Moreover, by openly criticizing public officials and the political system itself, as well as by merging political engagement with professional acting, jurists introduce non-legal, particularistic subjects in the legal system. They may also trade their actions for long-term group benefits. Considering the context and aftermath of Operation Car Wash, it is possible to discern that the jurists’ attitudes toward the law and politics exert impact on the assessment of the legitimacy of the exercise of power expressed in surveys measuring the trust in democracy. Within this framework, we argue that, by presenting themselves as agents of legality while simultaneously violating the law, jurists contribute to the deepening of the political-institutional crisis. By analysing the relationship between NGOs, the UNSC and human rights, this book argues that both... more By analysing the relationship between NGOs, the UNSC and human rights, this book argues that both NGOs and the UNSC use human rights semantics in a selective way in regard to the places and actors they affect. It observes knowledge and power, then, as forces that mutually affect one another, which may help to explain how global governance works. Moreover, the book explores the idea that law, aside from permeating traditional structures, can proceed upwards from the base of society towards institutional spheres. In this regard, its author proposes that the interplay between non-state actors and political institutions boosts bottom-up processes related to lawmaking and to the formation of political decisions. Considering critical problems of both NGOs and the UNSC concerning representation and responsiveness, the work asserts that the relationship between them takes place in an excluding, technocratic and arcane manner.

Abstract: The advance in social rights and the progressive occupation of public space as a settin... more Abstract: The advance in social rights and the progressive occupation of public space as a setting for protest and vindication (within the framework of the right to the city) is in tension with the security of people and goods. Thus, securitization, understood as the set of measures that seek to reduce the possibilities of events such as protests (which are seen as a risk), which may cause future harm to human beings and public and private goods in cities, brought with it the fact that in various parts of the world some protests have been prohibited, even perse- cuting opposition groups through arrests or imprisonment. In a certain sense, democracy must move from securitization of protests to securitization of the freedom to protest in order to strengthen, within the framework of cities, the capacity for reflection of social actors in relation to broad social processes open to criticism, enriching political discourse with more voices in a democratic context. Sustenta-se, sob o ângulo da teoria da diferenciação funcional luhmanniana, que pressões desdiferenciantes, nacionais ou não, advindas principalmente do sistema econômico, sobre o sistema político fazem com que tais análises, porquanto concentradas atomisticamente em organizações estatais, sejam insuficientemente complexas. Apresenta-se que a governança hodierna é também de base não política, arcana e tecnicista, instrumentalizando a política estatal, decorrendo daí questões relativas à legitimidade, representatividade e coalizões do sistema político. This paper collects data on normative design, composition, organization and performance of the Co... more This paper collects data on normative design, composition, organization and performance of the Councils of Justice of Brazil and Spain, and identifies the main obstacles to the functioning of both in order to bring closer their institutional experience. The attention is focused on seeking whether the institutionalization of the Councils of Justice in the postauthoritarian constitutional experiences of these countries provides common parameters for understanding judicial practices. By following a systemic-constructivist approach that confronts judicial discourses and practices, the paper calls into question the dogma according to which judges’ autonomy widens the ambit of rights. The hypothesis is that the preservation of the corporate structure and the lack of connection between independence and accountability have contributed to the dysfunctions of such bodies to the detriment of the entire Judicial Power.

ABSTRACT: In Brazil, in addition to formulating discourses and practices that mobilize legal... more ABSTRACT: In Brazil, in addition to formulating discourses and practices that mobilize legal institutions, jurists traditionally have a prominent place in politics orientation, being also able to (re)insert particular normative content in law by criticizing public agents and the political system, as well as by incorporating their own political views into professional practices, obtaining material benefits in this relationship. In this sense, considering the importance of judicial responses in the legitimation assessment of political power exercise after Operation Car Wash, evidenced by research into trust in democracy, one argues that, by presenting themselves as agents of legality and simultaneously violating the law, jurists have contributed to the deepening of the Brazilian political and institutional crisis. Furthermore, by blending law and morality, jurists eroded the democratic bases of legal dogmatics, facilitating the rise of authoritarian political forces. Hence, it is suggested that the instrumentalization of legal forms encourages undemocratic uses of law and has reinforced democratic disintegration after 2014.

