REGULATION ORDINANCE NO. 2014-194
AN ORDINANCE IMPOSING STIFFER PENALTIES ON BARKERS
Sponsored by Councilor Plaridel C. Nava II, duly seconded by
Councilors Lady Julie Grace L. Baronda, Nielex C. Tupas, Jason
R. Gonzales, Lyndon V. Acap and Carlos P. Guarin
WHEREAS, Republic Act 7160 otherwise known as the Local Government Code of
1991, empowers the Sangguniang Panlungsod to enact ordinances to promote and maintain
peace and order within its exlusive jurisdiction;
WHEREAS, the Iloilo City Peace and Order Council (ICPOC) has approved Resolution
No. 1 thereby identifying the barkers as menace to the society and detrimental to the transport
sector;

WHEREAS, the proposed ordinance is in harmony with the policy of'the State to protect
its citizens from acts inimical to their welfare and interest. This ordinance is neither unfair,
oppressive, discriminatory aor unreasonable.

NOW, THEREFQRE, be it ordained by the Sangguniang Panlungsod of the City of


Iloilo, in session assembl~, that:

Section l'. - The prdinance shall be known as "THE ANTI-BARKER ORDINANCE


OF THE CITY OF ILO~O";
Section 2. - It sh~ll be unlawful for any person, to loiter and wander in public places,
open parking spaces, and ~esignated loading and unloading areas and intermittently performing,
doing and acting as barker for any public utility jeepneys, vans, taxis and buses even with prior
consent from the driver or from any transport organization;'
Section 3. - A BARKER is an individual or person who calls for, facilitates, induces or
convinces commuters to board a particular or preferred public utility vehicle such as jeepney,
taxi, van and bus for the PurJ>ose of extracting an amount from the driver; one whose occasional
occupation is to attract or call a crowd or patrons by the use of loud voluble glib speech in order
to obtain money or profit;
Section 4. - A transport group shall be allowed to employ a dispatcher with proper
identification card with photograph and duly signed by its President. A dispatcher is an
individual or person duly authorized or accredited by the transport group to manage and
supervise the parking, loading of passengers and the send off of the public utility vehicle in an
orderly fas~within its designated parking area without collecting any fee from the driver;
Section 5. - Any person or individual acting and performing as barker shall be criminally
liable and shall be immediately apprehended and detained. If found guilty by the appropriate
co rt, the barker shall suffer an imprisonment of not less than three (3) months but not more
t an six (6) months at the discretion of the court;
Section 6. - Repealing Clause. All existing ordinances, executive orders, regulations or
parts thereof in conflict with any of the provisions of this ordinance are hereby repealed,
amended and revised.
Section 7. - Separability Clause. If any provision of this ordinance is held invalid by a
competent court, the remained provision shall not be affected thereby.
Section 8. - Effectivity Clause. This ordinance shall take effect after ten (10) days from
publication in a newspaper of general circulation in the City oflloilo.
