EXECUTIVE ORDER NO. 2


Series of 2023

AN ORDER REORGANIZING AND RECONSTITUTING THE BARANGAY COUNCIL FOR THE


PROTECTION OF CHILDREN (BCPC) OF BARANGAY 31 CENTRO-BAYBAY, LEGAZPI CITY

WHEREAS, the United Nations Convention on Rights of the Child (UNCRC) provides fundamental
basis of the Philippine Government’s vision for a “Child-Friendly, caring and protective society for, by and with
the Children”;

WHEREAS, the Philippine Government’s ratification on the United Nations Convention on the Rights
of the Child (UNCRC) in 1990 has made it imperative for all sectors of the society to translate its provisions
into concrete actions that will lead to the fulfillment of Filipino children’s rights to survival, development,
protection, and participation;

WHEREAS, Republic Act 7160 also known as the Special Protection of Children Against Child Abuse,
Exploitation and Discrimination Act, provides for stronger deterrence and special protection against child
abuse, exploitation and discrimination and its corresponding penalties;

WHEREAS, Article 359 and 360 of the Civil Code of the Philippines, provides that the government
shall establish a Council for the Protection of Children”;

WHEREAS, Article 87 of Presidential Decree 603 (Children and Youth Welfare Code) states that there
is a need to organize the Local Council for the Protection of Children (LCPC) not only at the barangays but also
in all levels of the Local Government Units to ensure synchronization and integration of policies, programs and
projects for children;

WHEREAS, Presidential Executive Order No. 310 series of 2000, “Adopted the Philippine National
Strategic Framework Plan Development for Children, 2000 – 2025 or Child 21” which is holistically looks and
attends to the needs of the child using the life-cycle approach of development;

WHEREAS, DILG Memorandum Circular No. 2002-121 dated August 5, 2002 enjoins all Local Chief
Executive (LCEs) to organize/reorganize Provincial/City/Municipal Council for the Protection of Children and
take lead in the implementation of all children’s programs in their respective localities;

WHEREAS, the Department of the Interior and Local Government (DILG) has issued Memorandum
Circular No. 2008-126 which provides the revised guidelines in monitoring the functionality of the Local
Council for the Protection of Children;

NOW THEREFORE, I, TERESITA L. EMPIG, Punong Barangay of Barangay 31 Centro-Baybay,


City of Legazpi by virtue of the powers vested in me by laws, do hereby reorganize the Barangay Council for
the Protection of Children (BCPC) pursuant to DILG MC No. 2002-121 dated August 5, 2002:

Section 1. The composition of the Barangay Council for the Protection of Children (BCPC) are as
follows:

Section 2. Duties and Functions. The BCPC shall perform the duties and functions in as follows:

1. Formulate plans, programs and policies for the children that are gender-fair culturally relevant and
responsive to the needs of diverse groups of children ages 5 and below;
2. Prepare AWFP for children and recommend appropriations to the Sanggunian;
3. Establish and maintain database on children in the barangay;
4. Foster education of every child;
5. Advocate for the establishment and maintenance of playgrounds, day care centers and other facilities
necessary for child and youth development;
6. Recommend local legislations promoting child survival, protection, participation and developments,
especially on the quality of television shows, media prints and coverage, which are detrimental to
children and with appropriate funding support;
7. Assist children in need of special protection and refer cases filed against child abusers to proper
agencies/institutions;
8. Conduct capability building programs to enhance knowledge and skills in handling children’s programs;
9. Document Barangay programs for children;
10. Monitor and evaluate the implementation of the programs and submit quarterly status reports to CCPC;
11. Perform such other functions as provider for the ECCD and other child related laws;

Section 3. Secretariat. The Secretariat shall be designated by the Chairperson of the Council from any
of the LGUs operating units, which shall provide administrative and technical support services to their
respective LCPC member agencies. The Secretariat shall be responsible for providing technical support,
documentation of proceedings, preparation of reports, and such other assistance as may be required in the
discharge of its functions. The Secretariat shall be composed of the following:

Section 4. Budgetary Support. Appropriate budgetary funds shall be allocated for the operations of the
Council chargeable against the General Fund – Lump Sum appropriation while implementation of programs,
projects, and activities (PPAs) inclusive of PPAs stated in DILG MC No. 2012 – 120 which enjoins all Local
Chief Executives to appropriate one percent (1%) of Internal Revenue Allotment on Children PPAs as planned
by the BCPC.
Section 5. Repealing Clause. All Executive Orders or Issuances inconsistent with the provisions of this
Executive Order are hereby repealed or modified accordingly.

Section 6. Effectivity. This order shall take effect immediately.
