EXECUTIVE ORDER NO. 09


Series of 2020

“AN EXECUTIVE ORDER RECONSTITUTING THE PEOPLE’S LAW


ENFORCEMENT BOARD (PLEB) OF THE MUNICIPALITY OF MUTIA,
ZAMBOANGA DEL NORTE”
 
WHEREAS, pursuant to Memorandum Circular No. 91-002 of the National
Police Commission (NAPOLCOM), as amended, dated April 8, 1991 there shall be
created by the Sangguniang Panglungsod / Bayan in every city/municipality such number
of People’s Law Enforcement Boards (PLEBs) as may be necessary: Provided that there
shall be at least one (1) PLEB for every five hundred (500) city or municipality police
personnel.

NOW, THEREFORE, I, LORRYMIR S. ADASA, Municipal Mayor of Mutia,


Zamboanga del Norte by virtue of the powers vested in me by RA 7160 otherwise known
as Local Government Code 1991 do hereby reconstitute the People’s Law Enforcement
Board (PLEB) of the Municipality of Mutia, Zamboanga del Norte.

Section 1. Creation of the People’s Law Enforcement Board

There is hereby a reconstituted People’s Law Enforcement Board whose primary


task is to hear and   decide citizen’s complaints filed against erring member of the PNP of
the Municipality of Mutia, Zamboanga del Norte.
Section 2. Composition of the People’s Law Enforcement Board 

The People’s Law Enforcement Boards (PLEB) shall be composed of the


following:
1. Any member of the Sangguniang Panglungsod/Bayan chosen by his respective
Sanggunian;
2. Any barangay captain of the city or municipality concerned chosen by the
Association of Barangay Captains and;
3. Three (3) other members who shall be chosen by the Peace and Order Council
from among the respected members of the community known for their probity and
integrity, one (1) of whom must be a member of the Bar or, in the absence thereof,
a college graduate or the principal of the elementary school in the locality.

The Chairman of the PLEB shall be elected from among its members.
Hence, the following is the composition of the People’s Law Enforcement Board
of the Municipality of Mutia:

Section 3. Issuance of Order to PLEB Members

Upon issuance of a resolution by the Sangguniang Bayan formally organizing the


Board, the municipal Mayor shall issue the corresponding order implementing the
decision of the Sangguniang Panglungsod/Bayan, the Association of Barangay Captains
and the City/Municipality Peace and Order Council on their respective chosen
representative to the PLEB.
 
Section 4. Oath of Office
 
Before assuming the duties of their office, the Chairman and Members of the
PLEB shall take the oath or affirmation before an administering officer, which shall be
filed with the office of the National Police Commission in the region where the PLEB is
situated.
 
Section 5. Term of Office
 
The term of office of the members of the PLEB shall be for a period of two (2)
years from assumption to office. Such member shall hold office until his successor have
been chosen and qualified.
The tenure of office of the PLEB member who has been designated as such by
virtue of his election to the Sangguniang Panglungsod/Bayan or his membership with the
Association of Barangay Captains ends upon the expiration of his term of office as
Sangguniang Panglungsod/Bayan member or Barangay Captain. If re-elected, and
subsequently re-designated to the PLEB, he must take a new oath of office.
 
Section 6. Compensation.
 
The membership in the PLEB is a civic duty, however, PLEB members may be
paid per diem as may be determined by the city or municipality council from the city or
municipal funds.
 
Section 7. Quorum.
 
The presence of the majority of all the PLEB members appointed shall constitute a
quorum.
The Board shall be determined by a majority vote of its members.

Section 8. Disqualification by Reason of Affinity or Consanguinity


 
Any member of the PLEB who is related to the complainant or respondent by
affinity or consanguinity within the fourth civil degrees shall be disqualified from
participating in the proceeding and the case shall be tried by the remaining members.
Provided that there is sufficient number to constitute a quorum, in the event that the
PLEB could not proceed with the hearing for lack of quorum, the Peace and Order
Council of the city/municipality concerned shall appoint temporary member/s to try and
decide the specific case only.
 
Section 9. Powers and Duties
 
The PLEB shall have the power to hear and adjudicate all administrative
complaints formally filed with, or referred to it, against any member of the PNP and to
impose the corresponding penalty. In the exercise of its functions, the PLEB acting
through its chairman is empowered to administer oaths, summon witnesses, require the
production of documents, records, books, or other things by a subpoena duces tecum and
issue other processes as maybe necessary. Applying the provisions of Article 152,
Chapter IV, Title III, Book II of the Revised Penal Code, the members of the PLEB are
considered as persons in authority.
 
Section 10. EFFECTIVITY 

This Executive Order for the Local PLEB reconstitution shall take effect
immediately.
