Elles sont intervenues a la suite de l'evolution des politiques migratoires en vigueur depuis le debut des annees 2000, qui rendait plus aleatoires les chances de regularisation. Le mouvement est d'abord parti de salaries sans papiers declares, qui se sont mis en greve en occupant leur entreprise pour obtenir leur regularisation. Il s'est ensuite etendu a une population pour laquelle il etait plus difficile de demontrer un lien salarial avec un employeur. Les greves de sans-papiers ont contribue a la reconnaissance de ces travailleurs en tant que salaries legitimes a faire valoir le droit du travail. Elles ont en outre permis une percee des syndicats dans des segments du tissu productif jusqu'alors inaccessibles.

In 2008, a new political figure appeared in the French public sphere: the illegal worker. This ar... more In 2008, a new political figure appeared in the French public sphere: the illegal worker. This article briefly describes this development before exploring the transformations in public policy and institutional practices that—short of naming it—contributed to the emergence of the category of illegal workers. Subsequently, some movements, especially strikes, identified with illegal workers, and this identification had consequences and contradictions that will be explored in the rest of the article.

Por su estatus, los trabajadores sin-papeles pertenecen al «asalariado encastrado» [salariat bridé] (Moulier-Boutang, 1998): sus posibilidades de contestación o de fuga ante el empleador son en efecto limitadas. Sin embargo, el movimiento concertado de huelgas de la primavera del 2008 en la región de París, hizo aparecer situaciones diversas del punto de vista de las forma de empleo así como del contenido mismo del trabajo. Esta diversidad se hace luz a partir del uso estratégico que se hace de las distintas situaciones y posiciones ocupadas: tratar de obtener, como hicieron los huelguista, una regularización a través del trabajo, conduce en efecto a un debate sobre el tipo de trabajo que puede justificar una regularización. Analizaremos aquí el modo en que se desarrollaron estas negociaciones en dos empresas, del sector de la restauración la primera, y la segunda del sector de la limpieza. Presentaremos el modo en que el movimiento ofrece localmente claridades sobre la naturaleza de las relaciones sociales entre empleadores y trabajadores sin-papeles en algunos sectores de la economía formal. Si este movimiento de huelga no aclaró completamente las condiciones de empleo y trabajo de los sin-papeles en Francia, si descubrió sin embargo la pertinencia estratégica de algunos de sus aspectos, ya fuera porque permitían o al contrario impedían la regularización. Este artículo reposa sobre una encuesta colectiva que busca escribir la historia del movimiento de huelga de los trabajadores sin-papeles en Francia. Decenas de entrevistas y observaciones etnográficas han sido realizadas, principalmente con huelguistas y militantes, pero también con empleadores y autoridades. El conjunto de los datos conforma el presente texto, que reposa esencialmente sobre dos monografías realizadas entre el 2008 e inicios del 2009.
Through a historic wave of strikes, France’s sans-papiers (immigrants without papers) became know... more Through a historic wave of strikes, France’s sans-papiers (immigrants without papers) became known as ‘ sans-papier workers’ and renewed their fight for legal status. The state instituted employment-based regularization and unions embraced migrant workers’ access to legal status as a labour issue. Following Bourdieu and Boltanski, this article traces the institutional genesis and political trajectory of the ‘sans-papier worker’ as symbolic category and objective group, highlighting its agonistic coproduction by state policy and union strategy. The study relies on a three-year collective ethnography including participant observation, archive collection and over a hundred interviews with migrant workers, union activists, employers and civil servants. Whereas the new framing initially uncovered the reality of undocumented migrants at work, it gradually became an exclusive category that sorted ‘workers’ from the others. En réponse aux critères restrictifs imposés par le gouvernement, qui réaffirment paradoxalement u... more En réponse aux critères restrictifs imposés par le gouvernement, qui réaffirment paradoxalement une norme d’emploi standard au moment même où se poursuit la politique néolibérale de fragilisation des salariés sur le marché du travail, les grèves de travailleurs sans papiers se sont d’abord appuyées sur les salariés les plus intégrés présentant les propriétés les plus « légitimes ». L’extension du mouvement à des travailleurs plus précaires a impliqué pour les syndicats une double stratégie : une tentative de sortie de la forme d’emploi atypique par la pression sur les employeurs ; une tentative de reconnaissance de la forme d’emploi atypique comme voie d’accès possible et « normale » à la régularisation par la pression sur les pouvoirs publics.