Assuming the existence of non-state normativity, it is reasoned that sometypical constitutional p... more Assuming the existence of non-state normativity, it is reasoned that sometypical constitutional problems are currently being settled through anti-constitutionalforms, which may stem from non-domestic law and politics. In effect, it is possible todiscern movements exploiting the shortcomings of democracy, forming non-statenormative flows importing and exporting anti-constitutionalism, and pressuringconstitutional orders to change. In this paper, it is demonstrated that anticonstitutionalcommunications can come from both legal and political systems,and from both state and transnational, non-state movements. In my opinion, albeitaffecting also the central, rich states, anti-constitutional discourses and practices arefinding more fertile ground among the peripheral, weak ones. Illustrating the migrationand implementation of anti-constitutional communications with political examplesand legal cases, I hold that these phenomena are weakening not only modernconstitutionalism as a normative and political fact, but also the conception ofdemocratic constitutionalism as a pivotal normative horizon of world society.Paradoxically, the destruction of modern, democratic constitutionalism throughanti-constitutional norms and political decisions appears to be also based on constitutionalsemantics. I call such a phenomenon ‘trans-anticonstitutionalism’.

The present publication is an effort made by the authors in order to bring awareness to issues related to law, society and institutions, but not neglecting the responsibility of propounding new ideas to object the violation of human rights, anti-feminism, corruption and partiality of judges. Themes that have hit a considerable number of newspapers headlines and polarised public opinion. Justice, the protection of human dignity and gender have undoubtedly drawn the attention of worldwide societies to the limits of political institutions, economic and state powers.

The article aims to show the conflictual nature of the relation between social movements organiza... more The article aims to show the conflictual nature of the relation between social movements organizations that coordinate protests and social systems and the challenges posed for legal and political systems that aspire to be democratic. In the first section, I outline the main theoretical contributions of systems theory regarding protests. The second section shows how securitization comes about, in particular the securitization of protests. Recent examples will then be examined of protests staged by social movements in public spaces and of the reaction of social systems to these. Finally, conclusions will are drawn regarding the link between protests, the freedom to protest occasionally ceded by political or legal systems and the hetero-legitimation of democratic politics. In short, I argue that the securitization of protests may pose a threat to democracy and that, hence, securitization per se can be seen as a threat, in so far as it hinders the inclusion of communications not seen as part of the system and thus stands in the way of democratic hetero-legitimation.

Assuming the existence of non-state normativity, it is reasoned that sometypical constitutional p... more Assuming the existence of non-state normativity, it is reasoned that sometypical constitutional problems are currently being settled through anti-constitutionalforms, which may stem from non-domestic law and politics. In effect, it is possible todiscern movements exploiting the shortcomings of democracy, forming non-statenormative flows importing and exporting anti-constitutionalism, and pressuringconstitutional orders to change. In this paper, it is demonstrated that anticonstitutionalcommunications can come from both legal and political systems,and from both state and transnational, non-state movements. In my opinion, albeitaffecting also the central, rich states, anti-constitutional discourses and practices arefinding more fertile ground among the peripheral, weak ones. Illustrating the migrationand implementation of anti-constitutional communications with political examplesand legal cases, I hold that these phenomena are weakening not only modernconstitutionalism as a normative and political fact, but also the conception ofdemocratic constitutionalism as a pivotal normative horizon of world society.Paradoxically, the destruction of modern, democratic constitutionalism throughanti-constitutional norms and political decisions appears to be also based on constitutionalsemantics. I call such a phenomenon ‘trans-anticonstitutionalism’.

The present publication is an effort made by the authors in order to bring awareness to issues related to law, society and institutions, but not neglecting the responsibility of propounding new ideas to object the violation of human rights, anti-feminism, corruption and partiality of judges. Themes that have hit a considerable number of newspapers headlines and polarised public opinion. Justice, the protection of human dignity and gender have undoubtedly drawn the attention of worldwide societies to the limits of political institutions, economic and state powers.

