A. SIGNIFICANCE OF FREEDOM AND
PRIVACY OF CORRESPONDENCE

 Anyone may not conceal, destroy and


discard, open and read or eavesdrop
citizens’ correspondence (including
telegraph, telephone, mail and other
lawful electronic contacts).
B. LEGAL PROTECTION OF FREEDOM AND

 Freedom and Privacy of correspondence
It guarantees that the content of sealed letters is never revealed, and
letters in transit are not opened by government officials, or any other third
party. 

 Legal protection
 COPYRIGHT definitely does apply to personal correspondence and private
records such as diaries and family photographs.

*The Philippine copyright law also protects trademarks, patents and even
various forms of intellectual property. You might have also heard about the
Optical Media Act, which aims to protect local artists against piracy. 
 State security or criminal investigation
Copyright protection rules are fairly similar worldwide, due to
several international copyright treaties, the most important of which
is the Berne Convention. Under this treaty, all member countries must
afford copyright protection to authors who are nationals of any
member country. 

 Public security or procuratorial` organs are permitted to censor


correspondence in accordance with procedures prescribed by law

No organization or individual may, on any ground, infringe


upon citizens freedom and privacy of correspondence.

D. LEGAL LIABILITY FOR INFRINGEMENT UPON
CITIZENS' FREEDOM OF CORRESPONDENCE

 Administrative liability
The imposition of administrative fines in such amount as
deemed reasonable by the Director of Legal Affairs, which
shall in no case be less than Five thousand pesos (P5,000) nor
more than One hundred fifty thousand pesos (P150,000). In
addition, an additional fine of not more than One thousand
pesos (P1,000) shall be imposed for each day of continuing
violation.
CRIMINAL LIABILITY
 Anyone who conceals, destroys and discards or unlawfully
opens another person's letter, thus infringing upon the
citizen's right to freedom of correspondence, shall be
sentenced to fixed-term imprisonment of not more than
one year or criminal detention if the circumstance is
serious.
 Any postal worker who opens, or conceals or destroys and
discards mails or telegrams without authorization shall be
sentenced to fixed-term imprisonment of not more than
two years or criminal detention.
