material com o qual ele trabalhava levou seus pulmões a se petrificarem,
pouco a pouco. Ele, que era um suíço alto, forte e extremamente culto,
estava, mesmo no auge da doença, lúcido, e queria viver, mas seus pulmões não permitiram. Foi um fim de vida sofrido. E foi muito difícil vê-lo morrer, lentamente, naquele quarto pela frente do qual eu desejava passar correndo – me sentindo, claro, culpada – e que parecia oprimir a casa inteira. Eu não era muito próxima do meu avô, porque ele nunca se fez muito presente na vida do meu pai. De vez em quando ele vinha em casa, me levava ao museu, jantava com a gente, e até passava a noite, mas nossa relação não passava muito disso. O que foi difícil foi ver a morte ali, de perto, dia a dia, pouco a pouco, e o sofrimento, a troca de enfermeiros, e o meu pai tendo que lidar com aquilo tudo, com tanta mágoa e, ao mesmo tempo, amor. Eu mal ficava em casa naquela época.
Com a minha bisavó, o cenário foi totalmente diferente. Apesar de sua difícil história de vida, ela sempre se fez extremamente presente. Aos dois anos de idade, Cleonice perdeu sua mãe e, dos cinco aos quinze anos, viveu em um colégio interno. Já adulta, em uma época em que certas coisas eram impensáveis, Nice foi abandonada pelo marido, após acompanhá-lo em sua carreira na magistratura, durante anos, por incontáveis cidades no interior; mais tarde, perdeu uma filha, assassinada por um primo, que não aceitou o término do relacionamento entre eles. E, ainda assim, ela sempre se esforçou para ser feliz, e, diga-se de passagem, acho que conseguiu. Quando ela já estava bem velhinha, não lembrava de mim nem de meu irmão, mas se alegrava extremamente quando contávamos para ela que éramos seus bisnetos. Mesmo sem a lucidez de outrora, era extremamente apegada à vida e não queria morrer de jeito nenhum. Algumas questões suscitadas no livro são particularmente difíceis para mim, por me lembrarem tanto dela...
Da minha tia-avó Maria Júlia, cunhada da minha bisa, nunca fui particularmente próxima. Mas o final da sua vida foi tão triste, e tão cruel, que ficou gravado em minha memória. Viúva desde muito jovem, Lili, como era conhecida, trabalhou como professora durante anos, profissão que ela adorava. Ao final da vida, entretanto, se viu deixada em um asilo. Poucos meses após chegar àquele lugar, tia Lili morreu.
Me lembro daquela casa de repouso como se fosse ontem: no dia da
minha visita, os idosos estavam largados em uma sala, em círculo, cada
um em uma cadeira, com suas cabeças pendendo para baixo; havia uma
infestação de abelhas no quintal, de modo que as portas estavam fechadas, tornando o ambiente ainda mais opressor; as cuidadoras roubavam os presentes que os internos recebiam de seus familiares – eu cheguei a levar um chocolate para tia Lili mas, antes que me despedisse dela, ele já havia sido levado – e as bananas, que eram a sobremesa oferecida no almoço, eram entregues ainda com casca, largadas em uma bandeja. Estranho como esses pequenos detalhes marcam. Eu a visitei naquele lugar apenas uma vez, e lembro de ter sentido uma tristeza profunda.
Esse livro é sobre todas essas pessoas, e sobre nenhuma delas. É sobre a velhice, sobre a morte, sobre a doença, sobre o tempo, sobre a
liberdade, sobre a democracia e sobre a diversidade. Em cada reflexão e
em cada leitura, levei comigo as pessoas que perdi.

