Evaluasi akan proses pembentukan Undang-Undang menjadi salah satu hal dasar yang sering dikesampingkan tatkala membahas hak asasi manusia. Proses pembentukan yang aspiratif, partisipatif dan tidak menegasikan masyarakat dalam proses, merupakan dasar terciptanya norma hukum yang ideal. Hal tersebut tidak lepas dari posisi Undang-Undang sebagai wadah dijamin, diatur, dan dituangkannya pelaksanaan hak asasi manusia (HAM), sehingga pembentukan undang-undang yang transparan dan aspiratif menjadi kebutuhan. Alhasil, Undang-Undang yang dihasilkan berperan sebagai alat perlindungan dan penegakan HAM.
Undang-Undang sebagai salah satu instrumen HAM, menjadi bagian yang penting dalam proses Pemajuan HAM. Hal tersebut selaras dengan prinsip negara hukum yang demokratis, yakni dengan mengatur, menjamin dan dituangkan dalam Peraturan Perundang-undangan. Upaya untuk menjaga agar Undang-Undang tetap berada di jalur yang tepat sebagai instrumen penegakan dan perlindungan HAM merupakan ranah kerja yang luas dan menantang. Kajian tentang kinerja legislasi (pembentukan Undang-Undang) dilakukan dengan menimbang cita hukum yang luput dalam proses legislasi. Sejalan dengan itu, perlunya kajian legislasi yang menempatkan konsep HAM sebagai ukuran sekaligus capaian ideal perlu untuk dikembangkan.

The earthquake and liquefaction in 2018 in Palu City, Central Sulawesi, Indonesia, caused thousands of casualties and property. This incident reminds us that we have forgotten the local wisdom of the Kaili Tribe, who have lived for hundreds of years in disaster-prone areas with Toponym and Kayori. We use qualitative methods with interviews and questionnaires, observation, and literature studies. One hundred Kaili people in Palu City are respondents in interviews and questionnaires, using purposive sampling taken at random. Apart from that, for supporting data, the team obtained from journals, books, and laws and regulations. The first sub-section of the book chapter discusses the existence of the Kaili Tribe in Palu City, and the second sub-chapter explores community wisdom in the form of Kayori, Toponym, and traditional houses. Discussion of the third sub-chapter is regarding recognizing the Kaili Tribe in disaster management legislation and policies. This study concludes that the Kaili people have cultural values that are adaptive to natural disasters through Kayori (oral poetry), toponymy (regional naming based on historical records), and earthquake-resistant traditional houses on stilts. In formal recognition, cultural heritage has been regulated in regional regulations related to conventional institutions. This research aims to find an ethical relationship between corruption, corruption  eradication and human rights in the context of the Covid-19 pandemic in Indonesia. This research uses a qualitative approach. Data was collected through literature study and interviews. The findings of the research indicate that, corruption affects the fulfillment of basic needs of the community, in the context of the pandemic it has a deeper impact on the quality of meeting the basic needs of the community. Simultaneously, anti-corruption with the spirit of retributive justice that uses interception is considered quite effective. debate use of interception in the anti-corruption as a human rights violations, can be ravel by looking back at the principles of proportionality and legal protection. while to prevent of abuse of interception authority, appropriate mechanisms are needed. It can be seen that the spirit of retributive justice in anti-corruption reciprocates the impact of corruption on human rights. The complexities of land and natural resource cases involve multiple stakeholders ranging from the government and security forces to corporations. The conflicts that drive these cases are reflected in the Indonesian Commission on Human Rights data and in complaints from civil society. One contributing issue is driven by regulatory factors in the agrarian sector that is not in line with international human rights principles and norms. The analysis of these problems will be described in three discussions: one identifying the meaning of agrarian followed by a model for internalizing human rights instruments and principles in domestic regulations, and one affirming the responsibilities of the State and of corporations in the business. This research aimed to analyze the relation between judicial review with lawmaking function. Subject was studied by the development and implementation of judicial review with lawmaking function. This research was a normative legal research explanatory, which intends to obtain a better understanding of the symptoms of a particular law, in the relationship judicial review with lawmaking function. Several approaches were used to examine the legal issue which were the statutory approach, historical approach and the conceptual approach, which was used to solve the legal issues as well as peeling explanatory nature. Furthermore, the analysis leads to the syllogistic analysis and interpretation techniques. Bersamaan dengan itu Putusan MK No.75/PUU-XII/2015 yang menguji frasa “kurang lengkap..” Pasal 20 (3) UU Pengadilan HAM, menegaskan bahwa bolak balik berkas, merupakan implikasi dari masalah dalam penerapan norma dalam praktik. For this reason, the principles of legality and prudence as a form of control over government actions need to offset the urgency of tapping. The issue of person with disability in indigenous peoples is closely related to issues pertaining to enjoyment of social development as well as inclusive citizenship. Indigenous peoples face potential discrimination and exclusion from every social development from every aspect of life. This condition becomes more vulnerable if it occurs in persons with disabilities. The issue of disability discrimination in indigenous peoples, still often neglected in the environment of its own community, as well as in larger systems of society and state. The areas of Toraja, and Bali, were focused on for this research and taken for their larger representation. Facts and analyses collected through this research demonstrate that indigenous persons with disabilities face various layers of discrimination and violations of gender and disability status. The characteristics of indigenous peoples determine the treatment of persons with disabilities within specific communities. Most noticeable is the lack of friendly service for persons with disabilities in their own societies. Therefore, people with disabilities in indigenous communities deserve greater and more accessible opportunities to participate in customary institutions and emancipation beyond the scope of protection and the fulfilment of rights by the government.