The article aims to show the conflictual nature of the relation between social movements organiza... more The article aims to show the conflictual nature of the relation between social movements organizations that coordinate protests and social systems and the challenges posed for legal and political systems that aspire to be democratic. In the first section, I outline the main theoretical contributions of systems theory regarding protests. The second section shows how securitization comes about, in particular the securitization of protests. Recent examples will then be examined of protests staged by social movements in public spaces and of the reaction of social systems to these. Finally, conclusions will are drawn regarding the link between protests, the freedom to protest occasionally ceded by political or legal systems and the hetero-legitimation of democratic politics. In short, I argue that the securitization of protests may pose a threat to democracy and that, hence, securitization per se can be seen as a threat, in so far as it hinders the inclusion of communications not seen as part of the system and thus stands in the way of democratic hetero-legitimation.

São aduzidas considerações a sobre a teoria sistêmica luhmanniana a respeito dos direitos humanos, enfatizando-se os desenvolvimentos de Neves. Sustenta-se que esta teoria não observa com a devida atenção o papel de organizações políticas internacionais e atores de movimentos sociais na articulação e afirmação de direitos humanos. Ao final, são expostas considerações a respeito do uso tecnocrático dos direitos humanos, enfocando-se, fundamentalmente, organismos políticos internacionais.

By analysing the relationship between NGOs, the UNSC and human rights, this book argues that both... more By analysing the relationship between NGOs, the UNSC and human rights, this book argues that both NGOs and the UNSC use human rights semantics in a selective way in regard to the places and actors they affect. It observes knowledge and power, then, as forces that mutually affect one another, which may help to explain how global governance works. Moreover, the book explores the idea that law, aside from permeating traditional structures, can proceed upwards from the base of society towards institutional spheres. In this regard, its author proposes that the interplay between non-state actors and political institutions boosts bottom-up processes related to lawmaking and to the formation of political decisions. Considering critical problems of both NGOs and the UNSC concerning representation and responsiveness, the work asserts that the relationship between them takes place in an excluding, technocratic and arcane manner.

Utilizando o Transconstitucionalismo como partitura de suporte, os capítulos apresentados alternam características de fugas e variações musicais. Ora trazem críticas e formulações teóricas que dele se afastam, ora trilham os caminhos transconstitucionais apresentados com modificações ou sugestões, dando espessura à presente obra. O caráter heterogêneo das composições evidenciam as diferentes linhagens acadêmicas de seus autores. Somadas aos comentários e réplicas de Marcelo Neves, dispostos em dois capítulos adicionais, estas composições adensam um provocativo caldo melódico.

The present article builds on systems theory to demonstrate that the flows of people, goods and p... more The present article builds on systems theory to demonstrate that the flows of people, goods and pathological agents are events that mutually affect one another. In turn, the political system acknowledges such phenomena and securitizes pathogens. In this sense, the securitization of diseases is one of the attributions of political organizations such as national states and international organizations, as well demonstrated in the cases of the HIV/AIDS pandemic and the Ebola epidemic, which served as the basis for specific UN Security Council resolutions, and the Zika case. I argue that global politics treats the world periphery with a marginal approach in comparison to how diseases that affect or may affect the populations of rich countries are treated, contributing to the global dynamics of exclusion. For this reason, I point out that the norms related to the global biosecuritization have several problems from a sociological perspective, if observed especially the social and the temporal spheres. .

Resumen: El avance en los derechos sociales y la progresiva ocupación del espacio público como escenario de protesta y reivindicación (en el marco del derecho a la ciudad) se encuen- tra en tensión con la seguridad de personas y bienes. Así, la securitización, entendida como el conjunto de medidas que buscan la reducción de posibilidades de eventos como las protestas (que son vistas como riesgo), que pueden causar daños futuros a seres humanos y bienes públicos y privados en las ciudades, trajo consigo que en varios lugares del mundo comenza- ran a prohibirse las mimas, incluso persiguiendo a los grupos opositores a través de detencio- nes e incluso penas de prisión. En cierto sentido, la democracia debe mudar de una securiti- zación de las protestas a una securitización de la libertad de éstas, con la finalidad de reforzar, en el marco de las ciudadaes, la capacidad de reflexión de los actores sociales en relación a procesos sociales amplios y abiertos a la crítica, enriqueciendo el discurso político con más voces en un contexto democrático.
