RESUMO O trabalho investiga os principais defeitos do microssistema dos juizados especiais cíveis. A partir do modelo constitucional de processo justo, examinam-se o princípio da paridade de armas no procedimento sumaríssimo e as garantias que podem ser renunciadas pelas partes, bem como a possibilidade de o magistrado retirar das partes mais garantias processuais, além das que o legislador expressamente subtraiu. One of the important features of arbitration is its speed. A question should be asked as to whether there is a legitimate need for separate regulation of small claims in commercial arbitration proceedings in Polish law, in particular, due to its more informal character and greater discretion of arbitrators, and if so, one ought to ask about the location of the regulation of this institution. Small claims have fundamental importance for commercial arbitration proceedings because they guaran- tee the implementation of speed in arbitration. Jedną z ważnych cech arbitrażu jest jego szybkość. Należy zadać pytanie sobie, czy istnieje uzasadniona potrzeba odrębnego uregulowania small claims w arbitrażu handlowym w prawie polskim, w szczególności ze względu na jego bardziej nieformalny charakter i większą swobodę arbitrów, a jeśli tak, to należy zapytać o lokalizację regulacji tej instytucji. Small claims mają fundamentalne znaczenie dla postępowań w arbitrażu handlowym handlu, ponieważ gwarantują szybkość w arbitrażu.