The current development paradigm is still dominated by the neoclassical economic perspective which sees economic development as a mechanical and simplistic process, without the need to look at aspects of respect, protection, and fulfillment of human rights, although, human rights is the first state responsibility of government. As a result, human rights are not the focus of development policy-making. Human rights and development have a mutually reinforcing relationship that will direct the efforts towards a higher quality of development.On this basis, this study shines a spotlight and examines the management of regional development planning with a human rights basis. To get an idea of the reality, researchers use three areas as a sample, namely: Batang (Central Java), Trenggalek (East Java), and Tanjungpinang (Riau Islands). Existing practices are examined with a human rights-based approach, namely: the formulation process, main content, implementation mechanisms, and protection and restoration. Furthermore, a descriptive qualitative approach is selected to describe the process, understand the nonconformities as well as identify the planning process and the implementation of the development plan. For that, primary data collection is done through interview techniques, focused discussions, and field observation. While for secondary data collection through a literature study. The study shows that the fulfillment of the right to healthcare, education, and food has become priorities in regional development planning. A more transparent and accountable planning approach also opens opportunities to make human right-based development planning as the mainstream. The prerequisites driving factors lie in the dynamics of regional regulation and the commitment of the regional heads with the vision and mission outlined in the RPJMD, including a commitment to maintain a transparent, accountable and clean bureaucracy. In conclusion, the transparent planning approach in the RPJMD needs to be balanced by using human rights standards to improve the quality of human development in the region.

It is characterized by Verdict Judicial Review as improvised to address the lack of implementation mechanism of Verdict Judicial Review. Meanwhile, after verdict Judicial Review, norm grows on the paper and it is difficult to have binding force. One of the ways to strengthen norm is by distinguish the strength of binding norms between parties and public. In line with the efforts to reduce the friction between those two is made by completing an alternative access in Judicial Review. Meanwhile, the integration of the analysis of the impact, benefits and costs in the process of the Law Making Function is a complement to the follow-up mechanism of Verdict Judicial Review.

Abstrak Perkembangan dan pelaksanaan hubungan antara Pengujian Undang-Undang dengan pembentukan undang-undang mengarah kepada friksi berupa lahirnya anomali putusan Pengujian Undang-Undang yang berbenturan terhadap praktik pembentukan undang-undang yang berlaku. Ketiadaan mekanisme tindak lanjut putusan yang membatalkan norma dalam sebuah Undang-Undang, menyebabkan lahirnya anomali putusan. Friksi hubungan Pengujian Undang-Undang dengan pembentukan undang-undang lahir dalam bentuk samar dan semu dengan ketiadaan mekanisme tindak lanjut. Upaya untuk mereduksi friksi di antara keduanya dilakukan untuk mencapai hubungan ideal antara Pengujian Undang-Undang dengan pembentukan undang-undang
