Témou dizertačnej práce je legislatívny rámec mediálneho systému Slovenskej republiky s ohľadom na slobodu médií. Zameriava sa na formovanie úpravy regulácie prístupu k masmédiám a regulácie obsahu masmédií po roku 1989. Pomocou analýzy a interpretácie právnych predpisov, judikatúry, návrhov zákonov a súvisiacich dokumentov skúma premeny vybraných inštitútov masmediálneho, respektíve tlačového práva, ktoré upravujú postavenie médií, prípadne jednotlivé práva a povinnosti novinárov, a to v dlhodobej perspektíve. Výsledkom by malo byť zachytenie vývojových trendov vo vzťahu medzi pozitívnym právom a normatívnou ideou slobody médií.

The purpose of the present paper is to identify the legal position and role of the right of reply within the European concept of media law. We wish to find an answer to the question whether the right of reply constitutes a limitation to the freedom of the press or if it is to be understood as a means of exercising freedom of opinion (or both, perhaps). We shall also try to identify the common foundations of the regulation of the right of reply and its general, or at least, most common, manifestations in Europe. According to our preliminary hypothesis, the right of reply is a legal instrument serving both the person whose (personality) rights have been violated (the applicant in the legal procedure) and the public wishing to access a wide variety of information via the media. The conclusions of the paper shall confirm or refute this hypothesis.

Transparency and the safeguarding of press credibility are the basis of the so-called “media accountability.” This concept is closely linked to the importance of journalism in any democratic society, where it has been assigned the enormous responsibility of informing truthfully while giving a voice and listening to citizens. The right of reply must be understood as an accountability instrument that satisfies the audience’s right to participate in the communication process while reinforcing the credibility of the press itself, and, ultimately, trust, which is fundamental for the tacit agreement between the audience and the press in any democracy. In the field of communication there is no research on the importance of the right of reply as an accountability instrument and no one has addressed the way replies—sent to newspapers by those affected by the news—are published. The aim of this research is to verify whether the main Spanish newspapers fulfill their duty to publish replies, taking into consideration legal requirements as well as ethical guidelines established by professional self-regulation. To this end, the study examines whether replies have a regular or marginal presence in El País, El Mundo, La Vanguardia and ABC and identifies these newspapers’ criteria regarding legal requirements and minimum ethical standards when publishing replies.

The article seeks to examine whether it would be feasible to recognize Internet Service Providers as being legally obliged to adapt the code of their applications in such manner as to contribute to better enabling individuals to exercise the right of reply online. The paper adopts the premise that there is no way to guarantee rights without also considering duties, identifying in the Brazilian 1988 Constitution, inter alia, the duty to protect a balanced environment. The article argues for a " digital environment " , as opposed to the overused concept of cyberspace, in order to include Internet Service Providers within the scope of this duty of protection. Next, valuing the importance of architecture of code for the eff ective fulfi lment of rights and duties in the digital environment, the paper aims to diff erentiate between types of service providers, seeking to ensure the imposition of proportional duties on individuals, with a view to obtaining a practical accommodation between the duty of protection and costs attached thereto. Finally, a suggestion is put forward that Internet Service Providers should commit themselves to making slight modifi cations in the code of popular applications, in order to contribute to enhancing the eff ective exercise of the right of reply on the Internet.