Este livro de autoria coletiva, intitulado Autonomia, Dignidade e Deficiência, reúne trabalhos re... more Este livro de autoria coletiva, intitulado Autonomia, Dignidade e Deficiência, reúne trabalhos realizados na área dos Estudos de Deficiência sob a orientação da Professora Ana Paula Barbosa-Fohrmann, no âmbito do Núcleo de Pesquisa sobre Discursos Teóricos de Direitos Humanos (NTDH) da Faculdade Nacional de Direito da Universidade Federal do Rio de Janeiro (FND-UFRJ) e do Programa de Pós-graduação em Direito da UFRJ. Sua relevância se manifesta na premência que a deficiência tem assumido em investigações filosóficas e jurídicas sobre três valores baluartes: dignidade, autonomia e justiça. Tratada como um caso marginal ou instrumentalizada como uma prova de teste para teorias da justiça que buscam provar sua consistência teórica e seu potencial inclusivo, a deficiência tem desestabilizado crenças e tensionado epistemologias. Especialmente ─ mas não só ─ as manifestações vivenciais rotuladas como deficiências intelectuais, psicossociais, mentais e cognitivas foram, quando não excluídas, marcadamente estereotipadas no âmbito dos três eixos investigativos que orientam este livro. Em sentido diverso, durante os últimos anos, buscamos, em nossas produções, compreender as matrizes de tais flagrantes silêncios e preconceitos, posicionando a deficiência como ponto de partida para a análise de nossos três fios condutores. Nesta coletânea, dando fim a algumas vias de investigação e início a outras, o mesmo ânimo se fez presente. Nesse sentido, para que o leitor vislumbre algumas indagações que conduziram as discussões e reflexões concretizadas nos trabalhos ora publicados, destacamos alguns problemas centrais que nos guiaram e inquietaram: “são pessoas com deficiências ─ sobretudo aquelas consideradas graves ─ sujeitos de justiça?”; “ tais pessoas merecem menor status moral do que seus pares sem deficiência?”; e “como promover o reconhecimento moral e jurídico de sujeitos frequentemente apontados como desprovidos de autonomia?”.

Ante o acentuado desenvolvimento tecnologico e cientifico ocorrido a partir da segunda metade do ... more Ante o acentuado desenvolvimento tecnologico e cientifico ocorrido a partir da segunda metade do seculo XX, a expectativa de vida sofreu um significativo aumento e, para alem dos indiscutiveis beneficios trazidos pela medicina para a saude das pessoas, ha de se debater, tambem, as novas questoes bioeticas que surgem com este avanco, que vem possibilitando aos pacientes terminais e incuraveis um extenso periodo de sobrevida, de modo artificial e por tempo indeterminado. Nesse contexto, passa a ser cada vez mais comum que os pacientes decidam que preferem morrer a viver de maneira que nao considerem digna. Passam, entao, a recusar tratamentos, ou pedem o auxilio de terceiros para sua morte. Por meio da pesquisa eminentemente bibliografica nacional e estrangeira, e da analise critica da doutrina, de fontes oficiais de legislacao, documentos, casos praticos, decisoes jurisprudenciais e outras fontes confiaveis, a finalidade da presente dissertacao e verificar quais direitos fundamentais devem prevalecer no debate acerca do direito a morte digna, como o ordenamento juridico patrio regulamenta, atualmente, as diferentes praticas relacionadas a autonomia para morrer, entrar em contato com as decisoes politicas de outros paises a respeito de tais praticas, debater questoes dificeis do ponto de vista juridico, filosofico e moral, e tentar afastar os argumentos comumente utilizados por aqueles que se opoem a existencia de uma autonomia para morrer. No Capitulo 1, delimitaremos os diferentes conceitos utilizados quando se discute a morte digna, como a eutanasia e suas diversas classificacoes e derivacoes, o suicidio assistido, a distanasia (ou obstinacao terapeutica), os cuidados paliativos, e as diretivas antecipadas de vontade. No Capitulo 2, discutiremos quais sao os direitos fundamentais em jogo quando se trata da autonomia para morrer. No Capitulo 3, analisaremos como o ordenamento juridico brasileiro trata as praticas relacionadas a autonomia para morrer e, ainda, como isso se da no direito comparado. No Capitulo 4, tendo em maos todas as ferramentas adquiridas nos capitulos anteriores, buscaremos responder a questoes dificeis, por meio da analise de casos praticos e, ao final, levantaremos e tentaremos afastar alguns dos argumentos mais frequentemente utilizados por aqueles que se opoem a existencia de um direito a morte digna

