EXECUTIVE ORDER No. 03


Series of 2023

WHEREAS, the United Nations convention on the Rights of the Child (UNCRC) provides the
fundamentals basis of the Philippine Government’s vision for a “Child-friendly, caring and protective
society for, by and with the Children”;

WHEREAS, the Philippine Government’s ratification on the United Nations Convention on the Rights
of the Child (UNCRC) in 1990 has made it imperative for all sectors of the society to translate its provisions
into concrete actions that will lead to the fulfillment of the Filipino children’s rights to survival,
development, protection, and participation;

WHEREAS, Republic Act 7610-A Special Protection of Children Against Child Abuse Exploitation and
Discrimination Act, provides for a stronger deterrence and special protection against child-abuse,
exploitation and discrimination and its corresponding penalties;

WHEREAS, Article 359 and 360 of the Civil Code of the Philippines, provides that the “Government
shall establish a Council for the Protection of Children”;

WHEREAS, Presidential Decree 603, article 87-The Child and Youth Welfare Code encourages the
organization of a Barangay Council for the Protection of Children (BCPC) and shall coordinate with the
council for the Welfare of the Children in drawing and implementing plans for the promotion of child
welfare;

WHEREAS, Presidential executive Order No. 310, series of 2000, “adopted the Philippine National
strategic Framework Plan development for Children, 2000-2025 or child 21” which is holistically looks and
attends to the needs of the child using the life-cycle approach of development;

WHEREAS, DILG Memorandum Circular No. 2002-121, dated August 03, 2002, a “Revised
Guidelines on the Organization and Strengthening of the Local Council for the Protection of Children (LCPC)
incorporating thereat Early Childhood Care and Development (ECCD) Coordinating Committees at the
Provincial, City, Municipality and Barangay level”;
WHEREAS, the Department of the Interior and Local Government (DILG) has issued Memorandum
Circular No. 2008-126 this provides the revised guidelines in monitoring the functionality of the local
council for the Protection of Children.
WHEREAS, as the core local institution for the child-related programs, the LCPC is responsible in
planning and spearheading programs for the Children at the local level with the end in view of making the
locality child-friendly;

NOW THEREFORE, I, VICTOR S. BUENAVENTURA, by virtue of the powers vested in me by law as


Punong Barangay, do hereby order the following:

SECTION 1. REORGANIZATION AND RECONSTITUTION OF THE BARANGAY COUNCIL FOR THE


PROTECTION OF CHILDREN. There is hereby reorganized and reconstituted body known and called as the
Barangay Council for the Protection of Children (BCPC) in Barangay Lipay-Dingin-Panibuatan, Iba,
Zambales.

SECTION 2. FUNCTIONS. The BCPC shall have the following functions:

1. Foster education of every child;


2. Take steps to prevent juvenile delinquency and assist parents of children with behavioral problems
so that they can get expert advice;
3. Adopt measures for the health of children;
4. Conduct capability building projects to increase knowledge and skills in handling children’s
programs;
5. Encourage the proper performance of the duties and responsibilities of parents, and provide
learning opportunities on the adequate rearing of children and positive parent-child relationship;
6. Promote wholesome entertainment in the community, especially in movie houses;
7. Prepare Annual Work and Financial Plan (AWFP) for children and recommend appropriations to the
sanggunian;
8. Provide coordinate linkages with other agencies and institutions in planning, monitoring and
evaluation of plans for children;
9. Establish and maintain database on children in the barangay;
10. Advocates for the establishment and maintenance of playgrounds, day care centers and other
facilities necessary for child and youth development;
11. Advocate for the passage of barangay resolution/ordinances responsive to child-related issues and
concerns and ensure the inclusion of children’s program in the executive agenda;
12. Protect and assist children in need of special protection (abandoned, maltreated and dependents)
and refer cases filed against child abusers to proper agencies/institutions;
13. Monitor situational reports on children and prepare quarterly updates including the
implementation of children’s program and make recommendations to the city council for the
Protection of Children (CCPC) for consideration and nationwide applications; and
14. Perform such other child related laws especially in matters of child and parent education, health,
entertainment, ect.

SECTION 3. COMPOSITION. The membership of the Barangay Council for the Protection of Children is
hereby reconstituted as follows:

SECTION 4. SECRETARIAT. The secretariat shall be designated by the Chairperson of the Council from any
of the LGUS operating units, which shall provide administrative and technical support services to their
respective LCPC member agencies. The secretariat shall be responsible for providing technical support,
documentation of proceedings, preparation of reports, and such other assistance as may be required in the
discharge of its function. The secretariat shall be composed of the following:

SECTION 5. BUDGETARY SUPPORT. Appropriate budgetary funds shall be allocated for the operations of
the Council chargeable against the general Fund-Lump Sum appropriation while the implementation of
programs, projects and activities (PPAs) inclusive of PPAs stated in DILG MC No. 2012-120 which enjoins all
local Chief Executives to appropriate one percent (1%) of internal Revenue Allotment on Children PPAs as
planned by the BCPC.

