We will not be responsible for replacing the Mobile Device or any part thereof that is lost, stolen,
damaged or defective (regardless such defect is a manufacturer defect or due to the reason of
installation of unauthorized app). You shall be responsible for the repair and maintenance of the Mobile
Device. Repairs shall be subject to the applicable warranty issued by the
37. In the event your Port request to us is still pending from the DNO, and you wish to subscribe to the Plan
before successful Porting of your Mobile Number to Maxis, you confirm, agree and understand that:
a. a Mobile Number provided by us will be attached to the Mobile Device purchased under this
Plan (“InterimMobileNumber”) with a SIM Card or eSIM (Maxis’ SIM Card or Maxis’ eSIM), as the
case maybe;
b. the Plan shall be effective and commence on the date of registration for the Plan and not on the
date of which your Port request is successful; and
c. you shall make and continue to make payment for the Charges associated to the Plan (including
the Charges for the Mobile Device purchased) from the date of registration of the Plan
regardless of whether your Port request to Maxis is successful.
38. In the event your Port request is successful within thirty (30) days from the date of registration of the Plan,
you confirm and agree that:
a. we will swap or switch the Interim Mobile Number to your Mobile Number provided by the
Donor (“Your Mobile Number”) at our end. In this case, Service to the Interim Mobile Number
will be deactivated. You must make request to us separately if you wish to retain the Interim
Mobile Number which such request is subject to registration on any Maxis’ mobile plan and
strictly subject to availability; and
b. we will notify you of the successful Port-in and Service of Your Mobile Number will be available
on the Maxis’ SIM Card or Maxis’ eSIM and you may discard your previous SIM provided by the
DNO.
39. In the event your Port request is not successful after thirty (30) days from the date of registration of the
Plan or where your Port request failed, is rejected by the DNO or unsuccessful, for whatsoever reasons,
you confirm and agree that:
a. we shall not be liable or responsible to you or any third party for any loss or damage whether
direct, indirect, special or consequential, or for loss of business, revenue or profits or of any
nature suffered by you, or any other person, or any injury caused to or suffered by a person or
damage to property;
b. the Interim Mobile Number shall automatically become your new Maxis Mobile Number line
without notice from us;
c. you shall remain responsible and liable for the Charges (including the Charges for the Mobile
Device purchased) associated with the Plan; and
d. if you decide to terminate the Plan before the expiration of the Minimum Period of Service, you
shall pay us the early termination charges as set out in clause 18 above and where applicable,
the Mobile Device non-return fee as described in clause 19 above.
40. For the avoidance of doubt, should this section applies to you, Clause 12 of the GTC (save for Clause 12.8)
shall be applicable to you.
41. Maxis Network Exclusive Device refers to certain Mobile Devices which will be locked and can be used
with Maxis SIM Card only within the Plan’s Minimum Commitment Period, to protect you from fraud and
reduce theft. From 15 January 2024, any iPhone 13/ 14 (128GB) or such other Mobile Devices model (as
may be notified by Maxis from time to time) purchased from us or from third party authorised by us under
the Plan and activated on Maxis SIM Card is locked to Maxis automatically, and the following terms will
apply:
a. Upon the activation of the Plan, the Mobile Device will be locked to Maxis’ network for a period
of twelve (12) months (“Lock Period”). During the Lock Period, you will not be able to connect
your Mobile Device to another operators’ or carrier’s network (locally as well as overseas);
b. After the end of the Lock Period, we will automatically remove the lock in which you will be able
to use other operator’s SIM Card (locally as well as overseas) on your Mobile Device, unless the
Mobile Device is deemed stolen or we suspect fraudulent purchase of the Mobile Device; and
c. If you intend to use other operator’s SIM Card on your Mobile Device at any point of time within
the Lock Period, you may do so by terminating the contract under this Plan and in such a case,
the early termination charges (Clause 18) and mobile device non-return fee (Clause 19), as the
case may be, shall apply.
42. For clarity, you may use the Mobile Devices that are locked to Maxis Sim Card for roaming on overseas
network when travelling abroad by subscribing to Maxis roaming passes.