O objetivo do presente artigo é verificar como se dá a participação política de pessoas com defic... more O objetivo do presente artigo é verificar como se dá a participação política de pessoas com deficiências nos quadros teóricos de John Rawls, Philippe van Parijs e Ronald Dworkin, analisando-se em que medida tais pessoas podem ser consideradas cidadãs. Nesse sentido, indaga-se até que ponto um indivíduo com deficiência em termos gerais e, mais especificamente, com deficiência cognitiva ou psicossocial, pode ser considerado, nos referidos quadros teóricos, destinatário da distribuição de justiça por meio do princípio da diferença e do mínimo social em Rawls, do princípio da solidariedade da renda básica universal incondicionada em Parijs, e dos princípios da igualdade material e da fraternidade em Dworkin. Como conclusão, constatar-se-á a possibilidade de se fazer uma leitura inclusiva de suas teorias, de um modo a abarcar pessoas com quaisquer tipos de deficiências.

The Brazilian Holocaust was a tragedy that took place at the Hospital Colônia de Barbacena betwee... more The Brazilian Holocaust was a tragedy that took place at the Hospital Colônia de Barbacena between the 1930’s and the 1980’s, killing over 60,000 people due to hunger, malnutrition, open sewage, the cold, medical experiments gone wrong, severe punishments, and diseases, only coming to an end with the Psychiatric Reform in Brazil, which took place in the last decade of the twentieth century. With this in mind, we will tell the story of Luizinho, Corporal and Conceição – three patients who were victimized by the Colony –, analysing, after, the bodies that exerted their powers over them inside Barbacena, from a Foucauldian standpoint. We will verify, next, how legislation and practices regarding the care and perception of people who are suffering psychologically changed over time and, finally, the state of psychiatric institutionalization in Brazil today.

the framework of the utilitarian consequentialism), and Tom Regan and Christine Korsgaard (who work within the Kantian deontological framework), since the mentioned authors propose reformulations in the way we perceive nonhuman animals both legally and morally, but choose different philosophical paths,
coming to conclusions that differ in important respects. Bearing
this in mind, we sought, in our analysis, to verify what are the
philosophical influences and bases adopted by each one, and
what are their positions regarding, for instance, (i) the possibility
or impossibility of speaking in terms of animal rights; (ii) what
the moral status of nonhuman animals is and why; (iii) how to
solve conflicts between human and nonhuman animal’s
rights/interests when they arise, etc.

Me lembro daquela casa de repouso como se fosse ontem: no dia da
minha visita, os idosos estavam largados em uma sala, em círculo, cada
um em uma cadeira, com suas cabeças pendendo para baixo; havia uma
infestação de abelhas no quintal, de modo que as portas estavam fechadas, tornando o ambiente ainda mais opressor; as cuidadoras roubavam os presentes que os internos recebiam de seus familiares – eu cheguei a levar um chocolate para tia Lili mas, antes que me despedisse dela, ele já havia sido levado – e as bananas, que eram a sobremesa oferecida no almoço, eram entregues ainda com casca, largadas em uma bandeja. Estranho como esses pequenos detalhes marcam. Eu a visitei naquele lugar apenas uma vez, e lembro de ter sentido uma tristeza profunda.

coming to conclusions that differ in important respects. Bearing
this in mind, we sought, in our analysis, to verify what are the
philosophical influences and bases adopted by each one, and
what are their positions regarding, for instance, (i) the possibility
or impossibility of speaking in terms of animal rights; (ii) what
the moral status of nonhuman animals is and why; (iii) how to
solve conflicts between human and nonhuman animal’s
rights/interests when they arise, etc.
The purpose of this article is to (i) draw a historical overview of the treatment of disabled individuals, using Michel Foucault’s work as a theoretical framework; and (ii) through an exploratory and inductive methodology, analyse some cases in which the discussion regarding psychiatric institutionalization in Brazil gained space, verifying three examples of the Public Ministry’s practice in that field, namely by (a) elaborating investigative reports about the situation of hospitalized people; (b) working in the case Ximenes Lopes versus Brazil; and (iii) elaborating an extrajudicial agreement in the municipality of Sorocaba (SP).
