ＮＨＫが受信契約を結ばない男性に支払いを求めた訴訟で、最高裁大法廷（裁判長・寺田逸郎長官）は６日、テレビがあればＮＨＫと契約を結ぶ義務があるとした放送法の規定は「合憲」とする初めての判断を示した。事実上、受信料の支払いを義務づける内容だ。男性は受信契約を定めた放送法の規定は「契約の自由」を保障する憲法に違反すると主張したが、最高裁は男性の上告を退けた。 判決は、ＮＨＫからの一方的な申し込みでは契約や支払い義務が生じず、双方の合意が必要としたが、ＮＨＫが受信料を巡る裁判を起こして勝訴すれば、契約は成立する、と指摘した。 争われたのは、２００６年３月、自宅にテレビを設置した男性のケース。ＮＨＫは１１年９月、受信契約を申し込んだが「放送が偏っている」などの理由で拒まれ、同年１１月に提訴した。 １９５０年制定の放送法の規定は「受信設備を設置したらＮＨＫと契約しなければならない」と定める。この解釈に