Waiting Period
43. Subject to approval by Maxis based on your application and credit check result, a minimum 3-months
waiting period is applicable to you for this Plan if you are:
a. a new customer of Maxis/ Hotlink; or
b. an existing customer of Maxis/ Hotlink eligible to take up more than one (1) Mobile Device
contract under the same Malaysian identity card number or passport number, where each
Mobile Device contract must be three (3) months

For claims and enquiries about the SafeDevice Programme, please contact Maxis Safe Device Hotline at 1800-88-
6888.
If you have subscribed to any one of the SafeDevice Programme, you will receive a rebate for Monthly Service Fee
for the first three (3) months. The rebate will be shown in your monthly bill. After the first three (3) months of the
SafeDevice Programme, you will be charged the Monthly Service Fee based on the recommended retail price
(RRP) of the mobile device and subject to this terms and conditions.
For the avoidance of doubt, in respect of Replacement Service Fee, you will still be liable to pay the Replacement
Service Fee during the first three (3) months , which is subject to these terms and conditions as described below.
All Monthly Service Fee and Replacement Service Fees are subject to applicable tax.
Maxis reserves the right to suspend or discontinue the SafeDevice Programme or any part thereof or modify the
Programme at any time at its sole discretion. You are not entitled to reactive the Programme once you have
terminated your subscription.
Capitalised terms used in these terms and conditions not specifically defined herein shall have the same meaning
as given to them in the Maxis’ General Terms and Conditions. References to "you" are references to you, the
Customer, and references to "we", "us" and "our" are references to Maxis.

1. Definitions.
“Protected Equipment” means one Eligible Device owned or leased by you or one Replacement Equipment
provided by us to you under the SafeDevice Programme. The Protected Equipment, designated by you at the time
of enrolment and identified by the International Manufacturer’s Equipment Identification (IMEI), Electronic Serial
Number (ESN) or Mobile Equipment ID (MEID), must be actively registered in your name in Maxis’s records and
have logged airtime after being enrolled in the SafeDevice Programme. Protected Equipment is limited to one
Eligible Device per replacement. If you have used a different Eligible Device on your mobile number immediately
prior to the time of a Failure, the Protected Equipment is the Eligible Device (1) for which you have used on your
mobile number immediately prior to the time of a Failure; and (2) for which you have provided a proof of purchase
or lease from us. If there is a difference in Eligible Device tier, additional fees may apply.
“Eligible Device” means the wireless mobile device or smartwatch that we have designated as eligible for
protection under the SafeDevice Programme as set forth in the list of Eligible Devices and device tier available
from us from time to time, which can be found in Maxis stores or by calling 123 or 1-800-886-888.
“Failure” means the occurrence of Attended Theft and/or Accidental Damage, during the time the SafeDevice
Programme is in effect. If Attended Theft occurs, you will also receive protection for unauthorized call charges and
overseas temporary rental costs in accordance with Section 2 of this Agreement.
“Replacement Equipment” means a wireless mobile device (whether new or refurbished) of the same make,
storage and model (but not necessarily colour), or if the same make, storage and model is not in stock or the
production for the Eligible Device is discontinued by the original equipment manufacturer, the replacement device
will be a different model of similar feature, functionality and fair market price to the Eligible Device at the time of
the Service Request (but may not be the same brand or model), with the same operating system and will not be a
model that is older than the Protected Equipment, which we will provide to you in the event of a Failure of the
Eligible Device. Replacement Equipment becomes Protected Equipment once it has been delivered to you or
acknowledged receipt by you.
“Effective Date” means the date you enrolled your Eligible Device in the SafeDevice Programme. If you enroll
your Eligible Device into the SafeDevice Programme within 10 days from the date of purchase of your Eligible
Device, the benefits begin immediately. If you choose to enroll into the SafeDevice Programme after the 10 days
from the date of purchase of the Eligible Device, we reserve our right to inspect your Eligible Device prior to
agree to enrolment or to deny enrolment if it is found to be ineligible, as determined by us in our sole discretion.
“The Plan” or “Programme” means the SafeDevice Programme in which you have enrolled in which you are
eligible for repair or replacement service if the Protected Equipment experiences a Failure.
“Authorised Service Facility” means the location or locations that serve as a repair or replacement facility for the
Programme and supply replacements for Protected Equipment.
“Computer Virus” means any unauthorized programming or intrusive codes that are entered by any means into
covered data processing equipment, media, software, programs, systems or records and interrupt the operations
of the Eligible Device.
