    SandovalAGutierrez,$J.$ provision! was! only! applicable! to! criminal! proceedings! and! not! to!
    $ extradition.! Modern! trends! in! international! law! gave! primary!
    Petitioner:$ importance! to! the! worth! of! the! individual! person! and! the! sanctity! of!
    GOVERNMENT!OF!HONG!KONG!SPECIAL!ADMINISTRATIVE!REGION! human! rights,! presently! making! the! human! person! a! valid! subject! of!

    A! Petition! for! Certiorari! seeking! to! nullify! the! two! orders! of! a! in! Mejoff' vs.' Director' of' Prisons! that! a! prospective! deportee! was! also!
    Manila! RTC,! namely:! (1)! an! order! on! December! 2001! allowing! private! entitled!to!bail.!
    J.A.! Muñoz! to! post! bail;! and! (2)! and! order! denying! the! motion! by! the! !
    Hong! Kong! Administrative! Region! (HKAD),! represented! by! the! DOJ! to! Both! extradition! and! deportation! are! administrative!
    vacate!the!December!2001!order.!This!petition!was!filed!on!the!ground! proceedings,! where! the! innocence! or! guilt! of! a! person! is! not! an! issue.!
    that! there! is! no! constitutional! provision! granting! bail! to! a! potential! But! extradition! involves! a! “deprivation! of! liberty! on! the! part! of! the!
    extraditee.! potential!extraditee,!and!“the!means!employed!to!attain!the!purpose!of!

    provisional!arrest!and!detention!from!1999!to!2001!upon!the!request!of! prohibiting!him!from!exercising!his!constitutional!right!to!post!bail.!
    HKAD!for!charges!of!bribery!and!conspiracy!to!defraud!before!the!Hong! !
    Kong!court.!In!November!1999,!HKAD!filed!a!petition!for!extradition!of! The! applicable! standard! of! due! process,! however,! is! different!
    respondent!Muñoz!while!at!about!the!same!time,!he!filed!a!petition!for! between!extradition!and!criminal!proceedings.!In!the!latter,!due!process!
    bail.!The!first!judge!(Bernardo,!Jr.)!denied!the!bail!on!the!grounds!that! is! premised! on! the! presumption! of! innocence! of! the! accused.! In! the!
    the! Philippines! has! no! law! granting! bail! in! extradition! cases! and! that! former,!the!potential!extraditee!is!considered!as!a!“high!flight!risk”,!and!
    respondent!is!a!“high!flight!risk”.!On!October!2001!an!MR!was!filed,!and! is!assumed!as!a!fugitive!from!justice.!In!posting!bail,!he!bears!the!onus'
    in! December,! respondent! judge! Felixberto! Olalia,! Jr.! granted! bail! to! probandi' of! showing! that! he! is! eligible! for! the! grant! of! bail.! An!
    respondent! Muñoz! worth! P750,000.! Petitioner! immediately! filed! a! extradition!proceeding,!being!a!sui'generis,'requires!a!standard!of!proof!
    motion!to!vacate!the!order!but!this!was!denied!by!respondent!judge.! for! bail,! and! according! to! Justice! Puno! in! Purgnan,' only! “clear! and!
    ! convincing!evidence”!will!be!considered.!Private!respondent!did!not!yet!
    ISSUE:$$ present!any!evidence!to!show!that!he!was!not!a!“flight!risk”.!
    Whether! or! not! the! constitutional! provision! on! bail! applies! to! !
