PETITIONERS/A-1 TO A-5 U/SEC.437 Cr.P.C.

1. The petitioners herein are arrayed as accused No.1 to 5 in the above


case which is registered by the respondent for the offences punishable
under sections 379, r/w 34 IPC, Sec.35 of AP WALTA Act and Sec.21
of Mines & Minerals Act.

2. The petitioners are remanded to the judicial custody by the Hon’ble


Spl. Judicial Magistrate of First Class (Proh. & Excise Cases),
Anantapuramu on 14-10-2019. No similar application is filed or
pending either before this Hon’ble Court or any other court including
the Hon’ble High Court of A.P.

3. The brief case of the prosecution as seen from the First Information
Report is that the Circle Inspector of Anantapuramu Rural Police
Station received credible information and that the C.I., along with his
staff went to Kamarupalli Vanka area. It is alleged that the police
noticed 5 tractors loaded with sand in attached trolley proceeding
towards Anantapramu side. It is alleged that on seeing the police the
drivers of the tractors stopped the vehicles and tried to ran away. The
police apprehended them and enquired them. It is alleged that the
said tractor drivers voluntarily confessed that on the instructions of
their respective owners they collected the sand illegally so as to sale
the same for higher rates. It is alleged that the police seized 5 tractors
loaded with sand under a cover of police proceedings and took the
custody of the said tractor drivers.

4. The case of the prosecution is totally false and the petitioners are
implicated in this case due to political influence and pressure.

5. The petitioners submit that the police falsely implicated the


petitioners based on inadmissible confession statement. There is
absolutely no evidence except the inadmissible confession statement
recorded by the police and the alleged confession statement is
fabricated to the dictation of the complainant police. The petitioners
beg to submit that the petitioners have no reason to make a
confessional statement before police as the petitioners never involved
in the alleged crime.

6. The petitioners are respectable, law abiding persons and having deep
roots in the society. The petitioners are not likely to abscond. The
petitioners will not jump bail and will not tamper with the evidence
and undertakes to abide by all the terms and conditions imposed on
them while releasing them on bail. The petitioners are ready and
willing to prove their innocence in due course of law and the
petitioners have absolutely no intention to evade the process of law
being vested upon them.
7. It is further submitted that the petitioners are ready and willing to
furnish sufficient security to the satisfaction of this Hon’ble Court in
the event of their release on bail.

8. It is therefore prayed that this Hon’ble Court may be pleased to


enlarge the petitioners on bail pending disposal of the case in the
interests of JUSTICE.