“Enrolled Subscriber” means a customer of Maxis who has accepted the device protection offered by Maxis as
part of a sales agreement with Maxis and who has paid all applicable fees due with respect to the Protected
Equipment.
“Terrorism” means an act, including but not limited to, the use of force or violence and/or the threat thereof, of any
person or group(s) of persons, whether acting alone or on behalf of or in connection with any organization(s) or
government(s), committed for political, religious, ideological or similar purposes including the intention to
influence any government and/or to put the public, or any section of the public, in fear.
“Pollutants” mean any solid, liquid, gaseous or thermal irritant or contaminant, including smoke, vapour, soot,
fumes, acids, alkalis, chemicals and waste. Waste includes materials to be recycled, reconditioned or reclaimed.
“Accidental Damage” means any direct and accidental damage including damage, accidental destruction that is
externally visible and which prevents the correct operation of the Protected Equipment, including glass breakage
(back and front of the LED screen), physical loss, damage, or destruction caused by an Accident.
“Accident” means a known and identifiable but unintended, sudden and unforeseen event.
“Attended Theft” means the dishonest appropriation of Protected Equipment belonging to the Enrolled
Subscriber while the equipment is in the possession of the Enrolled Subscriber or on his or her person or
authorized person, with the intention of permanently depriving the Enrolled Subscriber of that equipment.
“Registration Form” means the registration form as defined in Maxis’ General Terms and Conditions at
https://www.maxis.com.my/en/terms-conditions/personal/general/maxis-consumer/.
“Replacement Service Fee” means the amount the Enrolled Subscriber pays towards his or her service request.
“Personal Data Protection Act 2010” means the Personal Data Protection Act of 2010, as amended.
“Service Request” means the request for service that you file with us when your Eligible Device suffers a Failure.
2. Protection.
We will replace the Protected Equipment that has incurred a Failure from the causes shown below and reported to
Maxis during the month for which the Enrolled Subscriber has paid the required Monthly Service Fee.
These Terms & Conditions of the SafeDevice Programme together with your monthly bill for this Programme (the
“Monthly Service Fee”), confirmation of enrollment either by email or text message, applicable payment
provisions under your Maxis postpaid account or wireless service agreement, and applicable written
communications from us to you collectively comprise our contract (the "Contract"). You should keep these Terms
& Conditions and all of the other documents that comprise the Contract for your reference. If any portion of the
Contract is deemed invalid or unenforceable, it shall not invalidate the remaining portion of the Contract. We
exclude any liability related to it and is not responsible for any loss, damage, liability or expenses arising from any
claims, including those not specifically mentioned herein, including but not limited to invasion of privacy,
infringement of intellectual property rights or breach of any law or regulation arising from the use of the
SafeDevice Programme, whether by the you or any other person.
Service Contract Not Insurance Policy. This contract is not an insurance policy and provides no insurance
coverage or insurance benefits to you.
4. What is Protected.
If the Protected Equipment suffers a Failure during the time the Contract is in effect, we will replace the Protected
Equipment upon payment by you of the applicable Replacement Service Fee. The Protected Equipment will be
replaced with a wireless device of like kind and quality with comparable features and functionality to the Protected
Equipment. There is no assurance, representation, or warranty that any Replacement Equipment will be identical
or offer the same functionalities or color as the item being replaced. Replacement Equipment may be
remanufactured or refurbished, at our sole discretion. If the Replacement Equipment you receive is
remanufactured or refurbished, such Replacement Equipment shall be similar to your Protected Equipment
regarding functionality and features. Replacement Equipment is limited solely to a wireless device and will not
include any equipment accessories associated with the equipment. The Replacement Equipment becomes the
Protected Equipment immediately upon delivery to you. If we replace your Protected Equipment under the
Programme, we reserve the right to take possession and ownership of your defective Protected Equipment. You
hereby assign and transfer to us all rights and benefits of any manufacturer’s warranty or other ancillary service
relating to any replaced Protected Equipment.
5. Manufacturer’s Warranty.
The SafeDevice Programme complements and may overlap with the manufacturer’s warranty, which is typically
valid for one year from the purchase date of your new mobile device. Some devices may have a longer or shorter
manufacturer’s warranty. Please refer to the manufacturer’s warranty provided with your wireless mobile device or
through the manufacturer’s website to understand what protection is offered and the duration of the
manufacturer’s warranty.
