“LEAVE AND LICENSE AGREEMENT”

THIS AGREEMENT OF LEAVE AND LICENSE IS MADE AND ENTERED


INTO AT MUMBAI ON THIS _______ DAY OF 22th MARCH, 2024, DIST.
MUMBAI STATE OF MAHARASHTRA.

BETWEEN

MR. RAJARAM T.GAWADE Hindu, Adult, Aged about 66 years, Hanuman


Nagar ,Pump House,Jijamata Marg Andheri (East),Mumbai-400093 hereinafter
called as the ‘LICENSOR’

(Which terms and expression shall unless it be repugnant to the context or meaning
thereof shall be deemed to include his heirs, administrators, assigns and etc.)
“PARTY OF THE FIRST PART”

1. Ms.RESHMA R. DSOUZA Hindu, Adult, Aged about 34 years, Hanuman


Nagar ,Pump House,Jijamata Marg Andheri (East),Mumbai-400093,
hereinafter called as the ”LICENSEE” (Which terms and expression shall it
be repugnant the context of meaning thereof shall be include her heirs,
executors, administrators, assigns and etc.) “PARTY OF THE SECOND
PART”.
AND WHEREAS the party of the second part, Licensee is in need of temporary
requirement of accommodation for residence purpose of the said property for
period of 11 months, and the Licensor has agree to allow to the Licensee to use the
above said property for residence purpose for the period of 11 Months from
22.03.2024, this agreement effected from 22.02.2025 on Leave and License basis
for residential purpose and therefore He has approached and requested the party of
the first part, to allow him to use with his own family for the temporary period of
11 Months. The said property hereinafter referred as the said premises on Leave
and License basis for a period of 11 months.

AND WHEREAS the party of the first part have agreed to comply with the request
of the party of the second part, to grant him Leave and License to use and occupy
the said premises. The said property for a period of 11 months on the terms and
conditions into writing.

NOW IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES AS


FOLLOWS:-

1. That in consideration of the stipulation herein described that the observance,


of the terms and conditions, on the party of the first part, hereinafter
contained and agreed by the party of the second part to do hereby and grant
permission to the party of the second part, to use and occupy the said
property for a period of 11 months only commencing from 30th day of
march 2024, which facility shall expire on 30th day of feb, 2025 as agreed.

2. That the party of the second part, Licensee has deposited an amount of Rs.
20,000/-( Twenty Thousand Only) to the party of the first part, Licensor as
a security for any damages sustained to the above said property which is
refund by the party of the first part, Licensee without any interest at the time
of expire of the said agreement.

3. The Licensee has agreed to pay monthly compensation a sum of Rs. 4,000/-
(Four Thousand Only) excluding electricity and water charges in respect of
the above said property, to the party of the first part, Licensor for the use
and occupation of the said property on or before 15 th of every calendar
month.

4. That the party of the second part, Licensee fails to pay monthly
compensation a sum of 2,500/- (six Thousand Five Hundred Only) for the
any of the month for said agreement period to the party of the first part,
Licensor, licensor has right to recover that monthly compensation amount
from security deposit and Licensee has agreed for the same

5. Licensee shall pay Water charges & Electricity charges as per monthly
consumption which is decided by both parties or if any kind of dues
pertaining to flat any of pending due will be recovered from security deposit
and Licensor shall pay Maintenance charges & House Tax in respect of
above said property.

6. That the Licensor hereby grant to the Licensee to use and occupy the said
property premises for the period of 11 months commencing from 30th day
of feb 2025, which facility shall expire on 30th day of feb, 2025, for
residential purpose of the Licensee and after termination of the License the
Licensee shall handover vacant, physical, peaceful possession of the said
premises to the Licensor.

7. That the Licensee shall vacant the above said property as per agreement
and after the expiry of the period.

8. That the party of the second part, Licensee shall not store any hazardous,
inflammable or any other objectionable articles which are prohibited by law
of contrary in the said premises.

9. That the party of the second part, Licensee shall keep the said property in
clean & hygienic condition and shall not do any act which be a nuisance to
society members.

10.That the Licensee shall not let, sub let, or create any third party interest and
shall not do any illegal activities any contraband or inflammable materials in
the said property during the period of this agreement.

11.This agreement shall be for the period of 11 months only and effected from
the date of this Agreement.

12.The Licensee shall not claim any right of ‘tenancy, sub, tenancy or shall not
mortgage property to any one or shall not sale portion of property to any one
and shall not allow any other person and the Licensor shall at any time visit
for inspection in the said property premises for which the Licensee or any
one through him shall not object the same.

13.That the Licensee, his heirs, family members, executors, administrators,


relatives, have no any right, tenancy, right , title, claim over the said
property and none of the claim in any civil or criminal courts of law.

14.That it is agreed between both the parties after the expiry of the license
period, if both the parties’ wishes to renew for the further period of 11
months in that case the Licensor can be renew further 11 months periods.

15.That the said property having been given on Leave and License basis only,
the party of the second part, Licensee shall not deal with any manner
whatsoever and shall not part with the possession of the said property under
any circumstances to any person or persons whatsoever.

16.That the party of the second part, Licensee shall not take any loan or
advance from any Bank, Financial Institution, Private Financer and other
party or person on this said property.

17. That the party of the second part, Licensee shall not do any repairs or
alteration of the said property without the permission of the Licensor.

18.That the party of the first part, Licensor are not liable for any damage for
injury to any person whatsoever by fire, rain, damage, leakage, breakage or
bursting of electricity in the said premises or giving way of any portion of
the flooring, wall roof of any part of the said property or any other cause
whatsoever.

19.The Licensee shall not give the aforesaid property or any part of the above
said property to any other person for the use.

20.That the party of the second part, Licensee should not do any nuisance to
any society people: he could not create an disturbance by his residence to the
society and its members.

21.That the party of the second part, Licensee shall do reside in my said
property as per the rules and regulation of the local authority, Govt.
Authority and society etc.

22.That the party of the second part, Licensee shall be bound, to observe and
perform every all term and conditions on this Agreement, if the Licensee
failed at any time, during subsiding of this Agreement the Licensor/Owner
shall withdraw the License granted to the Licensee for the use and
occupation of the said property, forthwith and terminate this agreement
before the expiry of 11 months and further subject the Licensee from the
said property of the aforesaid mentioned, hereinabove without performing
the legal remedy or without going to court of law. After expire of period of
Licensee shall handover, vacant, physical peaceful possession to the
Licensor.

23.And it is hereby agreed and admits between the parties that if they desire to
vacate the said property the desiring party will have to give One-Month
Notice in writing to each other

24.While the termination/expiration of the date of this Agreement, the Licensee


shall give vacant peaceful possession of the said property to the Licensor
Licensee while vacating his belongings from the said property if any
damages occur to society property Licensee needs to fix the same if not then
same cost will be recovered from security deposit and clear all the dues.

25.That both the parties have read over and understood all the contents of this
agreement and have signed the same without any force or pressure from any
side.

IN WITNESS WHERE OF THE PARTIES TO THESE PRESENT HAVE


HEREUNTO SET THEIR RESPECTIVE HANDS ON THE DAY, MONTH
AND YEAR FIRST PARA HEREINABOVE WRITTEN.

RECEIVED from Ms.RESHMA R. DSOUZA (Aadhar no. 569113241846 ) as sum
of Rs.2,500/- (Two Thousand Five Hundred Only) by cash being security deposit
amount for use and occupy of the said premises as per this agreement in the
presence of witnesses.
