OPPOSITION
[TO THE PETITION FOR THE DECLARATION OF NULLITY OF MARRIAGE ]

RESPONDENT, by counsel, respectfully opposes the motion of plaintiff for

declaration of nullity of marriage, and in support of such opposition do hereby states:

1. Respondent is a Filipino citizen, of legal age, currently employed at

married to petitioner. She may be served with summons and other pertinent orders

and processes of this Court at 44 Rockwell Village, Makati City.

2. Petitioner is a Filipino citizen, of legal age and married to respondent.

For purposes of this petition, he may be served with notices and other pertinent

processes through counsel at 501 OMG Building, Jupiter Street, Makati City.

3. Petitioner and respondent were married on 30 April 2007 and out of

this marriage, they have one (1) child, Amanda Galang who is six (6) months old. A

copy of the Marriage Contract executed by petitioner and respondent is attached as

ANNEX A, while a copy of Amanda’s birth certificate is attached as ANNEX B.


4. The marriage license used when they were married was issued on 1

January 2007 and is valid only for one hundred twenty (120) days.

5. Petitioner’s application of the one-hundred-twenty-day rule is

erroneous. The correct application of the Rule is to exclude the first day and include

the last day. Therefore, as of 30 April 2007, the 30 th day from the date of the

marriage license issuance, the said license was still valid. Thus, the marriage of

petitioner and respondent is likewise valid.

PRAYER

WHEREFORE, it is respectfully prayed that Petitioner ARMAN

GALANG’s petition for Declaration of Nullity of Marriage be denied.

Other just and equitable reliefs are also prayed for.