Benefits under the SafeDevice Program begin on the Effective Date and continue from month to month unless
terminated by you or by Maxis in accordance with Cancellation provision herein. We will discontinue the Monthly
Service Fee for the SafeDevice Programme at such time and in accordance with the Cancellation provision below.
7. Charges.
You agree to pay your Monthly Service Fee for each month on the same terms and conditions as set forth under
this Contract. You also agree to pay the monthly Safe Device subscription regardless of barring or suspension of
your account, until you perform a cancellation of the subscription. Applicable Replacement Service Fees, shipping
and restocking charges, taxes, and regulatory surcharges and assessments, if any, may be added to your bill or, at
our sole discretion, collected from you prior to providing Replacement Equipment.
8. Service Request.
In the event of any Failure of Protected Equipment, you may file a Service Request with us by calling 1-800-886-
888. If the Protected Equipment has suffered Attended Theft, you must first notify Maxis to block the Protected
Equipment IMEI number within 24 hours from the time of Attended Theft before submitting the Service Request.
You must submit your Service Request and a police report and an affidavit (if required) for Attended Theft within
48 hours of the Attended Theft. If you are traveling outside of Malaysia when the Attended Theft occurs, you must
submit your Service Request within one hundred and twenty (120) hours of the Attended Theft and submit a copy of
your passport evidencing that you were outside the territory of Malaysia when the Attended Theft occurred or, you
must within forty eight (48) hours of arriving back in Malaysia, submit your Service Request and a copy of your
passport evidencing that you were outside the territory of Malaysia.
For all other Service Request, you must file your Service Request within seven (7) days of the Failure by calling 1-
800-886-888. If the Failure is not reported within seven (7) days, your Service Request will be forfeited and no
Replacement Equipment will be available under the Contract. You must provide us with all necessary information
required to approve replacement of the Protected Equipment and pay your Replacement Service Fee within
seven (7) days of reporting the Failure. If your Service Request is approved, we will provide the Replacement
Equipment within two (2) to seven (7) business days via a designated courier to your address, . For all Service
Request other than Attended Theft, you will be required to provide our designated courier with your original
Protected Equipment to the designated courier prior to receiving your Replacement Equipment. If you fail to
deliver your original Protected Equipment to our designated courier, you will not receive your Replacement
Equipment.
Failure on your part to provide us the necessary information and pay the Replacement Service Fee within seven (7)
days of the date that you report the Failure to us will result in forfeiture of your Service Request. We may require,
as a condition of approval of your Service Request, that you provide proof of purchase for the Protected
Equipment and/or your government-issued photo ID., a copy of your wireless bill, and/or other documentation or
information as reasonably necessary to establish your identity and right to service. We also retain the right to
inspect the Protected Equipment as a condition of approval of your service request.
A non-refundable Replacement Service Fee applies to each approved Service Request. The Replacement Fees
for Service Request for each Failure resulting from Accidental Damage or Attended Theft are stated in the table
above. You will be informed at the time you submit your Service Request of the applicable Replacement Service
Fee. Maxis will collect from you the Replacement Service Fee prior to providing Replacement Equipment. A
complete list of Eligible Wireless Devices is available by visiting any Maxis store or by calling 123 from your mobile
device or 1-800-886-888.
It is expressly agreed and understood that by accepting these terms and conditions, you understand, agree and
authorise us to access your account records for Service Request handling and product and service validation
purposes.
The benefit under this Contract for each and every Failure shall not exceed the recommended retail price of the
Protected Equipment at the time of the Service Request and is subject to a maximum of two (2) valid Service
Requests, of which no more than one (1) Service Request may be due to an Attended Theft Failure and no more
than one (1) Service Request may be due to Accidental Damage Failure, during any consecutive twelve (12) month
period, beginning from the date you filed your first valid Service Request with us. If you file two (2) valid Service
Requests, you will not be entitled to file an additional Service Request for Attended Theft or Accidental Damage
until the expiration of the said applicable twelve (12) month period. Protected Equipment approved for
replacement must be returned to us at our shipping expense. You will be instructed to provide your Protected
Equipment to our designated courier at the time you receive your Replacement Equipment.