SECTION 6. REPEALING CLAUSE. All Executive Order or issuances inconsistent with the provisions of this
executive order are hereby repeated or modified accordingly.

SECTION 7. EFFECTIVITY. This Executive Order shall take effect immediately.

RESOLUTION REORGANIZING/ RECONSTITUTED THE BARANGAY COUNCIL FOR THE


PROTECTION OF CHILDREN (BCPC) IN BRGY. LIPAY-DINGIN-PANIBUATAN, IBA,
ZAMBALES.

WHEREAS, Article XIII, Section 1(a) of the 1987 Philippine Constitution


states that the enactment of measures that protect and enhance the right of
the people to human dignity, reduce social, economic and political
inequalities and remove cultural inequities shall be given the highest
priority and consideration;

WHEREAS, the Constitution further provides under Section 2, Article II


thereof that the State values the dignity of every human person and
guarantees full respect for human rights;

WHEREAS, consistent with these constitutional precepts, Section 16 of


Republic Act No. 7160, as amended, otherwise known as the “Local
Government Code of 1991” mandates that the general welfare of the
Province and its inhabitants pursuant to general welfare clause;

WHEREAS, Article 87 of P.D. 603 (Child & Youth Welfare Code) “Every
Barangay Council shall encourage the organization of a Local Council for
the Protection of Children.”;

WHEREAS, DILG Memorandum Circular No. 2002-121, dated August 5,


2002 (Revised guidelines on the organization & strengthening of the Local
Council for the Protection of Children (LCPC) incorporating thereat Early
Childhood Care & Development (ECCD) Coordinating Committees at the
Provincial, City, Municipal and Barangay levels);

WHEREAS, Based on DILG-MC 2002-121, the Following are the prescribed

A RESOLUTION PROVIDING THE RIGHTS OF EVERY CHILD WITHIN THE VICINITY OF BARANGAY
LIPAY-DINGIN-PANIBUATAN, IBA, ZAMBALES.

WHEREAS, section 17 of republic Act 7160, also known as the Local government code of the
Philippines, mandates that the barangays shall endeavor to provide for an effective and efficient
provision of basic services and facilities which includes programs and projects for children and youth
welfare;

WHEREAS, republic Act 7610, otherwise known as the Special Protection of Children Against Child
Abuse. Exploitation and Discrimination Act, provides for stranger deterrence and special protection
against child abuse, exploitation and discrimination and its corresponding penalties;

WHEREAS, the Barangay Government of Lipay-Dingin-Panibuatan, Iba, Zambales recognizes that


children are important assets of society and it is only when children are able to exercise their rights
that they develop their full potentials;

WHEREAS, there is a need to codify the laws relating to children’s rights to apply particularly to the
Barangay Lipay-Dingin-Panibuatan, Iba, Zambales;

NOW THEREFORE, on motion of Co-chairman Jane D. Rabaja , duly seconded by member Cynthia Q.
Gonzales and with concurrence of all other members be it that:

SECTION 1. TITLE: This resolution shall be known as the “RIGHTS OF THE CHILD OF BARANGAY
LIPAY-DINGIN-PANIBUATAN, IBA, ZAMBALES”.

SECTION 2. PURPOSE:

a) To ensure that children’s rights and promote their welfare and development.
b) To ensure that children’s rights are given priority attention both in government and civil
society.

SECTION 3: RIGHTS OF THE CHILD.

a) Every child is entitled to survival, development, protection and participation rights without
distinction as to legitimacy, sex, social status, religion, political antecedents, and other
factors;
b) Every child has the rights to be born well, endowed with dignity and worth of a human
being from the moment of his or her conception;
c) Every child has the right to a whole some family life that will provide him or her with love,
care, and understanding, guidance and counselling and moral and material security. The
dependent or abandoned child shall be provided with the nearest substitute of a home.
d) Every child has the right to balanced diet, adequate clothing, sufficient shelter, proper
medical attention, and all the basic physical requirements of a healthy and vigorous life.
e) Every child has the right to a well rounded development of her of his personality to the end
that she or he may become a happy, useful and active member of the society specifically;

