OF CARMEN, AGUSAN DEL NORTE, IN ITS 4 th RSPECIAL SESSION HELD ON MAY 3, 2020 AT THE

AN ORDINANCE PROHIBITING AND PENALIZING ANY FORM OF


DISCRIMINATION AGAINST MEDICAL AND NON-MEDICAL
FRONTLINERS DURING PUBLIC HEALTH CRISIS

WHEREAS, Article II, Section 11 of the 1987 Philippine Constitution provides that the
“State values the dignity of every human person and guarantees full respect for human rights”.

WHEREAS, in the midst of the recent public health crisis brought about by the threat of
COVID-19, now categorized by the World Health Organization as a pandemic, a new form of
discrimination has become prevalent, targeting the “Frontliners” or the people who are in the
frontlines in the fight against the spread of the COVID-19 virus, including health professionals
and other medical staff personnel, as well as non-medical frontliners like law enforcement
officers and government officials, and even employees of establishments providing basic
services in this health crisis.

WHEREAS, the Department of Health has received various reports regarding


discrimination against the frontliners such as refused basic services like public transport and
laundry service, refused entry to supermarket or grocery stores, or being evicted from their
lodging houses and apartment due to the fear of contamination.

WHEREAS, instead of discrimination, fear and hate against the frontliners, they deserve
to treated as modern-day heroes as they put their lives at stake to respond to the public health
crisis and thus need the support and protection of the government.

NOW, THEREFORE –

BE IT ORDAINED by the Sangguniang Bayan of Carmen, Agusan del Norte, in session


duly assembled, that:

SECTION 1. TITLE. – The Ordinance shall be known and cited as the “Frontliners
Protection Ordinance of the Municipality of Carmen, Agusan del Norte”.

SECTION 2. DEFINITION OF TERMS. – As used in this Ordinance.

1. Frontliners – refers to medical and non-medical personnel, whether from the


private or public sector, who are on the frontlines in provision of essential
services in the face of public health crisis, such as:

a. Private and government doctors, nurses and other medical personnel


and health volunteers;
b. Hospital workers, administrative staff, janitors and security personnel;
c. National and local government officials and employees in the exercise
of frontline functions;
d. Members of the Philippine National Police (PNP), Armed Forces of the
Philippines and other law enforcement personnel;
e. Emergency responders like members of the Philippine Red Cross.
Bureau of Fire Protection. Disaster Risk Reduction and Management
office, and Barangay Health Emergency Response Team;
f. Employees and personnel of establishments providing needed
services like funeral parlors, manufacturers of medical supplies, and
those providing basic services.

2. Discrimination – for the purpose of giving effect to this Ordinance, refers to


any act or action committed to manifest prejudice, bigotry, unequal
treatment, exclusion, restriction, humiliation and vilification towards any
frontliner by reason of his or her work during a public health crisis.

SECTION 3. PROHIBITED ACTS. – It is hereby prohibited to discriminate against any


person or group of persons considered as frontliners during a public health crisis. Specifically, It
is unlawful for any person, natural or juridical, to commit the following against any frontliners:

a) Deny access to public programs and services otherwise available to the


public;
b) Refuse admission or expel from public markets, supermarkets, groceries,
bakeshops and convenience stores;
c) Refuse entry or eject from usual accommodation in any lodging house,
apartment, motel or hotel or give inferior accommodation or services by
reason of his/her work as frontliner;
d) Deny access of admission to medical and other health services, or give
inferior accommodation or services by reason of his/her work as frontliner;
e) Deny access to and/or use of private and public establishments, facilities,
utilities, transportation services that are open to the general public.

SECTION 4. PENALTIES.

a) First offense: Fine of One Thousand Pesos (₱1,000.00) or an imprisonment of


one (1) day to Ten (10) days, or both at the discretion of the court.

b) Second offense: Fine of One Thousand Five Hundred Pesos (₱1, 500.00) or an
imprisonment of one (1) day to Fifteen (15) days, or both, at the discretion of
the court.

c) Third offense or oftener: Fine of Two Thousand Five Hundred Pesos


(₱2,500.00) or an imprisonment of one (1) day to Thirty (30) days, or both, at
the discretion of the court.

SECTION 5. DUTY OF THE MUNICIPAL ADMINISTRATOR. – The Municipal Administrator


shall disseminate or post in conspicuous places within the Municipality of Carmen, Agusan del
Norte a copy of this ordinance. In addition, the Municipal Administrator shall coordinate with
all the Punong Barangays of the Municipality of Carmen, Agusan del Norte in order to see to it
that a copy of this Ordinance shall be posted in conspicuous places within their respective
Barangays.

SECTION 6. SEPARABILITY CLAUSE. If any herein section or part of the ordinance be


declared unconstitutional or invalid, other provisions which are not affected thereby shall
continue to be in force and in effect.

SECTION 7. REPEALING CLAUSE. All other existing resolutions, ordinance or rules, which
are inconsistent with the provisions of this ordinance, are hereby repealed or modified.

SECTION 8. EFFECTIVITY. This Ordinance shall take after its approval.