If we do not receive your original Protected Equipment at the first attempt to deliver your Replacement Device,
and makes a subsequent attempt to deliver your Replacement Equipment and collect your original Protected
Equipment, you will be charged an additional courier fee of RM50.00 per each additional courier delivery attempt.
13. Restriction.
You may only subscribe to one (1) SafeDevice Protection at a time under the same mobile number (MSISDN).
Should you have purchased a new mobile device with Maxis, the subscription for the old mobile device under the
same mobile number (MSISDN) will be automatically terminated.
If you file a Service Request, we will ask you at the time you file your Service Request to disable any locking
feature on your Protected Equipment, such as the “Find my iPhone” or similar locking feature. If you fail to disable
the locking feature, we may, in our sole discretion, decline to approve your Service Request. You may avoid
having your service request denied by disabling the locking feature on your protected equipment at the time you
file your service request.
15. Cancellation.
You may terminate the Contract at any time for any reason by calling us at 123 from your mobile device or visiting
any Maxis store location to request cancellation. You will not be entitled to any Monthly Service Fee refund if you
file a Service Request but refuse to accept the Replacement Equipment. We may, at our sole discretion cancel
your enrolment in the Programme if you fail to pay the Monthly Service Fee. If we cancel your enrolment, you will
not be entitled to any Monthly Service Fee refund.
We may terminate the Contract for any reason and at any time by notifying you, and we shall state the effective
date and grounds for cancellation. We may terminate the Contract immediately if you default on any of your
obligations, including but not limited to, failure to pay your Monthly Service Fee, commit fraud, or intentionally
conceal or misrepresent a material fact concerning your enrolment, Protected Equipment, or Service Request, and
you will not be entitled to any refund of Monthly Service Fees.
If you are enrolled in the Zerolution SafeDevice Plan, and your enrolment in the Zerolution Program is canceled,
your enrolment in the Zerolution SafeDevice Plan will also be canceled, unless you elect to continue in the
Program pursuant to the Standalone SafeDevice Plan. If you are enrolled in Zerolution360 SafeDevice Plan, and
your enrolment in the Zerolution360 Program is canceled, your enrolment in the Zerolution360 SafeDevice Plan
will also be canceled and you will not be able to continue in the Program pursuant to the Standalone SafeDevice
Plan. If you or we terminate the Contract, we will discontinue all monthly charges for the Plan as of the next billing
cycle. You will not receive any refund of your Monthly Service Fee, but you will remain eligible to file a Service
Request for a Failure that occurs prior to the expiration of your next billing cycle.
If we determine that a device other than an Eligible Device has been enrolled in the Plan, we may cancel the
Contract by notifying you in writing. Upon the occurrence of an ineligible enrolment, we will provide a refund of all
paid Monthly Service Fees, less the value of any replacement received.
17. Exclusions
We will not pay for any Failure caused directly or indirectly, in whole or in part, by any of the following exclusions.
The following events or occurrences are excluded regardless that any other cause or event contributes
concurrently or in any sequence to the excluded event or occurrence.
War, including
Undeclared or civil war;
Warlike action by military force; or
1. Insurrection, rebellion, revolution, usurped power or action taken by the governmental authority in
hindering or defending against any of these.
2. Any act of Terrorism.
3. Obsolescence or depreciation of the Protected Equipment.
4. Recall or Design Defect
Manufacturer’s recall; or
Error or omission in design, programming or system configuration.
1. Cosmetic Damage. Cosmetic damage, howsoever caused, that does not affect the manufacturer’s
intended use. This includes but is not limited to:
1. Service Request Reporting. A Failure from any cause if the Enrolled Subscriber fails to file a Service
Request, or fail to timely file a Service Request, as required by this Contract.
2. Programming, Repair work. Programming, cleaning, adjusting, repairing, modifying, installing, servicing,
maintaining or performing any other work upon Protected Equipment that is intended to alter, improve,
maintain or enhance the performance of the equipment.
3. Computer Virus. Computer Virus or any other malicious code or similar instruction that:
1. Wear and Tear, Prior Damage. Normal wear and tear, gradual deterioration, any latent defect or any
condition existing prior to the enrolment date of the Enrolled Subscriber.