1.) The gifted child shall be given the opportunity and encouragement to develop her or his
special talents;
2.) The emotionally disturbed or socially maladjusted child shall be treated with sympathy
and understanding and shall be entitled to treatment and competent care;
3.) The physical or mentally disabled child shall be given treatment, education, and care
required by her or his particular condition.
f) Every child has the right to be brought up in an atmosphere of morality and rectitude for
the enrichment and the strengthening of her or his character;
g) Every child has the right to grow up as free individual in an atmosphere of peace,
understanding, tolerance and universal sisterhood/brotherhood and with the
determination to contribute her or his share in the building of a better world;
h) Every child has the right to quality education, primary education must compulsory and
higher education must be available and accessible to all the basic of capacity by every
appropriate means. The education of the child must be directed to;

1.) The development of the child’s personally, talents and mental and physical abilities to
the fullest extent;
2.) The preparation of the child for responsible adult life in a free society;
3.) The development of respect for the child’s parents, her or his cultural identity, language
and values, and the cultural background and values of others’
4.) The development of respect for the natural environment;

i) Every child has the right to full opportunities for the safe and wholesome recreation and
activities, individual as well social for the wholesome use of her or his leisure hours;
j) Every child has the right to live in a community and a society that can offer her or him an
environment free form pernicious influences and conductive to the promotion of her or his
health and cultivation of her or his desirable traits and attributes.

RESOLVED, to provide the rights of every child within the vicinity of Barangay Lipay-Dingin-
Panibuatan, Iba, Zambales.
RESOLVED FINALLY, to furnish copies of the resolution to all concerned citizens for their information
and guidance.

WHEREAS, presented before the council is the draft Barangay Council for the Protection of Children
(BCPC) Plan and Budget for fY 2023 of barangay Lipay-Dingin_Panibuatan, Iba, Zambales;

WHEREAS, after a through deliberation on the merit of the plan, and upon motion of HON. JANE D.
RABAJA, Committee chairman on Social Services, duly seconded by the majority, it was ;

RESOLVED, as it hereby resolve, to approve the Barangay Council for the Protection of Children
(BCPC) Plan and Budget for fy 2023 of barangay Lipay-Dingin-Panibuatan, Iba, Zambales and
endorsing the same to the sangguniang Barangay for adoption.

RESOLVED FINALLY, to forward this resolution the concern barangay councils for information and
guidance.

A RESOLUTION RECOMMENDING FOR APPROVAL THE FORMULATED ANNUAL WORK AND


FINANCIAL PLAN BY THE BARANGAY COUNCIL FOR THE PROTECTION OF CHILDREN (BCPC) TO
INCORPORATE IN BARANGAY ANNUAL INVESTMENT PROGRAM OF BARANGAY LIPAY-DINGIN-
PANIBUATAN, IBA, ZAMBALES;

WHEREAS, executive Chairman Victor S. Buenaventura and members formulate stout and effective
work and financial plan for endorsement to sangguniang barangay to include in Annual investment
Program of barangay for calendar year 2024;

WHEREAS, DILG MC No. 2002-121 encourage the LGU’s to organize/reorganize their respective
LCPC’s/BCPC’s pursuant to R.A. No. 4881 and 8980 and Presidential decree No. 603 as amended. The
LCPC/BCPA shall responsible in planning and spearheading programs for children at the
local/barangay level with the end in view of making the locality child friendly;

WHERAES, after through study and deliberation the committee desire to include the following
programs, projects and activities in formulating annual investment program of barangay, to wit.

A RESOLUTION APPROVING THE BARANGAY COUNCIL FOR THE PROTECTION OF


CHILDREN (BCPC) ACTION PLAN OF BRGY. LIPAY-DINGIN-PANIBUATAN, IBA,
ZAMBALES.

WHEREAS, it has been agreed by the Sangguniang Barangay Members of this Barangay
Session dated January 15, 2022, approving the Barangay Council for the Protection of
Children (BCPC) Action Plan of Barangay Lipay-Dingin-Panibuatan, Iba, Zambales.

WHEREAS, Article 87 of the Presidential Decree 603 (Children and Youth Welfare Code)
states that, “Every Barangay Council shall encourage the organization of a Local Council
for the Protection of Children (LCPC) and shall coordinate with the Council for the welfare
of Children (CWC) in drawing and implementing plans for the promotion of child and youth
welfare”;

WHEREAS, it helps to protect and assist children in need of special protection, and refer
cases filed against child abusers to proper agencies; Monitor situational reports on
children, prepare quarterly updates; and perform such other functions and other related
laws especially in matters of child and parent education, health, entertainment.

NOW THEREFORE, on motion of HON. CYNTHIA Q. GONZALES, BARANGAY KAGAWAD,


Committee on Women and Family Affairs, duly seconded by the rest of the body the
Barangay Council for the Protection of Children Action Plan has been approved by the
body,

BE IT, RESOLVED FURTHER, the copies of this Resolution shall furnished to the other
concerned for their information appropriate action approve unanimously, January 15, 2023.
