    1. The Privacy Policy sets out the basis and purpose of personal data processing. The personal data of users (hereinafter: "Users") are process to successfully accept and fulfill User orders collected electronically through the website "orl-rc-cars.com" (hereinafter: "Website") and sales contracts conclusion and execution through the Website.
    2. Website process personal data in compliance with the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council  (EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter "GDPR") and the Data Protection Act of 10 May 2018.

    The data controller is ORHMET - M.ORLOWSKI, M.ORLOWSKA I M.ORLOWSKI SPOLKA JAWNA  with its registered office in Warsaw (00-079), Krakowskie Przedmiescie 81/6, entered into the commercial register of the National Court Register maintained by the District Court for the capital city of Warsaw in Warsaw, XII Commercial Division of the National Court Register, under KRS no. 0000012349, NIP: 5260158290, email address: controller@orhmet.com.pl (hereinafter: „Controller”).

  3. Purpose of personal data processing
    1. Personal data is used for:
      • website user account registration (Article. 6(1)(b) GDPR),
      • website log-in enabling (Article. 6(1)(b) GDPR),
      • the performance of the agreement concerning the provision of the Service's account functionality (Article 6(1)(b) GDPR),
      • User contact (livechat, contact form, etc.) (Article 6(1)(b) GDPR),
      • fulfilment of accounting and tax obligations imposed on us by law (Article 6(1)(c) GDPR),
      • debt recovery (Article 6(1)(f) GDPR),
      • establishment, assertion or defence of claims (Article 6(1)(f) GDPR).
    2. The User is not obliged to provide such data, but it is necessary in order to conclude a contract via the Website or to use other functionalities of the Website.
  4. Type of personal data being processed

    The Controller processes the User's personal data: name and surname, residential address, e-mail address, telephone number, Tax Identification Number.

  5. Period for processing personal data

    Users' personal data will be processed for the period of:

    • until the statute of limitations for claims relating to contract performance has expired, in case when processing is based on the performance of a contract.,
    • until revocation of consent, and after revocation of consent until the statute of limitations for claims relating to processing without consent, in case when the basis for data processing is user’s consent.

    In both cases, the limitation period is six years, and for periodic benefit claims and claims relating to the conduct of business, three years (unless a specific provision provides otherwise).

  6. Sharing personal data
    1. Your personal data is processed to successfully accept and fulfil your order. We may need to share your personal data with third parties to do this, such as storage and delivery companies, banks and online payment providers. Where possible, we'll provide you with information on the processing of your personal data received from a third party.
    2. Users' personal data will not be transferred outside the European Economic Area (EEA).
  7. Rights of the data subject
    1. You have the right to access your data, the right to demand its rectification, removal or restriction of its processing and the right to data portability. At your request, the Controller will provide a copy of the personal data to be processed, but for any subsequent copies you request, the Controller may charge a reasonable amount resulting from administrative costs.
      You have the right to object to the processing of your personal data.
      You have the right to withdraw your consent at any time. Withdrawal of the consent does not affect the lawfulness of the processing that was made on the basis of the consent before its withdrawal.
      To the extent that your data is processed in an automated way to perform and conclude the contract, or processed on the basis of consent, you also have the right to transfer personal data (such as to receive personal data from the Controller) in a structured, commonly used machine-readable format. You may send this data to another data Controller.

    3. The Controller shall fulfil or refuse to fulfil the request immediately - within a maximum of one month of reception.
    4. The user has the right to file a complaint to the President of the Personal Data Protection Office (address: Stawki 2, 00-193 Warszawa, www.uodo.gov.pl), if he considers that the processing violates his rights and freedoms (GDPR).
  8. Cookies - general information
    1. Our website uses own cookies and third-party cookies. We use cookies in order to improve the experience of visiting our website and to allow visitors to use certain functions, and to conduct statistical analyses of visits at our website. Cookies are small text files created automatically by the browser and saved on the user's device (laptop, tablet, smartphone, etc.) when visiting a website. Cookies are not harmful for the user's computer and they do not contain viruses, trojans or any other malware. Cookies store information connected with the use of a given device. However, it does not mean that based on such information we gain direct knowledge about the identity of the user.

  9. Automated decision making and profiling
    1. Users' data cannot be automatically processed in such a way that any decision which produces legal effects concerning users can be taken.
    2. Users' data may be profiled in order to adapt the content and personalize offers once they have given their consent..
  10. Final provisions
    1. The Controller has the right to make changes to the Privacy Policy, but Users' rights will not be limited.
    2. Information about the changes will appear in the form of a message available on the Website..
    3. In matters not regulated in this Privacy Policy, the provisions of the GDPR and the provisions of Polish law shall apply.