2. Theft:
1. Consequential loss or damage. Loss of use, consequential loss, or consequential damages of any kind.
2. Fraudulent Service Requests. If the proposal or declaration of the Enrolled Subscriber is untrue in any
material aspect or if any Service Requests made by the Enrolled Subscriber is fraudulent or intentionally
exaggerated or if any false declaration or statement is made in support thereof, then this Contract shall
be void and the We shall not be liable to make any payment hereunder.
3. Agreement and Notice of Material Change.
You agree to all the provisions of the Contract, including but not limited to these Service Program Terms &
Conditions, when you order the Plan and/or pay for it. Subject to applicable law, in the event of any material
change to the service terms, Monthly Service Fee, and/or Replacement Service Fee, unless such change is more
favorable to you, you will be provided thirty (30) days advance notice of such changes. Such notice may be
provided by any of the following methods: email, text message, in a separate mailing, or by any other reasonable
method, at our sole discretion. Such notice will set out the effective date of the material change. Your continued
use of the Plan and payment of the charges after such notice constitutes your acceptance of the changes. Your
participation in the Plan is optional and you may cancel the Plan at any time. Please refer to the Cancellation
section of the Contract.
You expressly and knowingly consent and agree that we (including any third party vendor, or representative
through which we provide services under this Contract) may handle or treat your Personal Data (as that term is
defined within the Personal Data Protection Act 2010) in accordance with the requirements of the Personal Data
Protection Act 2010. You further acknowledge and consent that, in providing the services hereunder, we may
process, move, share and/or store your Personal Data subject to the requirements of the Personal Data Protection
Act 2010 within and outside the Country of Malaysia.
You expressly and knowingly agree and consent to permit us (including any third party vendor, or representative
through which we provide services under this Contract) to make disclosures and provide notices to you in
electronic form, including but not limited to email and text messaging, instead of providing such notices and
disclosures in hardcopy by post mail. Your consent and agreement shall relate to all forms, disclosures, and
notices required under applicable law and shall remain valid until such time as you may exercise your right to
revoke this consent by notifying Maxis.
The Plan is for your use only. It is not transferable by you to any other person, and may not be assigned by you.
Wireless devices owned or leased by anyone other than you may not be made Protected Equipment. Any abuse of
the Plan by you, including but not limited to seeking replacement of a wireless device not belonging to you, may
result in termination of the Plan upon notice.
The protection provided by this Contract is void with respect to any Enrolled Subscriber who commits fraud or
intentionally conceals or misrepresents a material fact concerning, this Contract, the Protected Equipment, the
Enrolled Subscriber’s interest in the Protected Equipment, or a service requested under this Plan.
We have no responsibility for delays or failures due to acts of God, fire, flood, explosion, war, revolution, acts of
public enemy or terrorist, labour difficulties, including without limitation strikes, slowdowns, picketing or boycotts,
civil commotion, embargo, acts of government, military authority, pandemic, or the elements or other causes
beyond our reasonable control, and in such event, we may cancel the Contract and the Plan immediately.
No one may bring legal action against us under this Contract unless and until there has been full compliance with
all terms of this Contract.
In the event of any error, omission or failure by us or our agents, vendors, representatives or service providers
with respect to the SafeDevice Programme or the services provided by us or our agents, vendors, representatives
or service providers hereunder, our responsibility and liability and that of our agents, vendors, representatives
and service providers shall be limited to the charges actually paid by you for the SafeDevice Programme (but no
more than the last twenty-four (24) monthly charges you paid for the SafeDevice Programme). This is your sole
remedy for any errors, omissions or failure of us or our agents’, vendors’, representatives’ or service providers’
performance. Further, under no circumstances shall we or our agents, vendors, representatives or service
providers be liable for economic losses, indirect, incidental, consequential, special, exemplary or punitive
damages (even if we or our agents, vendors, representatives or service providers have been advised of or have
foreseen the possibility of such damages), arising from the plan or our or our agents’, vendors’, representatives’ or
service providers’ performance under the plan, or under any provision of the contract, such as, but not limited to,
loss of revenue or anticipated profits or lost business. Except as otherwise expressly stated in the contract or
required by law, we hereby specifically disclaim any and all conditions, representations or warranties, statutory,
express or implied, regarding the plan and services to be provided hereunder by us and our agents, vendors,
representatives or service providers, including any implied warranty of title, merchantability or fitness for a
particular purpose and implied warranties arising from course of dealing or course of performance.
